Shinn Grantor, for valuable consideration, the receipt and adequacy of which are acknowledged, does hereby give, grant, and convey unto the City of Tigard, a municipal corporation of Washington County, State of Oregon, and unto its assigns, forever; an easement over, across and under the following described lands and real property, to-wit : Beginning at the southeast corner of said Fee No.84011353,being in the westerly line of the J.L. Hicklin D.L.C. No.37, also being the northeast corner of"Genesis No. 3," as recorded in Book 52, Page 32,Washington County Plat Records; thence along the northerly line of said "Genesis No. 3," S. 89° 47' 52" W., a distance of 34.13 feet to the northeasterly corner of Lot 91 of said "Genesis No. 3"; thence along a line through said Fee No. 84011353, N. 43° 57' 56" E., a distance of 32.98 feet, more or less, to said westerly line of the J.L. Hicklin D.L.C., also being the west line of "Pathfinder II" as recorded in Book 37, Page 33 of the Washington County Plat records; thence along said westerly line, S. 25°26'40" E., a distance of 26.15 feet to the point of beginning. for a bicycle way and pedestrian way, which may be used by pedestrians and non-motorized mechanical means of transportation, such as bicycles and for no other purposes, and for said purposes to place, construct, operate, replace, maintain, inspect, reconstruct and install necessary improvements, and the right to enter upon such premises for said purposes . The Grantee shall have the right at any time to enter upon the above-described real property for the purposes hereinabove mentioned, and in connection therewith may remove any trees, shrubs, or brush necessary or convenient to accomplish said purposes . The Grantors, their heirs, successors, assigns or representatives shall not construct or maintain any building or other structures upon the above-described real property. The Grantors do hereby reserve the right to utilize the said area for all private lawful purposes which do not unreasonably interfere with or are not inconsistent with the uses thereof by the grantee and the public for the purposes herein stated. It is expressly understood that this easement does not convey any right, title, or interest except those expressly stated in this easement, nor otherwise prevent Grantors from the full use and dominion hereover; provided, however, that such use shall not interfere with the uses and purposes of the intent of the easement . The Grantee shall be responsible for the safe maintenance of the above-described easement and for otherwise maintaining said easement free of hazards . The Grantee agrees to indemnify and hold harmless the Grantors and their successors from all suits or actions brought because of injury or damage sustained by any person or property resulting from the negligent act, error, or omission of the Grantee or its agents in maintaining the bicycle or pedestrian easement . In consideration of the premises, Grantee agrees- that if said Grantee, its successors or assigns should cause said easement to be vacated, the rights of the Grantee in the above-described easement will be forfeited and shall immediately revert to the Grantors, their successors and assigns in the case of such event .
