BARGAIN AND SALE DEED
RICHARD G. PIKE and BETTE LEE PIKE, husband and wife
convey to the CITY OF TIGARD, OREGON, the following described
real property:
EXFIBIT "A"
A tract of land for road purposes being situated in
the northeast 1/4 of Section 12, T.2 S. , R.1 W. of the
Willamette Meridian, Washington County, Oregon, being
more particularly described as follows, to-wit:
Beginning at a point of intersection of the north
line of said Section 12 with the southwesterly right
of way line of S.W. 72nd Ave. which point of intersection
bears North 89°53' East along said northerly line of
Section 12, 1270.33 feet from the north 1/4 corner of
said Section 12. From said place of beginning; thence
South 62°20'20" East along said right of way line, 48.38
feet to an angle point in said right of way line; thence
South 0°09'30" West along the westerly right of way line
of said S.W. 72nd Ave. 217.32 feet; thence leaving said
right of way line, South 89°12'50" West 15.81 feet; thence
northwesterly along a curve to the left (long chord bears
North 25°1)4'36" West 265.14 feet) having a radius of
470.00 feet thru a central angle of 32°46' a distance
of 268.79 feet to said northerly line of Section 12;
thence North 89°53' East along said northerly line,
86.63 feet to the place of beginning.
This conveyance is made for the purpose of providing
land to be used by the City of Tigard and/or Washington County
in relocating S.W. 72nd Avenue in Tigard, Oregon so that the westerly
line of S.W. 72nd Avenue will be along the westerly line of the
property conveyed by this Deed. This conveyance is therefore made
upon the following express conditions:

1. The City of Tigard a-- _ - 7.-: ..!“ _:. - . shall use
its best efforts to cause S.W. 72nd Avenue to be relocated as
described above.
2. In the event that such relocation and improvement
of S.W. 72nd Avenue has not occurred by January 31st, 1987,
Grantors or their heirs may re-enter and terminate the estate
hereby created.
3. In the event that S.W. 72nd Avenue is relocated and
improved, as described above, via the formation of an assess-
ment district, then the reimbursement value of the property
described in Exhibit "A" shall be established and dispensed as
follows: Any assessment for such relocation and improvement
against the real property of Grantors Richard G. Pike and
Bette Lee Pike described on Exhibit "B", hereto, shall be

reduced by the then Washington County Assessed Valuation of .--------------

the property conveyed herein.
4. The Grantors Richard G. Pike and Bette Lee Pike owning
property described on Exhibit "B", hereto, consent to the
formation of an improvement assessment district by the City of
Tigard for the purpose of improving and relocating S.W. 72nd
Avenue as described above and waive all present and future
opposition or remonstrances against such relocation, improvement

or assessments. This consent and waiver shall run with the
title to the said property and be binding upon Grantors and
all successor owners for a period of ten (10) years from the
date hereof.
5. The City of Tigard, by executing this Deed, consents
and agreed to the conditions set forth above.
The true consideration for this conveyance cannot be
stated at this time. However, the consideration consists of a
value to be ascertained in the future.
