The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.410.040. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. LLA2016-00014 Kovalev Lot Line Adjustment 1 CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED 1. The applicant shall record the lot line adjustment with Washington County, and submit a copy of the recorded survey map to the city within 15 days of recording to be incorporated into the record. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located on the south side of SW Walnut Terrace, west of SW 65th Avenue, and east of SW 69th Avenue. The property is also located west of the city's border with the City of Portland, and south of the city's border with unincorporated Washington County. Each parcel is approximately 18,295 square feet in size,and has 86 feet of direct frontage along SW Walnut Terrace. Both parcels are currently vacant. In August 2016, a building permit (BUP2016-00231) was approved to demolish a single-family home and a detached garage that previously existed on Parcel 1. The applicant intends to build a new single-family home on Parcel 1, and develop a future three-lot partition on Parcel 2. Accordingly, the applicant requests this lot line adjustment to separate the proposed development on Parcel 2 from Parcel 1. Both parcels are zoned R-4.5 (Low-Density Residential),as are surrounding properties. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Tigard Development Code (TDC) Section 18.410.040 contains the following criteria for approval of a Lot Line Adjustment request: Section 18.410.040 A. Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No additional parcels will be created as a result of this lot line adjustment. Parcel 1 will be 7,560 square feet in size, and Parcel 2 will be 29,408 square feet in size. Accordingly, both lots exceed the minimum lot size for a detached unit in the R-4.5 zone: 7,500 square feet.This criterion is met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Staff reviewed the applicant's narrative and submitted site plan to determine that this lot line adjustment will not result in any violations of the site development or zoning district regulations for the R-4.5 zone. This criterion is met. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; LLA2016-00014 Kovalev Lot Line Adjustment 2 The average minimum lot width in the R-4.5 zone is 50 feet for lots with detached units. Both parcels exceed this requirement because Parcel 1 has an average lot width of 70 feet, and Parcel 2 has an average lot width of approximately 129 feet. This criterion is met. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; Parcel 1 will be 7,560 square feet in size, and Parcel 2 will be 29,408 square feet in size. Accordingly, both lots exceed the minimum lot size for a detached unit in the R-4.5 zone: 7,500 square feet. In addition, the applicant is not proposing to create any flag lots with this lot line adjustment. This criterion is met. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and As a result of this lot line adjustment, Parcel 1 will have approximately 70 feet of direct frontage along SW Walnut Terrace, and Parcel 2 will have approximately 85 feet of direct frontage along SW Walnut Terrace. This criterion is met. d. Setbacks shall be as required by the applicable zoning district. Both parcels are currently vacant, and the applicant is not proposing any structures on either parcel at this time. However, staff reviewed the applicant's site plan to confirm that both parcels have sufficient space for future development that meets the minimum required setbacks for the R-4.5 zone.This criterion is met. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The applicant is not proposing to create any flag lots as a result of this lot line adjustment. Therefore, these criteria do not apply. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. The applicant is not proposing to create a new accessway with this lot line adjustment. In addition, fire hydrants are already in place. This criterion is met. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. The applicant is not proposing to create a common drive to serve more than one lot with this lot line adjustment. This criterion does not apply. 7. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. As a result of this lot line adjustment, Parcel 1 will have approximately 70 feet of direct frontage along SW Walnut Terrace, and Parcel 2 will have approximately 85 feet of direct frontage along SW Walnut LLA2016-00014 Kovalev Lot Line Adjustment 3 Terrace.This criterion is met. FINDING: Based on the analysis above, staff finds the approval criteria for Lot Line Adjustments are either met, satisfied through conditions of approval, or do not apply. Both parcels currently consist of 18,484 square feet. One of the parcels has an address of 6618 SW Walnut Terrace and is identified as Tax Map #1 S 125DA03800. This parcel had an existing house and garage, both of which were completely demolished last week. The second parcel does not have an address, is adjacent to the east of Parcel 1 and is identified as Tax Map #1 S 125DA03700. Parcel 2 does not have any existing structures. The property owner proposes a lot line adjustment between Parcel 1 and Parcel 2 which would reduce Parcel 1 to 7,560 square feet in size and increase Parcel 2 to 29,408 square feet in size. The house and garage shown on the Existing Conditions Map on Parcel 1 have both been recently demolished. The property owner will build a new house on Parcel 1 upon completion of the lot line adjustment and will proceed with a three-lot partition on Parcel 2. TIGARD MUNICIPAL CODE Title 18 - COMMUNITY DEVELOPMENT CODE (the Code) CHAPTER 18.410 LOT L INE ADJUSTMENTS Section 18.410.020 Approval Process A. Decision-making process. Lot line adjustments shall be reviewed by means of a Type 1 procedure, as governed by Chapter 18.390, using approval criteria contained in Section 18.410.040. B. Time limit on approval. The lot line adjustment approval by the director shall be effective for a period of 1 1/2 years from the date of approval. C. Lapsing of approval. The lot line adjustment approval by the director shall lapse if: 1. The lot line adjustment has been improperly recorded with Washington County without satisfactory completion of all conditions attached to the approval; or 2. The final recording is a departure from the approved plan. D. Extension. The director shall, upon written request by the applicant and payment of the required fee, grant an extension of the approval period not to exceed one year provided that: Type I Lot Line Adjustment Tax Lots 3800 and 3700 E 1VS E R I U Response: The property owner is submitting a Type I application, pursuant to Section 18.410.020 A. of the Code. The property owner intends to record the property line adjustment as soon as approval is received, thus negating any lapses of approval or the need to request any extensions. Section 18.410.030 Application Submission Requirements A. General submission requirements. All application shall be made on forms provided by the director and shall include information required for a Type I application, as governed by Chapter 18.390. B. Specific submission requirements. All applications shall include the preliminary lot line map and necessary data or narrative, detailed information for which shall be obtained from the director. Response: The appropriate application has been obtained from City of Tigard for a Lot Line Adjustment - Type I Application, has been completed and is included as part of this package. An existing site plan, as well as the proposed Record or Survey map and legal descriptions have also been included with this submittal, along with the required fee and the signature of all property owners on the application. Section 18.410.040 Approval Criteria A. Approval criteria. The director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district. Response: Each of the parcels are presently 18,484 square feet. Parcel 1 will be reduced to 7,560 square feet. Parcel 2 will be increased to 29,408 square feet. There are two parcels now and there will only be two parcels after the lot line adjustment. No additional lots are being created. The subject parcels are located in the R4.5 zoning district which has a minimum lot size requirement of 7,500 square feet. Both of the reconfigured parcels meet or exceed the minimum lot size requirement. 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district. Response: At the time of this application, neither Parcel 1 nor Parcel 2 have any existing structures. Type I Lot Line Adjustment Tax Lots 3800 and 3700 E ]V\ ] R I U 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; b. The lot area shall be as required by the applicable zoning district. Each lot created through the partition process shall front a public right-of- way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and d. Setbacks shall be as required by the applicable zoning district. Response: The parcels are in the R4.5 zoning district with a minimum lot size of 7,500 square feet and a minimum lot width of 50 feet. Both parcels will meet or exceed both of those minimum requirements after the lot line adjustment. Parcel 1 will be 7,560 square feet, being 70.00 feet wide.
