VAC1980-00001 15. PROPOSED KATHERINE STREET GREENWAY DEDICATION (a) Public Works Director explained that the proper procedure had not been applied and he would need to re-collect signatures on the proper documents. (b) Steve Allision, 10265 SW Katherine Street, expressed his dismay that more time and effort would be required. Public Works Director stated that he would do the foot-work this time. (c) Council requested that this be brought back as quickly as possible. 16. STATUS REPORT REGARDING COMPUTER CONTRACT NEGOTIATIONS (a) City Administrator reported that the Wang hardware is finished and can be shipped at any time. He went on to report that negotiations with Telios are progressing and a first draft contract could be expected this week. He explained that the current negotiations would have Telios sub-contracting with Cogebec for the soft-ware and we would contract solely with Telios who would be responsible for the proper functioning of the system. He went on to say that the payment system would require payment for each component as it is installed and certified to be operational. 17. STATUS REPORT REGARDING SW HILLVIEW STREET L.I.D. (Sewer) (a) Public Works Director reported that a petition had been received from the four property owners affected. He recommended that staff investigate the proposed project, and if possible do the engineering work in-house. Council concurred. 18. RESOLUTION No. 80-27 A RESOLUTION AMENDING THE TIGARD/WASHINGTON COUNTY URBAN PLANNING AREA AGREEMENT, AS APPROVED BY COUNCIL ACTION ON DECEMBER 17, 1979. (a) Planning Director reported that he felt an amendment was needed in the Urban Planning Area Agreement as specified in the resolution. He felt that the proposed language would be more clear. (b) Councilman Brian stated that the original language would serve to insure that development would be compatible with future urbanization not only with the comprehensive plan. (c) Motion by Councilman Brian, seconded by Councilwoman Stimler to approve the amendment by passing Resolution No. 80-27. Approved by 3 to I vote of Council. Councilman Scheckla voting Nay. 19. RESOLUTION No. 80- RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE FINAL PUBLIC IMPROVEMENTS CONSTRUCTED WITHIN PATHFINDER NO. 2 SUBDIVISION. (a) Public Works Director reported that the final. inspection had been made and recommended approval. PAGE 4 - REGULAR MEETING MINUTES - MARCH 24 , 1980 17. SCHOLLS TRUNK SEWER AGREEMENT (a) Legal Counsel explained that this item has been considered by Council for two years now, and finally is ready for passage. He reported that this would transfer ownership of the sewer trunk from Wedgewood Homes and Amart Development to the City. He went on to report that the only change from the last draft reviewed by Council. was the insertion of the dollar figure and an increase in the interest rate from 67 to 9%. He recommended approval. (b) Councilman Brian questioned who would assume the administrative costs. Legal Counsel explained that this would be the responsibility of the City. He went on to say that he would not recommend to amending this particular case now, but would suggest provisions in future agreements. (c) After much discussion by Council regarding the relationship between this project and the Patterson issue, it was moved by Councilman Cook and seconded by Councilman Brian to authorize the Mayor and City Recorder to sign and execute the agreement. Approved by unanimous vote of Council. 18. RESOLUTION No. 80-19 A RESOLUTION OF THE TIGARD CITY COUNCIL REQUESTING AN IN BOUNDARY REVIEW ANNEXATION PETITION' BE FORWARDED TO THE COMMISSION (Richard Smith Annexation) (a) Planning Director after pointing out the lot in question explained that this was a simple case of sewer failure and recommended approval. (b) Motion by Councilman Cook, seconded by Councilwoman Stimler to approve. Approved by unanimous vote of Council. 19. RESOLUTION No. 80-20 A RESOLUTION OF THE TIGARD CITY COUNCIL REQUESTING AN ANNEXATION PETITION BE FORWARDED TO THE BOUNDARY REVIEW COMMISSION (Bowles/74th Avenue) (a) Planning Director recommended approval. (b) Motion by Councilwoman Stimler, seconded by Councilman Brian to approve. Approved by unanimous vote of Council. 20. KATHERINE STREET VACATION PROPOSAL (a) Public Works Director referring to the memo provided to Council reported that there were three ways of dealing with this issue: 1) Do nothing; 2) Vacate the right-of-way and re-dedicate to greenway use; and 3) Vacate the right-of-way but retain the easement. He recommended the second option as this would offer the residents the most protection, even though it might be time consuming and costly. (b) Council discussed the burden of expense and requested that staff present both the first and second options to the residents and report back to Council. RESOLUTION No. 80-21 A RESOLUTION CONCERNING VACATION OF A PART OF A CERTAIN REAR LOT EASEMENT IN YE-OLDE WINDMILL SUBDIVISION IN THE CITY OF TIGARD, WASHINGTON COUNTY, OREGON. (a) Public Works Director referring to the previous discussion at study session recommt�nded approval with the amendment from 2.5 feet to 5 feet in the second paragraph of the Resolution and in the second paragraph of Exhibit B. (b) Motion by Councilman Brian, seconded by Councilman Cook to approve. Approved by unanimous vote of Council. 22. OTHER (a) Councilman Scheekla asked regarding the status of the water runoff problem on Mr. Gaarde's property. Public Works Director reported that negotiations were continuing. (b) Planning Director reported that Associate Planner, Ken Selby was resign- ing to accept a position in Alaska. (c) Public Works Director reporting that the earlier negotiations for the sewer jet and vacuum had "fallen through, but that another sewer jet might be available. He requested that Council authorize him to negotiate on this new jet with the same latitude as before but with a $14,000 maximum. Motion by Councilman Cook, seconded by Councilwoman Stimler to authorize staff to negotiate as before for a sewer jet with a maximum of $14,000. Approved by unanimous vote of Council. (d) Chief reported that the Usury Advisory Board on the 911 system would be meeting on March 31 and said that he planned to attend. REGULAR SESSIGN' ADJOURNED: 9:00 P.M. PROCLAMATION - GIRL SCOUT WEEK (a) Mayor read the proclamation declaring the week of March 5th Girl Scout Week in the City of Tigard. (b) Representatives from Girl Scout Troup #512 thanked the City and Mayor and presented him with a calendar, carnation, and a box of Girl Scout cookies. 3. LOAVES & FISHES REQUEST (a) City Administrator explained the history of the Loaves & Fishes levy and requested that Council direct staff to prepare the necessary ordinance to allow the Loaves & Fishes levy to appear on the May 20, 1980 ballot. He explained that the levy this year would apply a $.0129/$1000 assessed valuation tax as compared to last year's $.0142/$1000, for a total levy request of $6,000. (b) It was the consensus of Council to direct staff to prepare the necessary ordinance and bring it back to Council on March 11, 1980 for final con- sideration. 4. KATHERINE STREET VACATION PETITION (a) Public Works Director displayed a map of the area in question and recom- mended that Council not grant the vacation. He explained that vacating the property would allow it to return to the private domain, and that, as this land was both in the floodplain and in the greenway, it was in the City's interest to have it remain publicly owned. (b) Councilwoman Stimler expressed the concern of the residents that the parcel not become a street in the future. (c) Public Works Director indicated that there were more appropriate tech- niques for accomplishing this (i.e. dedicate the land to some other pur- pose than casement) , and said that he would research procedures and come back to Council with a recommendation. 5.
