i Lto L C hereinafter called the Grantors, in consideration for access to the traffic
signal at I4.d . 51,-) IGg-f-ttirt&itet from the City of Tigard, hereinafter called Grantee, grant and convey
unto the City of Tigard a perpetual easement for the construction, maintenance and free access to, the traffic signal apparatus on the
following described parcel of land described in Exhibit"A",situated in the City of Tigard,Washington County,State of Oregon.
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right, title or interest except those expressly stated in this
easement, nor otherwise prevent Grantors from the full use and dominion thereover; provided, however, that such use shall not be
permitted to damage or destroy the traffic signal apparatus or otherwise interfere with construction, maintenance, and access to, such
traffic signal apparatus,and it is FURTHER UNDERSTOOD AND AGREED that the City of Tigard shall never be required to be subject
to any damages to the Grantors, their heirs, successors and assigns by reason of change of access or grade at the street abutting said
property. Grantor shall maintain the landscaping within the easement. All costs of installation, maintenance and power for the traffic
signal apparatus shall be paid by the City unless otherwise stated above.
IN CONSIDERATION of the premises, Grantee agrees that if said Grantee, its successors or assigns should cause said easement to be
vacated, the right of the Grantee in the above-described easement will be forfeited and shall immediately revert to the Grantors, their
successors and assigns in the case of such event.
TO HAVE AND TO HOLD the above-described and granted premises unto said Grantee,its successors and assigns forever.
The Grantors does hereby covenant to and with the City of Tigard, that it is the owner in fee simple of said premises; that the above
described property is free from all encumbrances,and that it will warrant and defend the same from all lawful claims whatsoever.
IT WITNESS WHEREOF, the undersigned corporation has caused this easement to be executed by its duly authorized, undersigned
officers acting pursuant to resolution of its Board of Directors.

A portion of that property described in deed to TLB, LLC recorded June 12, 2006 as Document
Number 2006-069461, Washington County Deed Records, located in the southwest one-quarter of
the southeast one-quarter of Section 36, Township 1 South, Range 1 West, Willamette Meridian,
City of Tigard,Washington County, Oregon, and being more particularly described as follows:
Commencing at a 3-1/4 inch aluminum cap set in concrete at the south quarter corner of said
Section 36; Thence along the south line of said Section 36, South 88°32'46"East 709.55 feet to a 2
inch brass disk stamped "City of Tigard PLS 1856" located on the centerline of SW 72nd Avenue;
Thence continuing along the south line of said Section 36, South 88°32'46" East 20.00 feet to the
southwest corner of said TLB, LLC property, and the Point of Beginning.
Thence along the easterly right-of-way line of SW 72"d Avenue (20.00 feet easterly from the
centerline thereof, when measured at right angles), North 01°43'56" East 100.00 feet; Thence
departing said easterly right-of-way line, South 88°16'04" East 26.00 feet to a point 46.00 feet
easterly from the centerline of SW 72nd Avenue, when measured at right angles; Thence parallel
with and 46.00 feet easterly from said centerline, when measured at right angles, South 01°43'56"
West 61.74 feet to a point of curvature; Thence 40.97 feet along a tangent circular curve to the left

36.86 feet to a point of tangency with a 47.00 foot northerly offset line from the centerline of SW
Dartmouth Street; Thence South 01°27'14" West 12.00 feet to the northerly right-of-way line of
SW Dartmouth Street (35.00 feet northerly from the centerline thereof, when measured at right
angles); Thence along said northerly right-of-way line, North 88°32'46" West 52.19 feet to the
Point of Beginning.
