For good and valuable consideration, receipt of which is
hereby acknowledged, the Northwest District of the Lutheran Church,
Missouri Synod, (Grantor) conveys to the CITY OF TIGARD, a
municipal corporation (Grantee) , the following perpetual and
temporary easements :
(A) A perpetual easement and right of right of way over
the following described property:
10 FOOT WIDE STORM DRAIN EASEMENT
SITUATED IN THE NORTHEAST ONE-QUARTER OF SECTION 4,
TOWNSHIP 2 SOUTH, RANGE 1 WEST OF THE WILLAMETTE
MERIDIAN, CITY OF TIGARD, WASHINGTON COUNTY, OREGON WITH
BEARINGS BASED ON THE SOUTH LINE OF LOT 141 OF THE PLAT
OF "MORNING HILL NO. 6" AS RECORDED IN PLAT BOOK 66, PAGE
35, WASHINGTON COUNTY RECORDS AND MORE PARTICULARLY
DESCRIBED AS FOLLOWS:
ALL OF THAT PORTION OF LAND LYING 7 . 50 FEET ON EACH SIDE
OF THE FOLLOWING DESCRIBED CENTERLINE:
BEGINNING AT A POINT ON THE WEST LINE OF SAID LOT 141,
WHICH BEARS S 3° 32 ' 03 " W, A DISTANCE OF 7 . 60 FEET FROM
THE NORTHWEST CORNER THEREOF; THENCE N 77" 17 ' 02 " W, A

OF 132 . 57 FEET TO THE TERMINUS OF THIS CENTERLINE.

1 . The easement is for the purpose of constructing or
maintaining the improvements necessary for conveying storm drainage
within, over or under the above described strip of land.

2 . The Grantee, its agents, contractors, and invitees
shall have the right to enter upon the above described real estate
at any time that it may see fit to construct, maintain, and repair
a pipeline of such dimensions as may now or hereafter be required
for the purpose of conveying all or any part of the surplus waters
of the area served by this line which is known as Morninghill of
the City of Tigard.
3 . The Grantor shall not be allowed to build any
permanent structure or make any site alterations over and above the
permanent easement described above.
4 . The easement shall run with the land and is binding
on Grantor' s heirs, personal representatives, successors, and
assigns .
(B) A temporary easement over the following described
property:
30 FOOT WIDE STORM DRAIN EASEMENT.
SITUATE IN THE NORTHEAST ONE-QUARTER OF SECTION 4,
TOWNSHIP 2 SOUTH, RANGE 1 WEST OF THE WILLAMETTE
MERIDIAN, CITY OF TIGARD, WASHINGTON COUNTY, OREGON WITH

FEET TO THE TERMINUS OF THIS CENTERLINE.
The temporary easement is only for the original
excavation and construction of the storm drainage line described at
Section (A) above. Upon completion and acceptance by Grantee of
the construction, the temporary easement shall cease.
