change current policy, but better defines where the liability
rests (with the property owner) . He stressed that this was a
legal viewpoint and opinion, and that. the Council must determine
the policy issues .
b. City Administrator stated that if current code is preferred then
the City will have to create a sidewalk inspection program and a
sidewalk replacement program. This would be a costly plan. He
recommended adopting Legal Counsel' s recommendation based on
current court ruling .
