As a result of this lot line adjustment, Parcel 1 will be 2.71 acres in size,and Parcel 2 will be 6.01 acres in size. The MUE zoning district is designed to apply to a majority of the land within the Tigard Triangle, a regional mixed-use employment district bounded by Pacific Highway (Hwy. 99), Highway 217 and I-5. This zoning district permits a wide range of uses including major retail goods and services, business/professional offices, civic uses and housing; the latter includes multi-family housing at a maximum density of 25 units/acre, equivalent to the R-25 zoning district. A wide range of uses, including but not limited to community recreation facilities, medical centers, schools, utilities and transit-related park-and-ride lots, are permitted conditionally. Although it is recognized that the automobile will accommodate the vast majority of trips to and within the Triangle, it is still important to (1) support alternative modes of transportation to the greatest extent possible; and (2) encourage a mix of uses to facilitate intra-district pedestrian and transit trips even for those who drive. The zone may be applied elsewhere in the city through the legislative process. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.410.040. LLA2016-00015 Triangle Pointe,LLC 1 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED 1. The applicant shall record the lot line adjustment with Washington County, and submit a copy of the recorded survey map to the city within 15 days of recording to be incorporated into the record. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located on the southwest side of SW 68th Parkway, bordered on the west by Highway 217 and on the east by Highway I-5. Parcel 1 is currently 2.01 acres in size and is occupied by a paved parking lot with 175 spaces, and associated landscaping. Parcel 2 is currently 6.72 acres in size and is occupied by a 108,171-square-foot commercial building, paved parking lot with 381 spaces, and associated landscaping. Parcel 1 has direct frontage along Highway 217 and also connects to SW 68th Parkway via a 24-foot-wide access easement across Parcel 2. Parcel 2 has direct frontage along Highway 217 and Highway 1-5, and contains two accessways that connect to SW 66th Avenue and SW 68 Parkway. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Tigard Development Code (TDC) Section 18.410.040 contains the following criteria for approval of a Lot Line Adjustment request: Section 18.410.040 A. Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No additional parcels will be created as a result of this lot line adjustment. Furthermore, there is no minimum lot size for the MUE zone. This criterion is met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Parcel 2 will be reduced in size from 6.72 acres to 6.01 acres, and will meet the maximum floor area ratio (FAR) for the MUE zone (0.4). In addition, Parcel 2 will contain 306 parking spaces, which is within the minimum (293 spaces) and maximum (446 spaces) off-street parking requirements for this property. Parcel 1 will be increased in size from 2.01 acres to 2.71 acres. Parcel 1 is not currently developed with any structures; accordingly, the maximum FAR and off-street parking requirements do not apply. Furthermore, staff reviewed the applicant's narrative and submitted site plan to determine LLA2016-00015 Triangle Pointe,LLC 2 that this lot line adjustment will not result in any violations of the site development or zoning district regulations for the MUE zone. This criterion is met. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; Staff reviewed the applicant's site plan to confirm the average lot widths for both Parcels 1 and 2 exceed the average minimum lot width for the MUE zone (50 feet).This criterion is met. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; There is no minimum lot size for the MUE zone. In addition, the applicant is not proposing to create any flag lots as a result of this lot line adjustment. This criterion is met. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and As illustrated in the applicant's site plan, Parcel 1 has more than 15 feet of direct frontage along Highway 217, and will also connect to SW 68th Parkway via an approximately 30-foot-wide accessway. Parcel 2 has more than 15 feet of direct frontage along both Highway 217 and Highway 1-5, and will also connect to SW 66th Avenue via an approximately 37-foot-wide accessway.This criterion is met. d. Setbacks shall be as required by the applicable zoning district. Staff reviewed the applicant's submitted site plan to confirm that all existing structures meet the minimum setback requirements for the MUE zone.This criterion is met. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The applicant is not proposing to create any flag lots as a result of this lot line adjustment. Therefore, these criteria do not apply. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. The applicant is not proposing to create a new accessway with this lot line adjustment. In addition, fire hydrants are already in place. This criterion is met. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. The applicant is not proposing to create a common drive to serve more than one lot with this lot line adjustment. The existing 30-foot-wide accessway to SW 68th Parkway will be transferred from Parcel 2 to Parcel 1. In addition, the applicant is not proposing to modify the other existing accessway that connects Parcel 2 to SW 66th Avenue. This criterion is met. LLA2016-00015 Triangle Pointe,LLC 3 7. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. Parcel 1 will connect to SW 68th Parkway via an approximately 30-foot-wide accessway, and Parcel 2 will connect to SW 66th Avenue via an approximately 37-foot-wide accessway. This criterion is met. FINDING: Based on the analysis above, staff finds the approval criteria for Lot Line Adjustments are either met, satisfied through conditions of approval, or do not apply. The proposal is in compliance with the requirements of this Title. SECTION V.
