This Easement dated this day of September,
1977 from B & T Investment Company, a joint venture of Riley
R. Taylor and Thomas M. Taylor, referred to hereinafter as
"Grantor" , and to The City of Tigard, State of Oregon,
referred to hereinafter as "Grantee".
IN CONSIDERATION of approval of a zone change
request by Grantee, Grantor conveys to Grantee, its successors
and assigns, a perpetual non-exclusive easement for use of
a strip of land across the property of Grantor described as
follows:
A tract of land in Section 1, Township 2 South,
Range 1 West, Willamette Meridian, Washington
County, Oregon, more particularly described as
follows :
Beginning at the northwest corner of Government
Lot 4, in Section 1, Township 2 South, Range 1
West, Willamette Meridian, Washington County,
Oregon; thence North 89° 15' 37" East 418. 38
feet along the North line of said Lot 4; thence
South 00° 31' 16" West 366. 28 feet to the center
line of Southwest Sandburg Street; thence South
89° 05' 17" West 419.48 feet along said Northerly
right of way line to a point on the West line of
said Lot 4; thence North 00° 42 ' 00" East 367.57
feet to the point of beginning.
1. Easement Strip. The easement strip shall be a
rectangular section of land one (1) foot in width from east
to west and 367 feet in length, and running precisely from
the northern border to the southern border of the lot of

Grantor described above, with the easement strip on the
westerly area of the lot and immediately adjacent to that
portion of the lot dedicated for Southwest 72nd Avenue.
2. Use. Grantee shall use the easement as an access
control strip to prohibit direct access across the easement
strip between the lot of Grantor and Southwest 72nd Avenue.
3. Southwest Sandburg. This easement shall not
restrict the right of Grantor to have access across, onto,
from, or over Southwest Sandburg Street.
4. Title. This easement does not convey the title
to the easement strip to Grantee, and Grantor retains title
to the easement strip and may use the easement strip for any
purposes not contrary to this easement.
