APPLICATION SUMMARY FILE NAME: Hall Boulevard Baptist Church CASE NO.: Minor Modification of Existing Conditional Use MMD2017-00013 PROPOSAL: The applicant proposes to install two (2) above-ground condensers, adjacent to the north facade of an existing religious institution (Hall Boulevard Baptist Church). The applicant also proposes to construct a five-foot-tall wood fence to screen the condensers from view by any neighboring residences, parking areas, or public streets. Mobile home parks and subdivisions are also permitted outright. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.330.020.C.3 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. 11MMD2017-00013 Hall Boulevard Baptist Church THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located on the west side of SW Hall Boulevard;south of SW McDonald Street,and north of SW Greensward Lane. The subject property is a 3.93-acre tax lot occupied by an existing religious institution, Hall Boulevard Baptist Church. The site is zoned Medium-Density Residential (R-7); accordingly, a religious institution is a conditional use in this zone. Adjacent properties are zoned Low- Density Residential (R-4.5). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.330 Conditional Use: 18.330.020.0 Minor modification of approved or existing conditional use. 3. A minor modification shall be approved,approved with conditions,or denied following the director's review based on the findings that: a. The proposed development is in compliance with all applicable requirements of this title;and The applicant proposes to install two (2) above-ground condensers, adjacent to the north facade of an existing religious institution (Hall Boulevard Baptist Church). The applicant also proposes to construct a five-foot-tall wood fence to screen the condensers from view by any neighboring residences, parking areas,or public streets. Staff reviewed the applicant's narrative and site plan to determine the proposal complies with the special provisions for screening of service facilities,as outlined in TDC 18.745.050.E.2: "Screening of service facilities. Except for one-family and two-family dwellings, any refuse container or disposal area and service facilities such as gas meters and air conditioners which would otherwise be visible from a public street, customer or resident parking area, any public facility or any residential area shall be screened from view by placement of a solid wood fence or masonry wall between five and eight feet in height. All refuse materials shall be contained within the screened area." Accordingly, staff concludes the two (2) above-ground condensers will be adequately screened from view, and that the proposed solid wood fence meets the screening standards outlined above. Furthermore, compliance with state building code setback requirements will be ensured at the time of building permit submittal. Upon review of the applicant's plans and narrative, staff finds that all other applicable requirements are met.This criterion is met. b. The modification is not a major modification as defined in subsection A of this section. Staff finds that the changes listed in TDC 18.330.020.B.2 are either satisfied or do not apply.Therefore,the proposed development is not a major modification.This criterion is met.
