Street Dedication b. Partial Release With respect to Idents. 14 and 15, the above dedication has been provided to the City at no cost. This compares with an amount of approximately $3,744.00 if the taking had been at appraised cost. Negotiation of this taking has been long and tedious, our records showing 55 random telephone calls. The original documents were in the name of Siemens-Allis, Inc., the parent company. During these proceedings, it was determined that the owner's intent was that ownership should have been transferred to Circle A-W Products Company. Recent deeed copies from Ticor Title Insurance reveal that Ident. 15 was conveyed to Circle A-W in 1979 by Instrument 79014612. Ident. 14 was conveyed May 25, 1984 to Circle A-W by Instrument 84021663 (copies of instruments are attached). Ticor Title Insurance indicates complete confidence in Circle A-W Company' s ownership. Attached is a proper Partial Release from First Interstate Bank. The only other item of concern is that Circle A-W omitted the paragraph "The grantor (s) hereby covenants that they are the owner (s) in fee simple and have good and legal right to grant their rights above-described. Although you may wish to review this with the City's attorney, it would seem to me that you have in hand a fully valid dedication. Unless there is some compelling reason to demand inclusion of this paragraph and because of the possible risks of not being able to otherwise take the property at no cost, we feel the dedication should be accepted by the City as is.
