DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. LLA2016-00005 Reaume Lot Consolidation 1 CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED 1. The applicant shall record the lot line adjustment with Washington County, and submit a copy of the recorded survey map to the city within 15 days of recording to be incorporated into the record. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located southwest of SW Tigard Street, and north of SW Katherine Street. Parcel 1 (10150 SW Tigard Street;WCTM 1S135CC,Tax Lot 3700) currently contains a mobile home, but is otherwise undeveloped. Parcel 2 (WCTM 1S135CC, Tax Lot 3800) is currently vacant and undeveloped. Parcel 3 (10180 SW Tigard Street; WCTM 1S135CC, Tax Lot 3900) is currently developed with a detached, single-family home, various accessory structures (including a detached garage), paved driveway, and associated landscaping. All three parcels are zoned Low-Density Residential (R-4.5),as are adjacent properties. Proposal Description: The applicant is proposing to consolidate three properties: 10150 SW Tigard Street,WCTM 1S135CC, Tax Lot 3700 (Parcel 1); WCTM 1S135CC, Tax Lot 3800 (Parcel 2); and 10180 SW Tigard Street, WCTM 1S135CC, Tax Lot 3900 (Parcel 3). The proposed action will be processed through a lot line adjustment. The three tax lots identified above will be combined to create one tax lot that is 3.14 acres in size. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Section 18.410.040 contains the following criteria for approval of a Lot Line Adjustment request: Section 18.410.040 A. Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; An additional parcel will not be created as part of this application. The applicant is not proposing to reduce any lot sizes; the proposal is to combine Parcels 1, 2, and 3 into one 3.14-acre tax lot. The resulting lot exceeds the minimum lot size for the R-4.5 zone (7,500 square feet for detached, single- family units and 10,000 square feet for duplexes) because it is approximately 136,778 square feet in size. This criterion is met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; The applicant is not proposing to reduce any lot sizes; the proposal is to combine Parcels 1, 2, and 3 into one 3.14-acre (136,778 square feet) tax lot. Staff reviewed the applicant's narrative and submitted site plan to determine that this lot consolidation will not result in any violations of the site development or zoning district regulations for the R-4.5 zone. This criterion is met. LL.t2016-00005 Reaumc Lot Consolidation 3. The resulting parcels are in conformity with the dimensional standards of the zoning district,including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; Staff reviewed the applicant's site plan to confirm the average lot width for the resulting lot exceeds the average minimum lot width for the R-4.5 zone (50 feet for detached, single-family units and 90 feet for duplexes). This criterion is met. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; The lot area meets all requirements for the R-4.5 zone because the resulting lot exceeds the minimum lot size of 7,500 square feet for detached, single-family units and 10,000 square feet for duplexes. The resulting single lot is approximately 136,778 square feet in size. The lot is not a flag lot. This criterion is met. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and The resulting lot will have approximately 351 feet of direct frontage along SW Tigard Street. This criterion is met. d. Setbacks shall be as required by the applicable zoning district. Staff reviewed the applicant's site plan to confirm the resulting lot meets all setback requirements for the R-4.5 zone. This criterion is met. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The applicant is not proposing to create any flag lots as a result of this lot consolidation. Therefore, these criteria do not apply. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. The applicant is not proposing to create a new accessway with this lot consolidation. In addition, fire hydrants are already in place. This criterion is met. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. The applicant is not proposing to create a common drive to serve more than one lot with this lot consolidation. This criterion does not apply. 7. Any accessway shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. L1..\2016-00005 Reaume Lot Consolidation 3 The applicant is not proposing any new accessway to the consolidated lot, and the resulting lot will have approximately 351 feet of direct frontage along SW Tigard Street.This criterion is met. FINDING: Based on the analysis above, staff finds the approval criteria for Lot Line Adjustments are either met, satisfied through conditions of approval, or do not apply. The proposal is in compliance with the requirements of this Title. SECTION V. It is necessary to ensure that any future development of the adjusted, and consolidated lots 3700,3800, & 3900 are located outside of the flood Plain. The house currently addressed at 11820 SW Tiedeman Ave, and located on Tax Lot 800 will remain. After the PLA this property will NOT be part of the adjacent land use subdivision decision, and not part of its development. There will be temporary disturbance for the construction of the public sanitary, and storm mains. But these will be constructed as "off-site" Improvements. 18.410.040 Approval Criteria A. Approval criteria. The director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district. Comment: The proposed property line adjustment will use the existing property line between tax lot 800 and the consolidated tax lots 3700, 3800& 3900. Which will be relocated to the east side of the existing home of tax lot 800. Minimum lot size will be met, both parcels are over 7,500 SF. Tax lot 800 is 1.14 acres. After the PLA it will be 0.33 acres or 14,191 SF. Tax Lot 3700, 3800 and 3900 are 3.14 acres. After the PLA It will be will be 3.95 acres. This is the area that will be subdivided, after the PLA is recorded. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district. Comment:Applicants proposal will comply with all zoning and zoning district regulations. All setback requirements will be met in the R4.5 zone and minimum density of 7,500 is complied. 3.The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a.The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; Comment:Average minimum lot width is 50ft, parcel 1 and 2 have no width under 100ft. b.
