APPLICATION SUMMARY FILE NAME: BCS DEVELOPMENT, LLC CASE NO.: Lot Line Adjustment(LLA) LLA2016-00012 PROPOSAL: The applicant is proposing a lot line adjustment affecting two properties: WCTM 2S103CA, Tax Lot 111 (Parcel 1); and WCTM 2S103CA, Tax Lot 101 (Parcel 2). As a result of this lot line adjustment,Parcel 1 will be a flag lot that is 7,636 square feet in size (exclusive of the flag pole area),and Parcel 2 will be 13,515 square feet in size. This proposal is the second in a series of three applications for lot line adjustments. The applicant ultimately proposes to reconfigure Parcels 1, 2, and an adjacent property (13185 SW 115th Avenue; WCTM 2S103CA, Tax Lot 110), in order to accommodate the future construction of two new detached, single-family homes. The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.410.040. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. LLr12016-00012 BCS Development,LLC 1 CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED 1. The applicant shall record the lot line adjustment with Washington County, and submit a copy of the recorded survey map to the city within 15 days of recording to be incorporated into the record. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located on the west side of SW 115th Avenue, north of SW Gaarde Street, and south of SW Fonner Street. Both parcels are currently vacant, and are zoned Low-Density Residential (R-4.5), as are surrounding properties. Each parcel has at least 25 feet of direct frontage along SW 115th Avenue. This proposal is the second in a series of three applications for lot line adjustments. The applicant ultimately proposes to reconfigure Parcels 1, 2, and an adjacent property (13185 SW 115th Avenue;WCTM 2S103CA,Tax Lot 110),in order to accommodate the future construction of two new detached, single-family homes. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.410 Lot Line Adjustments: 18.410.040 Approval Criteria A. Approval criteria. The director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No additional parcels will be created as a result of this lot line adjustment. Parcel 1 will be a flag lot that is 7,636 square feet in size (exclusive of the flag pole area), and Parcel 2 will be 13,515 square feet in size. Accordingly, both lots exceed the minimum lot size for the R-4.5 zone: 7,500 square feet for detached units.This criterion is met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Staff reviewed the applicant's narrative and submitted site plan to determine that this lot line adjustment will not result in any violations of the site development or zoning district regulations for the R-4.5 zone.This criterion is met. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district,including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; The average minimum lot width for the R-4.5 zone is 50 feet for lots with detached units. Staff reviewed the applicant's submitted site plan to confirm the lot widths for both parcels exceed 50 feet. Therefore, this criterion is met. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; LLA2016-00012 BCS Development,LLC 2 Parcel 1 will be a flag lot that is 7,636 square feet in size (exclusive of the flag pole area), and Parcel 2 will be 13,515 square feet in size. Accordingly, both lots exceed the minimum lot size for the R-4.5 zone: 7,500 square feet for detached units.This criterion is met. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and As a result of this lot line adjustment,Parcel 1 will be a flag lot that connects to SW 115t Avenue via an approximately 15-foot-wide accessway (flag pole), and Parcel 2 will have approximately 60 feet of direct frontage along SW 115`h Avenue. This criterion is met. d. Setbacks shall be as required by the applicable zoning district. Both parcels are currently vacant, and the applicant is not proposing any development at this time. Accordingly,compliance with minimum setback requirements for the R-4.5 zone (TDC Table 18.510.2) and for flag lots (1DC 18.730.050.F) will be confirmed prior to building permit submittal. This criterion is met. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. The applicant is not proposing any development at this time. However, the proposed flag lot (Parcel 1) is large enough to accommodate a residence and still meet minimum setback requirements. Prior to building permit submittal, compliance with the standard outlined above will be ensured through site plan review.This criterion is met. b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The applicant is proposing an approximately 54-foot-long accessway (flag pole) that will connect Parcel 1 to SW 115`h Avenue. There are currently hedges located along the northern property line of Parcel 1, which provide adequate screening between Parcel 1 and an abutting lot (13125 SW 115th Avenue; WCTM 2S103CA,Tax Lot 104). Staff finds these hedges meet the screening standard outlined in TDC 18.745.050 because they are taller than six feet in height. Therefore,this criterion is met. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. Access drives in excess of 150 feet in length shall be provided with approved provisions for the turning around of fire apparatus (l'DC 18.705.030.I.4). This standard does not apply because the applicant is proposing an accessway to connect Parcel 1 to SW 115`h Avenue that is only 54 feet in length. In addition, fire hydrants are already in place.This criterion is met. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. The applicant is not proposing to create a common drive to serve more than one lot with this lot line adjustment. This criterion does not apply. 7. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. LLA2016-00012 BCS Development,LLC 3 As a result of this lot line adjustment,Parcel 1 will be a flag lot that connects to SW 115`h Avenue via an approximately 15-foot-wide accessway (flag pole), and Parcel 2 will have approximately 60 feet of direct frontage along SW 115th Avenue.This criterion is met. B. Exemptions from dedications.A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. No floodplain,greenway, or right-of-way dedication will be required as part of this lot line adjustment application. C. Variances to development standards.An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370,Variances and Adjustments. (Ord. 09-13) No variances or adjustments are being requested as part of this application. FINDING: Based on the analysis above, staff finds the approval criteria for Lot Line Adjustments are either met, satisfied through conditions of approval, or do not apply. The proposal is in compliance with the applicable requirements of this Title. SECTION V. The purpose of the Lot Line Adjustments is to separate the existing house from the other two parcels resulting in two additional buildable single family residences in the R-4.5 Zone. Chapter 18.410 Lot Line Adjustments 18.410.010 Purpose The purpose of this chapter is to provide rules, regulations and criteria governing approval of lot line adjustments. COMMENT: The applicant is requesting a 3-phase Lot Line Adjustment application. The adjustments are as follows: Lot Line Adjustment 1: LLA2016-010 between Tax Lots 101 & 110. Lot Line Adjustment 2: LLA2016-012 between Tax Lots 101 & 111. Lot Line Adjustment 3: LLA2016-013 between Tax Lots 101 & 110. 18.410.020 Approval Process A. Decision-making process. Lot line adjustments shall be reviewed by means of a Type I procedure,as governed by Chapter 18.390, using approval criteria contained in Section 18.410.040. COMMENT: Lot Line adjustments 1, 2 & 3 are being processed through separate Type I applications. B. Time limit on approval.The lot line adjustment approval by the director shall be effective for a period of 1-1/2 years from the date of approval. C. Lapsing of approval. The lot line adjustment approval by the director shall lapse if: 1. The lot line adjustment has been improperly recorded with Washington County without the satisfactory completion of all conditions attached to the approval; or 2. The final recording is a departure from the approved plan. D. Extension.The director shall, upon written request by the applicant and payment of the required fee,grant an extension of the approval period not to exceed one year provided that: 1. No changes are made on the original plan as approved by the director; 2. The applicant can show intent of recording the approved partition or lot line adjustment within the one year extension period; and 3. There have been no changes in the applicable comprehensive plan policies and ordinance provisions on which the approval was based. Page 3 COMMENT: The applicant intends to complete and record the lot line adjustments in a timely manner prior to expiration. 18.410.030 Application Submission Requirements A. General submission requirements.All applications shall be made on forms provided by the director and shall include information required for a Type I application, as governed by Chapter 18.390. B. Specific submission requirements.All applications shall include the preliminary lot line map and necessary data or narrative, detailed information for which shall be obtained from the director. COMMENT: The applicant has submitted the required materials including lot line maps with legal descriptions, other exhibits and this narrative. 18.410.040 Approval Criteria A. Approval criteria.The director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment,and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district. COMMENT: No new parcels are created through these lot line adjustments. All adjustments are in compliance with the minimum 7,500 sq. ft. lot area standard. 2. By reducing the lot size,the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district. COMMENT: The common lot line between existing residence on Tax Lot 110 and Tax Lot 101 will be reduced to 12-ft. upon approval of a related rear yard setback adjustment. All other setbacks are in compliance with the standards of the R-4.5 zone. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; COMMENT: All three parcels will have a minimum 50-ft. lot width. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot,the accessway may not be included in the lot area calculation; Page 4 COMMENT: All three parcels exceed the minimum 7,500 sq. ft. lot area standard of the R-4.5 zone. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement;and COMMENT: Tax Lots 101 & 111 are flag lots with a minimum 15-ft. frontage on SW 115th Avenue. d. Setbacks shall be as required by the applicable zoning district. COMMENT: The residences on all three parcels will comply with the setback standards of the R-4.5 zone subject to approval of the requested rear yard setback adjustment. 4. With regard to flag lots: a. When the partitioned lot is a flag lot,the developer may determine the location of the front yard, provided that no side yard is less than 10 feet.Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within 10 feet of an abutting lot in accordance with Section 18.745.050.Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. COMMENT: Setbacks on Tax Lots 101 & 111 will be determined prior to building permit issuance. The shared driveway will be screened from adjacent Tax Lot 110 with an existing landscape strip. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. COMMENT: A fire hydrant is located across SW 115th Avenue. 6. Where a common drive is to be provided to serve more than one lot,a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. COMMENT: A reciprocal access easement will be recorded over the shared access on Tax Lots 101 & 111. Page 5 7. Any accessway shall comply with the standards set forth in Chapter 18.705,Access, Egress, and Circulation. COMMENT: No accessways are proposed or required. B. Exemptions from dedications.A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway,or right-of-way dedication is required. COMMENT: This project is exempt from the requirement for dedication of additional right-of-way. C. Variances to development standards. An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370,Variances and Adjustments.
