WARRANTY DEED OF:DEDICATION
KNOW ALL MEN BY THESE PRESENTS, that ROBERT L. EMPKIE Jr. and HAZEL L.
EMPKIE, hereinafter calledthe grantor(s) , in consideration of the granting
of zone change No. 21-77 which is the whole consideration, heretofore
granted by Washington;County, Oregon, hereinafter called the grantee, does
hereby grant, bargain, sell and convey unto the use of the public as a
public way forever that certain real property situated in the County of
Washington and State of Oregon, described as follows, to-wit:

HEIGHTS, being more clearly described as follows:
A parcel of land in the North half of the John L. Hicklin DLC No. 54,
also being a portion of the SES of the SWC of Section 35, T1S, R1W, W.M. ,
Washington County described as follows:
Beginning at the SE corner of Lot 5, GREENBURG HEIGHTS, also being a
point on the West line of Lot 2 RUTH, a duly recorded plat in Washington
County; thence South 0001' W along the West line of said Lot 2 a distance
of 99.5 feet to the NE corner of Lot 2, GREENBURG HEIGHTS; thence S89°58'W
438 feet along the North linexaf Lot 2, GREENBURG HEIGHTS to the NW corner
thereof; thence NO°03' W 99.5 feet to the SW corner of Lot 4, GREENBURG
HEIGHTS; thence N89°58' E 438 feet to the point of beginning.
EXCEPTING therefrom that portion lying within the limits of SW 98th Ave.
To have and to Hold the same unto the public as a public way forever.
And said grantors, jointly hereby covenant to and with said grantee,
that grantors together, are lawfully seized in fee simple of the above
granted premises and in this deed dedicate the aforesaid real property free
from all encumbrances and that grantors and each of them will warrant and
forever defend the above granted real property and every part and parcel thereof
against the lawful claims and demands of all persons whomsoever.
In construing this deed and where the context so requires, the singular
includes the plural.

CONSENT COVENANT
•
Street Improvements
The undersigned owners (including purchasers) of the
real property described below do hereby record their consent to the
folmation of a local improvement district by the City of Tigard for
the purpose of improving the public street or streets upon which
the described property abuts. The undersigned expressly waive all
present and future rights to oppose or remonstrate against the
folmation of a local improvement district for the improvement of the
abutting street or streets , reserving only the right to contest the
inclusion of particular cost items in the improvement district pro-
ceeding and any right they may have under the laws of the state of
Oregon to contest the proposed assessment formula.
This consent and waiver shall run with the title to the
described land and be binding upon the undersigned and all successor
owners, for a period of 15 years from the date of the last
signature below.
