The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.410.040. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. LLA2016-00011 Freni Lot Line Adjustment 1 CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED 1. The applicant shall record the lot line adjustment with Washington County, and submit a copy of the recorded survey map to the city within 15 days of recording to be incorporated into the record. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located on the south side of SW McDonald Street, and the west side of SW 93`d Avenue. Parcel 1 has approximately 80 feet of direct frontage along SW 93`d Avenue, and is occupied by a detached, single-family dwelling with attached garage, a paved driveway, and associated landscaping. Parcel 2 has approximately 217 feet of direct frontage along SW McDonald Street, and also includes an approximately 25-foot-wide "flag pole" that connects to SW 93rd Avenue. Parcel 2 is also occupied by a detached, single-family dwelling, several accessory structures, a paved driveway, and associated landscaping. Both parcels are zoned Low-Density Residential (R-4.5), as are surrounding properties. The northern portion of Parcel 2 contains a freshwater wetland, stream, and associated Clean Water Services Vegetated Corridor.The wetland is not regulated by the City of Tigard,and is not identified on the city's "Wetland and Streams Corridors Map." The applicant submitted a Clean Water Services (CWS) Sensitive Area Pre-Screening Site Assessment (CWS file 16-003437),which determined that this lot line adjustment will not significantly impact the existing or potentially sensitive area(s) found near the site. In December 2014, the City of Tigard Planning Division approved a lot line adjustment between the two subject parcels (LLA2014-00011), in order to create an approximately 25-foot-wide "flag pole" on Parcel 2. The purpose of this "flag pole" was to accommodate future development on Parcel 2, by creating a secondary accessway via SW 93`d Avenue. The applicant now proposes to eliminate this "flag pole" on the east side of Parcel 2,and increase the square footage of Parcel 1. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Tigard Development Code (TDC) Section 18.410.040 contains the following criteria for approval of a Lot Line Adjustment request: Section 18.410.040 A. Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No additional parcels will be created as a result of this lot line adjustment.Parcel 1 will be 35,893 square feet in size, and Parcel 2 will be 78,619 square feet in size. Accordingly, both lots exceed the minimum lot size for the R-4.5 zone: 7,500 square feet for detached units, and 10,000 square feet for duplexes. This criterion is met. LLA2016-00011 Freni Lot Line Adjustment 2 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Staff reviewed the applicant's narrative and submitted site plan to determine that this lot line adjustment will not result in any violations of the site development or zoning district regulations for the R-4.5 zone.This criterion is met. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; The average minimum lot width for the R-4.5 zone is 50 feet for lots with detached units, and 90 feet for lots with duplexes. Both parcels exceed this requirement because Parcel 1 has an average lot width of approximately 122 feet, and Parcel 2 has an average lot width of approximately 105 feet. This criterion is met. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; Parcel 1 will be 35,893 square feet in size, and Parcel 2 will be 78,619 square feet in size. Accordingly, both lots exceed the minimum lot size for the R-4.5 zone: 7,500 square feet for detached units, and 10,000 square feet for duplexes. In addition, the applicant is not proposing to create any flag lots with this lot line adjustment.This criterion is met. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and As a result of this lot line adjustment, Parcel 1 will have approximately 105 feet of direct frontage along SW 93rd Avenue, and Parcel 2 will have approximately 217 feet of direct frontage along SW McDonald Street. This lot line adjustment will also eliminate an approximately 25-foot-wide "flag pole" that connects to SW 93rd Avenue from Parcel 2.This criterion is met. d. Setbacks shall be as required by the applicable zoning district. Staff reviewed the applicant's submitted site plan to confirm that all existing structures on both parcels meet the minimum setback requirements for the R-4.5 zone.This criterion is met. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The applicant is not proposing to create any flag lots as a result of this lot line adjustment. Therefore, these criteria do not apply. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. The applicant is not proposing to create a new accessway with this lot line adjustment. In addition, fire hydrants are already in place.This criterion is met. LLA2016-00011 Freni Lot Line Adjustment 3 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. The applicant is not proposing to create a common drive to serve more than one lot with this lot line adjustment. This criterion does not apply. 7. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. As a result of this lot line adjustment, Parcel 1 will have approximately 105 feet of direct frontage along SW 93`d Avenue, and Parcel 2 will have approximately 217 feet of direct frontage along SW McDonald Street. This lot line adjustment will also eliminate an approximately 25-foot-wide "flag pole" that connects to SW 93`d Avenue from Parcel 2. This criterion is met. FINDING: Based on the analysis above, staff finds the approval criteria for Lot Line Adjustments are either met, satisfied through conditions of approval, or do not apply. The proposal is in compliance with the requirements of this Title. SECTION V. Freni Lot Line Adjustment-August 23, 2016 City of Tigard SR Design LLC Page 2 of 8 Chapter 18.390 DECISION-MAKING PROCEDURES 18.390.010 Purpose The purpose of this chapter is to establish a series of standard decision-making procedures that will enable the city, the applicant, and all interested parties to reasonably review applications and participate in the local decision-making process in a timely and effective way. Each permit or action set forth in Chapters 18.320-18.385 has been assigned a specific procedure type. 18.390.030 Type I Procedure A. Pre-application Conference. A preapplication conference is not required for a Type I action. B. Application requirements. 1. Application forms. Type I applications shall be made on forms provided by the director as provided by 18.390.080.E.1. 2. Application requirements. Type I applications shall: a. Include the information requested on the application form; b. Address the relevant criteria in sufficient detail for review and action; and c. Be accompanied by the required fee. C. Administrative decision requirements. The director's decision shall address all of the relevant approval criteria. Based on the criteria and the facts contained within the record, the director shall approve, approve with conditions or deny the requested permit or action. D. Final decision. Decision-making process. Lot line adjustments shall be reviewed by means of a Type I procedure, as governed by Chapter 18.390, using approval criteria contained in Section 18.410.040. B. Time limit on approval. The lot line adjustment approval by the director shall be effective for a period of 1-1/2 years from the date of approval. C. Lapsing of approval. The lot line adjustment approval by the director shall lapse if: 1. The lot line adjustment has been improperly recorded with Washington County without the satisfactory completion of all conditions attached to the approval; or 2. The final recording is a departure from the approved plan. D. Extension. The director shall, upon written request by the applicant and payment of the required fee, grant an extension of the approval period not to exceed one year provided that; 1. No changes are made on the original plan as approved by the director; 2. The applicant can show intent of recording the approved partition or lot line adjustment within the one year extension period; and 3. There have been no changes in the applicable comprehensive plan policies and ordinance provisions on which the approval was based. It is also understood that the approval shall lapse if the lot line adjustment is not recorded properly with Washington County. Therefore, the above criteria will be met. 18.410.030 Application Submission Requirements A. General submission requirements. All applications shall be made on forms provided by the director and shall include information required for a Type I application, as governed by Chapter 18.390. B. Specific submission requirements. All applications shall include the preliminary lot line map and necessary data or narrative, detailed information for which shall be obtained from the director. Comment: As mentioned above, the applicant will submit the request for a lot line adjustment using a Type I Application Form and the submittal shall include information required for a Type I application as governed by Chapter 18.390. The submitted Type I application packet includes the preliminary lot line map, written narrative and all other necessary data in order for the director to make an informed decision. Therefore, the above criteria will be met. Freni Lot Line Adjustment-August 23, 2016 City of Tigard SR Design LLC Page 4 of 8 18.410.040 Approval Criteria A. Approval criteria. The director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district. Comment: There will be no additional parcel(s) created by the proposed lot line adjustment. The existing parcel that will be reduced in size by the lot line adjustment will not be below the minimum lot size for its zoning district after the adjustment. Therefore, the above-criteria will be met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development zoning district regulations for that district. Comment: The lot or structures on the lot which will be reduced in size as a result of this lot line adjustment will not be in violation of site development zoning regulations. Therefore, the above-criteria will be met. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation; c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and d. Setbacks shall be as required by the applicable zoning district. Comment: The resulting parcels will remain in conformity with the dimensional standards for the zoning district after the lot line adjustment. Therefore, the above- criteria will be met. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within 10 feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation for proposed development. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. Comment: The application is requesting the approval of a lot line adjustment. The reduced parcel (TL 3300) will continue to utilize the existing access off of SW McDonald Street, the driveway has already been designed with a fire apparatus turnaround at the end of the driveway near the existing residence for fire-fighting capabilities and there are two accessible fire hydrants located along SW McDonald Street. The increased parcel (TL 3100) will continue to use its existing access located off of SW 93rd Avenue, this driveway is not increasing in length will not require the installation of a fire hydrant as there is one located directly across SW 93rd Avenue from the parcel. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approval partition map. Comment: The applicant is not proposing a common drive serving more than one lot. Therefore, this criterion does not apply. 7. Any accessway shall comply with the standards set forth in Chapter 18.705, Access, Egress, and Circulation. Comment: The accessway's for both parcels affected by this Lot Line Adjustment will not be affected. The reduced parcel (TL 3300) will continue to utilize the existing access off of SW McDonald Street and the increased parcel (TL 3100) will continue to use its existing access which is located off of SW 93rd Avenue. Therefore, the above condition has been met. B. Exemptions from dedications. A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. Comment: We are not requesting any dedications as a result of this lot line adjustment. Therefore, this criterion does not apply. C. Variances to development standards. An application for variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370, Variances and Adjustments. (Ord. 09-13). Comment: The applicant is not proposing a variance to development standards. Therefore, this criterion does not apply. 18.410.050 Recording Lot Line Adjustments A. Recording requirements. Upon the director's approval of the proposed lot line adjustment, the applicant shall record the lot line adjustment with Washington County and submit a copy of the recorded survey map to the city, to be incorporated into the record. B. Time limit. The applicant shall submit the copy of the recorded lot line adjustment survey map to the city within 15 days of recording and shall be completed prior to the issuance of any building permits on the re-configured lots. Comment: The applicant understands that the lot line adjustment will need to be recorded with Washington County, and the recorded documents will be submitted to the Freni Lot Line Adjustment-August 23, 2016 City of Tigard SR Design LLC Page 6 of 8 city. The applicant will submit a copy of the recorded lot line adjustment to the city survey department within 15 days of recording. Chapter 18.510 RESIDENTIAL ZONING DISTRICTS 18.510.020 List of Zoning Districts D. R-4.5: Low-Density Residential District. The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. Comment: The applicant is aware that the zoning of the two lots involved in the proposed lot line adjustment are zoned R-4.5 — Low-Density Residential. It is also understood that after the lot line adjustment each lot must still meet the minimum lot size for this zoning district which is 7,500 square feet. After the lot line adjustment tax lot 3100 will be approximately 35,893 square feet and tax lot 3300 will be approximately 78,619 square feet.
