Expressway Developing Co.,Joseph M. Fought doing business as J.B.K. Company, R.
M. Investment Company, A. Victor Rosenfeld, Cathy B. Siegel who took title as Cathy
Rosenfeld, Fern Meltzer, Eric L. Meltzer, Patti Sue Newby, Roberta M. Stern, and Herbert
Meltzer, Grantors, convey and warrant to the City of Tigard, Oregon, a Municipal Corporation,
Grantee, the following described real property, for the purposes of constructing a road, free of
encumbrances except as specifically set forth herein, situated in Washington County,Oregon, to-wit:
A tract of land located in the Northeast one-quarter of Section 12 Township 2 South, Range 1
West, Willamette Meridian, City of Tigard, Washington County, Oregon, described as follows:
Beginning at the Southeast corner of Parcel 1 of that property deeded to Expressway development
Co. in Book 419 Page 713 of the Washington County Deed Records, thence N 89°24' 53" W a
distance of 5.00 feet to the true point of beginning, also being on the westerly right-of-way of
S.W. 72nd Avenue 25.00 feet wide (when measured at right angles); thence N 01° 23' 37" E,
along the said westerly line, a distance of 52.65 feet; thence S 07°06' 44" W a distance of 52.99
feet to then southerly line of said deed; thence S 89° 24' 53" E, along the southerly line of said
deed, a distance of 5.28 feet to the point of beginning.
Containing 139 square feet 1-24-95
Reserving, however, unto the Grantors, their successors and assigns, the following: NONE
THIS INSTRUMENT WILL NOT ALLOW USE OF THE PROPERTY IN VIOLATION OF
APPLICABLE LAND USE LAWS AND REGULATIONS. BEFORE SIGNING OR ACCEPTING
THIS INSTRUMENT, THE PERSON ACQUIRING FEE TITLE TO THE PROPERTY SHOULD
CHECK WITH THE APPROPRIATE CITY OR COUNTY PLANNING DEPARTMENT TO
VERIFY APPROVED USES AND TO DETERMINE ANY LIMITS ON LAWSUITS AGAINST
FARMING OR FOREST PRACTICES AS DEFINED IN ORS 30.030.
The said property is free from encumbrances except Conditions, Restrictions, Restrictive Covenants
and Easements of Record, if any, and the provisions of any ordinance of the of the City of Tigard,
Oregon, enacted prior to the date hereof.
The true consideration for this conveyance is SIX HUNDRED FIFTY AND NO/100 DOLLARS
($650.00) as specified per the requirements of ORS 93.030.
