APPROVED the above request, subject to certain conditions of approval. The findings and conclusions
on which the decision is based are noted in Section IV.

CONDITIONS OF APPROVAL
THE FOLLOWING CONDITIONS SHALL BE SATISFIED:

1. The street right-of-way shall be free at all times of customer vehicles associated with this home
occupation. All customer parking shall be accommodated on site.
2. The applicant shall obtain all necessary permits for any structural, mechanical, electrical, or
plumbing work performed as part of the home occupation. Please contact the Building Division at

3. The applicant shall obtain and annually renew a City of Tigard business license, and any and all
State and Federal approvals,permits,and licenses. Please contact Lizbeth Lutz,Finance Division at

SECTION III. BACKGROUND INFORMATION & PROJECT DESCRIPTION
Site Information:
The 0.2-acre site is located on the west side of SW Village Glenn Court, north of SW Omara Street and
south of SW Ash Avenue. The property is currently occupied by a 1,648-square-foot detached, single-
family dwelling with attached garage, paved driveway, and associated landscaping. The site is zoned R-
4.5 (Low-Density Residential),as are surrounding properties.
Proposal Description:
The applicant is requesting a Type II Home Occupation at 13430 SW Village Glenn Court. The home
occupation is for an acupuncture practice with a maximum of six (6) daily customers, and will occupy
approximately 343 square feet of an existing residence. No external changes are proposed as part of this
application.
SECTION IV. PUBLIC COMMENTS
The Tigard Community Development Code requires that property owners within 500 feet of the
subject site be notified of the proposal, and be given an opportunity for written comments and/or oral
testimony prior to a decision being made. A letter was received from Rhonda Eckroth on November
28, 2016. Ms. Eckroth expressed concern about the proposed home occupation's impact on the
neighborhood and increased traffic.
RESPONSE: As outlined in IUC Table 18.510.1, home occupations are an allowed land use in all
residential zones,subject to the requirements in l'UC 18.742 Home Occupations. These
requirements establish approval criteria and standards to ensure that home occupations
are conducted in a manner that is not detrimental or disruptive in terms of appearance
or operation to neighboring properties and residents. The proposed home occupation is
limited to a maximum of six (6) daily customers, and will therefore not generate
excessive traffic. In addition, staff has included a condition of approval that requires all
customer parking to be accommodated on site. Accordingly, staff finds this home
occupation is in compliance with the applicable requirements of this Title, as detailed in
Section V of this staff report.
SECTION V. APPLICABLE REVIEW CRITERIA& FINDINGS
As set forth in Table 18.510.1 of the Tigard Community Development Code, home occupations are an

allowed land use in all residential zones, subject to the approval standards and criteria contained in
Chapter 18.742 Home Occupations. Relevant standards and approval criteria are addressed below.
18.742 Home Occupations
18.742.040 General Approval Criteria
All home occupations except those that have proven nonconforming status shall observe the
following criteria in addition to the standards established for Type I and Type II uses
described in Section 18.742.050 of this chapter.
A. Home occupations may be undertaken only by the principal occupant(s) of a residential
property.
The applicant is the property owner and principal occupant of the residential property in which the
home occupation is proposed to take place. This criterion is met.
B. There shall be no more than three deliveries per week to the residence by suppliers.
The applicant's narrative indicates that there will no more than three deliveries per week to the
residence by suppliers. This criterion is met.
C. There shall be no offensive noise, vibration, smoke, dust, odors, heat or glare noticeable at
or beyond the property line resulting from the operation. Home occupations shall observe
the provisions of Chapter 18.725, Environmental Performance Standards.
This home occupation application is for an in-home acupuncture practice. It is anticipated that none of
the items listed above will be compromised beyond allowable levels as a result of this project. All
activities will be conducted indoors between the hours of 9 a.m. and 9 p.m.This criterion is met.
D. The home occupation shall be operated entirely within the dwelling unit and a conforming
accessory structure. The total area which may be used in the accessory building for either
material product storage and/or the business activity shall not exceed 528 square feet.
Otherwise, the home occupation and associated storage of materials and products shall not
occupy more than 25% of the combined residence and accessory structure gross floor area,
but in no case shall the portion of the home occupation occupying the accessory use
exceed 528 feet. The indoor storage of materials or products shall not exceed the limitations
imposed by the provisions of the building, fire, health and housing codes.
This home occupation will be operated entirely within the primary residence (an existing detached,
single-family dwelling). In addition, staff reviewed the applicant's narrative and submitted floor plan to
determine 343 square feet of floor area (or approximately 21% of the existing 1,648-square-foot
residence) will be utilized for the home occupation. Accordingly, this proposal does not exceed the
floor area maximums stated above (528 square feet, or 25% of the combined residence and accessory
structure gross floor area). This criterion is met.
E. A home occupation shall not make necessary a change in the State Building Code use
classification of a dwelling unit. Any accessory building that is used must meet State
Building Code requirements.

No changes are proposed to the dwelling unit, and the home occupation is not proposed within an
accessory building. This criterion is met.
F. More than one business activity constituting two or more home occupations shall be
allowed on one property only if the combined floor space of the business activities does not
exceed the limitation of space imposed in Subsection 4 above. Each home occupation shall
apply for a separate home occupation permit, if required as per this chapter, and each shall
also have separate Business Tax Certificates.
Staff conducted a search of city records, and found there were no other home occupations at this
property. This criterion is met.
G. There shall be no storage and/or distribution of toxic or flammable materials, and spray
painting or spray finishing operations that involve toxic or flammable materials which in
the judgment of the Fire Marshal pose a dangerous risk to the residence, its occupants,
and/or surrounding properties. Those individuals which are engaged in home occupations
shall make available to the Fire Marshal for review the Material Safety Data Sheets which
pertain to all potentially toxic and/or flammable materials associated with the use.
This home occupation will not have any storage and/or distribution of toxic or flammable materials
that pose a dangerous risk to the residence,its occupants, and/or surrounding properties. Furthermore,
Tualatin Valley Fire and Rescue was sent a copy of the applicant's proposal to review, and had no
objections.This criterion is met.
H. No home occupation shall require any on or off-street parking other than that normally
required for a residence.
This home occupation will not require any on or off-street parking, other than that normally required for
a residence. The existing detached, single-family dwelling includes an attached two-car garage and paved
driveway that is available for use by the applicant and customers. Furthermore, a condition of approval
has been added to ensure the street right-of-way will remain free of customer vehicles associated with this
home occupation.All customer parking shall be accommodated on site.This criterion is met.
I. The following uses are not allowed as home occupations:
a.Auto-body repair and painting;
b. Ongoing mechanical repair conducted outside of an entirely-enclosed building;
c.Junk and salvage operations;
d. Storage and/or sale of fireworks
The applicant's proposal for a home occupation does not involve any of the activities listed above. This
criterion is met.
J. There shall be no exterior storage of vehicles of any kind used for the business except that
one commercially licensed vehicle of not more than three-quarters ton gross vehicle weight
(GVW) may be parked outside of a structure or screened area.
The applicant is not proposing exterior storage of vehicles of any kind used for the business. In
addition, the subject property includes an attached two-car garage and paved driveway that can
accommodate any personal vehicles utilized by the applicant. This criterion is met.
18.742.050 Type I and Type II Home Occupations Defined

A. Home occupations shall be administered as either Type I or Type II uses. A separate home
occupation permit and/or fee is required for each property on which a Type II home
occupation is undertaken. In addition to the general criteria outlined in Section 18.742.040,
home occupations shall observe the following additional standards:
1. Type II home occupations. Property on which a Type II home occupation is located
may show evidence that a business is being conducted from the premises.Therefore the
following is allowed for Type II home occupations:
a. One non-illuminated sign, not exceeding 1.5 square feet, which shall be attached to
the residence or accessory structure or placed in a window;
The applicant is not proposing any signage related to this home occupation. Therefore, this standard
does not apply.
b. No more than one outside volunteer or employee who is not a principal resident of
the premises;
At this time, the applicant is the sole participant in the proposed acupuncture practice. However, in the
future, the applicant will be restricted to no more than one outside volunteer or employee related to this
home occupation. This standard is met.
c. No more than six daily customers or clients. Customers and clients may not visit the
business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate
excessive traffic or monopolize on-street parking;
The applicant states the business will not generate more than six (6) daily customers,between the hours
of 9 a.m. and 9 p.m. In addition, the subject property includes an attached two-car garage and paved
driveway that can provide off-street parking for the applicant and any customers. Furthermore, a
condition of approval has been added to ensure the street right-of-way will remain free of customer
vehicles associated with this home occupation. All customer parking shall be accommodated on site. This
standard is met.
d. Storage of materials, goods, and equipment which is screened entirely from view by
a solid fence. Storage shall not exceed five percent of the total lot area and shall not
occur within the front yard or the required side yard setback.
The applicant is not proposing any outdoor storage of materials,goods,or equipment.This standard does
not apply.
18.742.060 Permit Procedures for Type I and Type II Home Occupations
B. Type II home occupation permit. A Type II home occupation permit will be processed by
means of a Type II procedure, as governed by Section 18.390.040, after a demonstration that
the proposal complies with all development criteria in Sections 18.742.040.A and
18.742.050.A.2 and subject to the following approval criteria:
1. Is in conformance with the standards contained in this chapter; and

As detailed in the findings above, this application is in conformance with the standards contained in
this chapter, or will be consistent with the conditions of approval outlined in Section II. This criterion
is met.
2. Will be subordinate to the residential use of the property; and
The business will be subordinate to the residential use of the property. This home occupation will
occupy 343 square feet of floor area, or approximately 21% of the existing 1,648-square-foot residence.
This criterion is met.
3. Is undertaken in a manner that is not detrimental nor disruptive in terms of appearance
or operation to neighboring properties and residents.
The proposed business will be entirely contained within the existing detached, single-family dwelling,
and will not be detrimental or disruptive in terms of appearance or operation to neighboring properties
and residents. This criterion is met.
C. Conditions of approval. The director may impose conditions upon the approval of a Type II
home occupation permit to ensure compliance with the requirements of this chapter. These
conditions may include, but are not limited to, the following:

occupation;
Staff has included a condition of approval that requires the street right-of-way to be free at all times of
customer vehicles associated with this home occupation. All customer parking shall be accommodated
on site.
FINDING: The proposed Type II Home Occupation complies or can be made to comply with all
statutory and ordinance requirements and regulations, as demonstrated by the analysis
contained within this administrative decision, and through the imposition of conditions
of approval.
SECTION VI. OTHER STAFF COMMENTS
The City of Tigard Building and Engineering Divisions were sent copies of the applicant's
proposal,and had no objections.
SECTION VII. AGENCY COMMENTS
Tualatin Valley Fire and Rescue was sent a copy of the applicant's proposal,and had no objections.

The decision of the Director (Type II Procedure) or Review Authority (Type II Administrative Appeal or
Type III Procedure) is final for purposes of appeal on the date that it is mailed. Any party with standing as
provided in Section 18.390.040.G.1 may appeal this decision in accordance with Section 18.390.040.G.2 of
the Tigard Community Development Code, which provides that a written appeal together with the
required fee shall be filed with the Director within ten (10)business days of the date the Notice of Decision
was mailed. The appeal fee schedule and forms are available from the City of Tigard Planning Division,
13125 SW Hall Boulevard,Tigard, OR 97223.
Unless the applicant is the appellant, the hearing on an appeal from the Director's Decision shall be
confined to the specific issues identified in the written comments submitted by the parties during the

of using the adjoining area of 238 sq. feet.

PROJECT DESCRIPTION: Acupuncture practice with clients coming to the home by
appointment.
ZONING: R-4.5 Low Density Residential
SUBMITTAL MATERIALS:
• Completed Land use application
• Narrative that describes the proposed business and addresses the Tigard
Community Development Code sections 18.742.040 and 18.742.050 (see
attached).
• Dimensioned floor plans to scale showing location and square footage of areas
used for business.This includes living areas,garage space,accessory buildings,
and yard space.
• A list of all work-related vehicles,including the trailer if applicable. If the
trailer is not a work vehicle,please specific its function and use.
• Proposed parking locations of personal and work vehicles.
• Copy of the deed or title report showing ownership of the property.
• Impact study describing the impact on public systems (water,sewer,parks,
transportation,storm drainage,and noise).
• Two (2) sets of stamped and addressed envelopes (see handout titled Envelope
Submittal Requirements).
• Copy of the Pre-Application Notes.
• Home Occupation Type II: $300.00 (Please note all fees increase July 1,2017)
PROCESS
Type II application process that includes:
• Completeness Review (15`round can be up to 30 days)
• Once deemed complete,review takes approximately 6 weeks
• 14 day public comment period during the review
• Decision issued will be Approved,Approved with Conditions, or Denied
• 10 day appeal period after the decision is issued
ONGOING OBLIGATIONS
The proposed home occupation must adhere to the scope of the business proposed in the
application materials,as well as any conditions of approval applied to the approval. This is
necessary to ensure your home occupation complies with the Tigard Development Code,and
does not result in detrimental or disruptive impacts to neighboring properties and residents.
Failure to adhere to the scope and conditions of the approved permit may result in the
revocation of the permit by the Community Development Director.
