DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED: 1. The applicant shall record the lot line adjustment with Washington County,and submit a copy of the recorded survey map to the city within 15 days of recording to be incorporated into the record. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located on the north side of SW Pacific Highway,west of SW 69`h Avenue,and east of SW 71"Avenue. Currently, Parcel 1 has direct frontage along SW 71'Avenue, and Parcel 2 has direct frontage along SW 71" Avenue and SW Pacific Highway; as a result of this lot line adjustment, both Parcels 1 and 2 will have direct frontage along SW 71"Avenue and SW Pacific Highway. The two parcels make up the Pacific Terrace Shopping Center, which is currently developed with multiple commercial buildings, landscaping, and associated parking. Both parcels are zoned General Commercial (C-G), as are adjacent properties to the south and west; adjacent properties to the north are zoned Low-Density Residential (R-4.5) and Medium-Density Residential (R-12); and adjacent properties to the east are zoned Professional/Administrative Commercial (C-P). In November 2015, the City of Tigard Planning Division issued a Zoning Analysis Letter (ZAL2015- 00001) that confirmed both Parcels 1 and 2 as "lots of record," per the applicant's request.Accordingly, the purpose of this Lot Line Adjustment is to reconfigure Parcels 1 and 2, so the properties' legal descriptions match their configurations on the Washington County Assessment and Taxation Map (WCTM 1S136AD). Proposal Description: The applicant is proposing a lot line adjustment affecting two properties: 11505 to 11527 SW Pacific Highway, WCTM 1S136AD, Tax Lot 4000 (Parcel 1); and 11539 SW Pacific Highway, WCTM 1S136AD,Tax Lot 4001 (Parcel 2). As a result of this lot line adjustment,Parcel 1 will be 68,669 square feet in size,and Parcel 2 will be 28,205 square feet in size. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Tigard Development Code (TDC) Section 18.410.040 contains the following criteria for approval of a Lot Line Adjustment request: Section 18.410.040 A. Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; LL-A2016-00002 Pacific Terrace Commercial,I.LC 2 No additional parcels will be created as a result of this lot line adjustment. Furthermore, there is no minimum lot size for the C-G zone. This criterion is met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Staff reviewed the applicant's narrative and submitted site plan to determine that this lot line adjustment will not result in any violations of the site development or zoning district regulations for the C-G zone. This criterion is met. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; Staff reviewed the applicant's site plan to confirm the average lot widths for both Parcels 1 and 2 exceed the average minimum lot width for the C-G zone (50 feet). This criterion is met. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; There is no minimum lot size for the C-G zone. In addition, the applicant is not proposing to create any flag lots as a result of this lot line adjustment. This criterion is met. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and As illustrated on the applicant's site plan,both Parcels 1 and 2 have more than 15 feet of direct frontage along SW 71"Avenue and SW Pacific Highway. This criterion is met. d. Setbacks shall be as required by the applicable zoning district. TABLE 18.520.2 COMMERCIAL DEVELOPMENT STANDARDS STANDARD C-G Parcell Parcel 2 Minimum Setbacks -Front yard 0 ft. 15.4 ft. 46.9 ft. -Side yard 0/20 ft.* 4.6 ft.* 15.3 ft. -Rear yard 0/20 ft.* 50 ft.* 125 ft. *No setback shall be required except 20 feet shall be required where the zone abuts a residential zoning district. This standard only applies to Parcel 1,which abuts the R-4.5 and R-12 zones along its side and rear property lines. As illustrated in the table above, Parcel 2 meets all setback requirements for the C-G zone. Parcel 1 abuts the R-4.5 and R-12 zones along its side and rear property lines; therefore, the 20-foot-minimum side and rear setback requirements apply.The existing structures on Parcel 1 meet the rear yard setback, but do not meet the side yard setback. As determined in Case No. ZAL2015-00001,Parcel 1 meets the "lot of record" definition outlined in TDC Chapter 18.120, as it was lawfully created and platted prior adoption of the city's first Subdivision Ordinance in 1968. Accordingly, existing buildings or structures on Parcel 1 are not subject to the 20-foot-minimum side yard setback. However, new development will be subject the setback standards outlined in TDC Table 18.520.2. This criterion is met. LLA2016-00002 Pacific Terrace Commercial,LLC 3 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The applicant is not proposing to create any flag lots as a result of this lot line adjustment. Therefore, these criteria do not apply. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. The applicant is not proposing to create a new accessway with this lot line adjustment. In addition, fire hydrants are already in place.This criterion is met. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. The applicant is not proposing to create a common drive to serve more than one lot with this lot line adjustment. Both adjacent commercially zoned parcels have separate access in addition to the access through the area affected by the lot line adjustment.Therefore,this criterion does not apply. 7. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. The applicant is not proposing to create a new accessway with this lot line adjustment. Parcel 1 has two access points from SW Pacific Highway,and Parcel 2 has two access points from SW 71`t Avenue. This criterion is met. FINDING: Based on the analysis above, staff finds the approval criteria for Lot Line Adjustments are either met, satisfied through conditions of approval, or do not apply. The proposal is in compliance with the requirements of this Title. SECTION V.
