HERNDON; and DONALD W. LEWIS and NANCY K. LEWIS, husband and wife, herein called "Grantors," for the sum of Ten Dollars ($10.00) constituting the actual consideration for this deed, do hereby give, grant and dedicate to the City of Tigard, a municipality of the State of Oregon, its successors and assigns, a perpetual right-of-way and easement for pub- lic street, road and utility purposes on, over, across, under, along and within the following described real premises in Washington County, Oregon: Description of a tract of land located in the Northwest one- quarter Section 14, Township 2 South, Range 1 West, Willamette Meridian, Washington County, State of Oregon, said tract being a portion of that tract conveyed to Harvey L. and Judith A. Knauss, husband and wife, in Deed Records Book 557, page 26, said tract being more particularly described as follows: Commencing at Northwest corner of said Knauss tract, said point being on the North line of said Section 14, thence South 0° 10' 53" East (Deed 50° 09' East) along the West line of said Knauss tract 257.61 feet more or less, to the true point of beginning on the North line of the right-of-way of Serena Way projected to include the following area of Grantors' lands hereby dedicated for the purpose above stated. Thence along the arc of a nontangent 125.00 radius curve right (through a central angle of 36° 52' 12") a distance of 80.44 feet (the long chord of which bears South 18° 36' 59" East 79.06 feet) said point being 25.00 feet from (when measured at right angles to) said West line; thence South 0° 10' 53" East, parallel to said West line, 423.36 feet; thence along the arc of 125.00 foot radius curve right (through a central angle of 36° 52' 12") , a distance of 80.44 feet (the long chord of which bears South 18° 15' 13" West 79.06 feet) to a point of non-tangency on said West line; thence North 0° 10' 53" West along said West line 573.36 feet to the point of beginning. To have and to hold the above-described dedicated rights unto the City of Tigard for the uses and purposes hereinabove stated. (b) Motion by Councilwoman Stimler, seconded by Councilman Brian to approve. Approved by unanimous vote of Council. 13. APPROVAL WASHINGTON COUNTY - TIGARD URBAN PLANNING AREAYGREEMENT AND AUTHORIZE SIGNING BY MAYOR AND CITY RECORDER. (a) Planning Director recommended approval. (b) Motion by Councilwoman Stimler, seconded by Councilman Brian to approve and authorize signing by Mayor and City Recorder. Approved by unanimous vote of Council. 14. APPROVE DEDICATION DEED - Portion of Tract "C" Brookway. (a) City Administrator recommended approval . (b) Motion by Councilman Cook, seconded by Councilman Brian to authorize Mayor and City Recorder to sign and execute. Approved by unanimous vote of Council. 15. ACCEPT STREET DEDICATION - S.W. Serena Way - Pick's Landing. (a) City Administrator, after locating the street in questions, recommended approval. (b) Motion by Councilman Cook, seconded by Councilman Brian to authorize Mayor and City Recorder to sign and execute. Approved by unanimous vote of Council. 16. CONSIDERATION OF GRAYSON INVESTMENTS REQUEST FOR NON-OCCUPANCY AGREEMENT. (a) City Administrator, referring to the letter of request from Grayson Investments, explained his problems with this type of action. He expressed his fear that the City would not have good control on the project if we issue building permits and allow construction prior to obtaining sewer fees. He suggested phasing the sewer connection fees throughout the project to minimize the cost impact on developers. (b) Mickey Bowman, Grayson Investments, explained that the request was to have permission to put in the main line and begin construction, not to hook up prior to paying fees. He went on to say that if Council were to approve this, it would mean a delay in getting the fees of only four months. (c) After much discussion by Council, the City Administrator requested further study by staff. He went on to say that if additional staff research did not find any problems with this type of action, he could recommend approval. Page 4 - Regular Council Meeting - March 12, 1979
