PERMANENT STORM DRAINAGE EASEMENT
KNOW ALL MEN BY THESE PRESENTS THAT Eastgate Theatre, Inc.
hereinafter called the Grantors, in consideration for the sum of ZERO
dollars ($ 0.00 ) from the City of
Tigard, hereinafter called Grantee, grant and convey unto the City of Tigard a
perpetual easement for constructing, reconstructing, operating, maintaining,
inspecting and repairing of an underground storm drainage line and
• appurtenances, together with the right to remove, as necessary, vegetation,
foliage, trees and other obstructions on the following described parcel of
land, situated in the City of Tigard, Washington County, State of Oregon: *
(SEE ATTACHED DESCRIPTION)
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right,
title or interest except those expressly stated in this easement, nor
otherwise prevent Grantors from the full use and dominion thereover; provided,
however, that such use shall not interfere with the uses and purposes of the
intent of the easement.
IN CONSIDERATION of the premises, Grantee agrees that if said Grantee, its
successors or assigns should cause said easement to be vacated, the rights of
the Grantee in the above-described easement will be forfeited and shall
immediately revert to the Grantors, their successors and, assigns in the case
of such event.
TO HAVE AND TO HOLD the above-described and granted premises unto said
Grantee, its successors and assigns forever.
IN WITNESS WHEREOF, the undersigned corporation has caused this easement
to be executed by its duly authorized, undersigned officers acting pursuant to
resolution of its Board of Directors.

LEGAL DESCRIPTION
A tract of land situated in the S.E.1/4, Section 36, T1S, R1W,
W.M. , City of Tigard, Washington County, Oregon, being more
particularly described as follows:
A 20 .0 foot wide strip of land being 10 .0 feet on each side of
the following described centerline:
Beginning at a point on the northerly line of parcel one of that
tract of land conveyed to Eastgate Theatre, Inc. , recorded in
Book 886, Page 935, Washington County deed records, that is North
34°28'23" West, 26.08 feet from the southeasterly corner of said
parcel one, said point also being South 1°43 '56" West, 1617.63
feet and North 88°16 '04" West, 512 .13 feet from the N.E. corner
of the Richardson D.L.C. #55;
thence, South 50 °40 '45" West, 200 .0 feet;
thence, South 31°42 '40 " West, 180 .0 feet to the terminus of said
centerline.
