ACCESS EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that HERITAGE DEVELOPMENT COMPANY, INC. ,
an Oregon corporation, hereinafter referred to as Grantor, does hereby
grant unto the CITY OF TIGARD, a Municipal corporation and political
subdivision of the State of Oregon, hereinafter referred to as Grantee,
its successors and assigns, a perpetual easement and right of way across
the following described property:
(See Exhibit A attached hereto)
This access easement is granted for the purpose of maintaining, repairing
and using the same for access to public facilities, and Grantee shall have
the right at any time hereafter to enter upon the above described real
property for the purposes above mentioned.
Grantor, its successors or assigns in title to the subject property reserves
the right to use the surface of the land for residential purposes which do
not interfere with the use of the subject easement area by Grantee. No
building or improvement shall be placed upon the foregoing easement area
without written permission of Grantee.
Upon completion of any use, maintenance or repair by Grantee, Grantee shall
restore the disturbed surface and shall indemnify and hold Grantor harmless
against any and all loss, costs or damage arising out of the exercise
of the rights granted herein.
The true and actual consideration for this easement is $0. However, the
actual consideration consists of other good and sufficient value given or
promised, which is the whole consideration.
IN WITNESS WHEREOF, the Grantor above named herein set its hand and seal

Northeast one-quarter of Section 9 in Township 2 South and Range
1 West of the Willamette Meridian in the City of Tigard, County
of Washington and State of Oregon, being more particularly
described as follows:
§D(§A The southeasterly 10 feet of said Lot 24, being a strip 10 feet
in width, adjoining and immediately northwesterly of the lot
line bearing North 35°32 '25" East as shown on the plat of said
Three Mountain Estates; said strip terminating on the northerly
and southerly lines of said Lot 24.
