Since our meeting on June 13, 1985, the City staff who were involved in the original purchase have raised the issue of whether the easement runs in favor of the Randall property. I have asked for a complete review of the deed records and the original easement. I will let you know the results of our analysis as soon as they are available. From our past conversations, I am aware that your client may make a prescriptive easement claim in addition to the claim based upon an express easement. I think it would be useful for all parties if you would assemble the evidence on which that claim would be based so that we can evaluate it. In the meantime, I have directed the City staff to permit use of the disputed area by the The Robert Randall Company and Pacific Frontier Wood Markets, Inc. This use is by permission of the City and may be revoked at any time. This status could, of course, change in the event that it becomes clear that your client has a legal right to the use of the property. Ramis : This office represents The Robert Randall Company and Pacific Frontier Wood Markets , Inc . , owners of Lots 6 and 7 Burnham Tracts , respectively . Until approximately two years ago there existed two residences on Lot 7 . These residences were serviced by a 16 foot easement that provided ingress and egress to Burnham Street . When Pacific Frontier Wood Markets , Inc . acquired Lot 7 , the houses were removed with the intention that the land would be prepared for use as a rental parking area . Recently , however , access over the 16 foot strip was barricaded by the City of Tigard . There is no other existing roadway to Lot 7 , and the property is currently landlocked . Upon investigating this matter , I am advised that the City of Tigard has barricaded this property pursuant to the request of DWD Contractors , who had formerly owned the property . However , upon examining the title to the property which the City of Tigard received from DWD Contractors , it appears that it is subject to an easement recorded in May 2 , 1933 which affects the entire strip. The easement is in favor of the "westerly adjacent property owners" . Mr . Timothy V. Ramis June 17 , 1985 Page 2 Since Lot 7 is one of those westerly adjacent property owners , it appears that the City has no more authority to barricade the 16 foot strip than did DVVD. Accordingly , demand is hereby made upon the City of Tigard to remove the existing barricade immediately .
