AN ORDINANCE GRANTING A 'LONE CHANGE AND APPROVING CONDITIONAL-
USE WITH RESPECT TO LA14DS OF HOWARD S. GASS and MARGARET A. GASS,
being Lots 10 through 20, inclusive, and Lots 31 through 35, inclusive,
Graham Acres, Washinzton County, Oregon.
WHEREAS, the hereinafter described lands, by action r , `�^ City
Council of the City of Tigard, Oregon, pursuant to the 'Zoning; Code of
said city, have heretofore been limited in use to those uses permitted
by said Code under, and have been classified and koned for R-7 (Resi-
dential) purposes; and
WHEREAS, pursuant to prebcribed procedures, the owners of said
lands have applied to the City of Tigard for reclassification of said
property and cnange of zone thereof to permit the use thereof for
A-2 (Multiple Dwelling) purposes, and said application has been duly
publicized and public hearing held by the City Planning Commission on
, after due and legal notice; and
WHEREAS, the City Planning Commission has recommended approval of
said zone change to the City Council, subject to the conditions herein-
after set forth, and notice of City Council hearing thereon having been
duly giver, by publication in the Tigard Times, and the City Council
having conducted said hearing at its regular meeting of October 14,
1968, the Council finds that said lands are well-adapted to and meet
the criteria for Apartment Residential development under the A-2
(Multiple Dwelling) classification, subject to the conditions pre-
scribed by the Planning Commission; and the Council further finds that
it is in the public interest that said conditional use and zone change
be approved and granted.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS A� FOLLOWS:
Section 1: ` nat the lands hereinafter described, be, and the name are,
hereby reclassified to permit the use thereof for Apart-
ment Residential development under the A-2 (Multiple Dwelling) Classi-
fication of the Zoning Code of the City of Tigard, subject to the con-
ditions as hereinafter stated:
Lots 10 through 20, inclusive, and Lots 31 through 35,
Inclusive, GRAHAM ACRES, Washinfr,ton County, Oregon,
EXCEPTING that portion conveyed to the State of Oregon
by deed recorded September 22, 1961 in hook 450, page 126
records of Washington County, Oregon, and EXCEPTING that
portion lying; within the boundaries of Beaverton-Tigard
Highway, as said highway has been relocated.
The above lands shall be and remain subject to each and
all of the following conditions and requirements:
Pare I - ORDINANCE No.hB-
1. Restricted by covenants recorded in the Deed Records
of Washington County, Oregon to Plan #103 prepared
by Phillip Balsiger and Associates, to a total of
apartment units not to exceed 150.
2. Dedication of street as shown in the aforementioned
Plan #103, to the public or to the City of Tigard,
and improvement of said street in accordance with
the Subdivision Ordinance of the City of Tigard prior
to construction of any apartment units.
3. Vacation of existing dedicated roadways which conflict
with the orderly development in accordance with
Plan #103 prepared by Phillip Balsiger and Associates.
Section 2: It is further ordered that no building; permits shall be
issued by the Buildirg Department of the City of Tigard
until. the foregoing requirements have been met and approved by the
proper City officers.
Section 3: This ordinance shall be effective on the 31st day after
its enactment by the City Council of Tigard, Oregon.
PASSED: By unanimous vote of all Council members present after
beim; read three times by number and title only, this
14th day of October, 1968.

A request for a change from I1-7 to A-2 on a
property located in the vicinity of the
Beaverton-Tigard Highway, Hall Boulevard, and
Manzanita Street (Map #1S1 35AD) (Tax Lots 1600 , 1700)
and (Map #1S1 35DA) (Tax Lot 2500)
Planning and Zoning Commission Action:
The Commission recommends approval of this zone change
with deed covenants which will limit the development to 150
apartment units and provide dedicated street access into the
property from Hall Boulevard (without covenants , the A-2 zone
will permit a maximum of 250 units on the property. ) This
reduced number of units will provide for a good amount of
landscaped open space and will give the development a lower
density character. in additon, the highway border, and
direct access should keep neighborhood disruption to a minimum.
There is great neighborhood concern for 89th Street and
Spruce Streets. These are dedicated County roads , but are
presently 20 ' wide unimproved roads maintained by the surrounding
property owners. These property owners are concerned about the
effect of the apartment traffic on these roads. Mr. Gass has
agreed to improve the dedicated road through his property up
to within a few feet of the northerly property line, at which
point shrubbery would be planted, prevbnting traffic from
going onto 89th and Spruce Streets.

SIZE OF PROPERTY: 7+ acres
STAFF RECOMMENDATION (revised) :
The staff now recommends _approval of this application. The previous
problem of access to an improved road has been solved by the addition
to the original property of a 75' lot which connects the property with
Hall Boulevard. A 50' dedicated road will be located through this and
the apartment development, and connecting with 89th Street. (89th Street
will also be a 50' road improved to City standards within the property) .
Mr. Gass has now prov ded us with a plot plan showing his proposed
development and has a,reed to limit the development to 150 units. This
will provide for a good amount of landscaped open space and give the
development a lower density character. The reduced number of units,
the highway border, and the direct ar.r:ess to Hall Boulevard should keep
neighborhood disruption to a minimum. Deed covenants are ready for
recording which rill guarantee development of the pian presented.
Staff recommendation had said that a small neighborhood
comlmlercial facility could better be developed under a re-
sidential conditional use. Mr. Howard Gass, property owner
4 developer in the area spoke in favor, saying he didn't
think the area was single family residential in character.
Neighbors Mr. Burrow, Mr. Vest, Mr. Piland, Mr. Larson,
Mrs. Beggs & Mrs. Gray spoke in opposition because of
hazardous traffic conditions already on Hoffarber. Mr.
Moore, 12575 S.W. Grant, said he telt that there was a need
to expand services in this area and that improvement was
always stet by objection, that improvement can be made
without bad effects.
Mr. ftwol said he had previously spoken with Mr. Logan,
City Administrator about commercial development of the pro-
perty and upon his encouragement had had water brought to
the property. Chairman Paterson reminded Mr. Fimmel the
staff recommendation for a small development and said a 4
more development could not be considered small and that
under the conditional use there could be control of the
development. He also mentioned that the plans showed only
halt the development and if the sone change were granted
now it would be doing so without knowing what was proposed
for the other half of the property.
3. Commission discussion and action
a. Mr. Perry said he didn't agree that this zone change would
Load to strip commercial, but felt the area was not yet
ready for commercial development although it might be in
five years.
b. Mr. Phillips said he agreed that a commercial development
would be better under the conditional use.

a majority vote (Mr. Aitken lescenting) that the zone

correeted the staff statement that there was no access
to a "Jar street, Paying that he had purchased a 75'
wide lot (Map 191 35 DA, Tex lot 2402) which, connects the
property, he said, lies presently in the County, but he is
planning for annexation,
b. Chsirmlan Paterson asked if Mr. Gams would like to have his

C. Mr. Thompson suggested that a condition he put on the zone
change requesting access to be dedicated. Mr. Gass asked
if conditions could be put on county land. Mr. Thompson
interpreted a recent memorandum from the City Attorney
that conditions may be put on zone changes. He said that
in this case such a condition would be on the zone change
of the city property and would not be on the county
property.
Mr. Gees spoke of the fine quality development he had planned
for the area.
Mr. Paterson suggested that a planned residential develop-
ment as suggested in the Staff recommendation might be
more suitable.
Mr. Gass said the property was too expensive for single family
development.
Mrs. Brown, a Hall Blvd. neighbor, wanted to know what
happened to the taxes on the surrounding properties if
this development was allowed.
Mr. Miller, a Spruce Street neighbor, wanted to know if
Mr. Gass planned on using 89th Street for access.
Mr. Gass answered yen. Mr. Miller mentioned that the
■urrounding property owners maintain 89th and Spruce Streets.
He said he also felt this would be spot zoning if approved,
bocause the freeway acted as a natural barrier between any
existing commercial or multiple zoning. Mr. ad. Hennevig,
p:roperty owner on spruce Street, said that the adjoining
property owner to the north (Map 181 35 AD, Tax lot 1701)
had petitioned to the County for multiple zoning recently
and been turned down. The County had said there was
sufficient multiple zoning in the area which was still un-
developed. He also said he felt the topography of the land
was perfect for single family daylight basement develo►.ment.
Be mentioned further that in order for the County to take
over 89th and Sp-uce Streets, they must be brought ur to
County standards by the property owners, a cont which they
haven't been anxious to bear.
Mr. Thompson, Mr. P,terson asked if the 75' strip to Hall
Blvd. would provide adequate access according to City
standards. Mr. Thompson said it would.
3. Commission discussion and action
a. Mr. Perry asked if 89th could be closed off at the
property line. Mr. Thompson said "no" as it was a
dedicated street.
Mr. Phillite said he thought the 75' access would become
over- .,sed ano the rera-"-nts of the now development would
hive to use Spruce et. 6 89th. He asked if Mr. Gass would
be willing to improve the street.

Mr. Gass said only with the surrounding neighbors, not
alone. Mr. Paterson suggested that the hearing be continued
to tr►e next meeting September 17, 1968, and that in the
meantime Mr. Gass could tie up a few loose ends on his
proposal. It was moved (Aitken) seconded (Phillips) and
unanimously passed by vote of the commission that hearing be 1
continued at the next meeting.
4. MISCLLLANZWS
A. Mr. Paterson passed out the George Fann proposal on zoning
ordinance revision including a section each on implement-
ation, A-2 and a new P.U.D. zone. He asked that the com-
mission members read it in the next month for discussion
at the next meeting.
B. Creamer Hills Subdivision - Mr. Jim Aitken,
Sponsor
1. No staff recommendation was given due to the late
date of submission
2. Mr. Paterson asked if the street shown on S.W. Cressmer
Drive would eventually connect with Ash Street. Mr.
Aitken said it would. Mr. Paterson asked if the 20'
frontage of the bottleneck lots was in accordance with
city standards. Mr. Thompson said it was, but that the
Staff had not particularly liked these lots, but had
no other suggestion !or them.
It was moved, seconded, and passed unanimously by vote
of the Commission to approve the preliminary plat
for Creamer Hille Subdivision.
