Lautt Hereinafter termed grantor Zs), in consideration of the sum of $ none to be paid by CITY OF TIGARD, a municipal corporation of Oregon, hereinafter termed the City, hereby grant, bargain, sell and convey unto the CITY OF TIGARD a perpetual right- of-way and easement as hereinafter described, together with a temporary right-of-way and easement to use an additional area hereinafter described and designated temporary ease- ment, for the following uses and purposes: I. Perpetual easement: An unencumbered perpetual right-of-way and easement for the purpose of constructing, reconstructing, operating, maintaining, inspecting and repairing of an underground sewer line and appurtenances, together with the right to remove, as necessary, vegetation, foliage, trees and other obstructions within the easement area, but re- serving to the grantors the title to the lands, subject to the easement, and the right to make such use thereof; except to construct buildings, as will not interfere with the uses and purposes of the easement; said easement area being ten (10) feet on each side, when measured at right angles, of the following described center line within the following designated premises; Easement (1) - Beginning at a point on the west line of Lot 28 Tigardville Heights in Section 11 , T-2S:, R-1W, W. M. Washington County, Oregon which is 170.00 feet south of the northwest corner; thence easterly to a point on the east line of Lot 28 that is 175.00 feet south of the northeast corner of Lot 28. Easement (2) - Beginning at a point on the north line of that tract described in bargin and sale deed recorded in Washington County, Oregon as instrument 79046096; said point being 107.50 feet west of the east line of Lot 28 Tigardville Heights; thence west along the north line of the last referenced tract 250.00 feet to a point. Said easement (2) being 5 feet only on the north side. Easement (3) - Also an easement 7.5 feet on each side of the following described centerline; beginning at a point located southerly 175.00 feet from the north- east corner of Lot 28 Tigardville Heights on the east line thereof; and westerly 107.50 feet on the centerline of the easement described in Easement #1 above; thence southerly parallel with and 107.50 feet from the east line of said Lot 2.8; to the north line as described fee no. 79-046096 Washington County,. Oregon. Landscaping trees within easement (3) to be replaced to original condition. 2, Temporary easement: Together with the temporary right of ingress, egress and regress, and use of sewer construction purposes, of additional lands lying parallel to, along the sides and within 15 feet, when measured to right angles, of the above described perpetual easement area, excepting and reserving to grantors the unencumbered enjoyment, use and preservation of all structures present upon the premises. This temporary easement shall terminate upon completion of the sewer construction work, at which time, upon request of the owner, the City will issue a written release thereof. /— e2— • a The grantors do hereby warrant that they are the owners in fee simple and have the right to grant the above described easements.
