_..� 90- 43297 Washington County AD/ INDIVIDUAL PERMANENT SANITARY SEWER EASEMENT KNOW ALL MEN BY THESE PRESENTS that THEODORE H. GANO and HELEN E. GANO, husband and wife, hereinafter called the Grantors, in consideration of that certain Agreement dated May 28, 1989 between WTM Development Group, Theodore H. Gano and Helen E. Gano and other good and valuable consideration from the City of Tigard (the City of Tigard, hereinafter called the Grantee), grant and convey unto the City of Tigard a perpetual easement for constructing, reconstructing, operating, maintaining, inspecting and repairing of an underground sewer line and appurtenances, together with the right to remove, as necessary, vegetation, foliage, trees and other obstructions on the described parcel of land, situated in the City of Tigard, Washington County, State of Oregon, as fully described in Exhibit "A" attached hereto and incorporated herein. IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right, title or interest except those expressly stated in this easement, nor otherwise prevent Grantors from the full use and dominion thereover; provided, however, that such use shall not interfere with the uses and purposes of the intent of the easement. IN CONSIDERATION of the premises, Grantee agrees that if said Grantee, its successors or assigns should cause said easement to be vacated, the rights of the Grantee in the above-described easement will be forfeited and shall immediately revert to the Grantors, their successors and assigns in the case of such event. TO HAVE AND TO HOLD the above-described and granted premises unto said Grantee, its successors and assigns forever. Title: 61/4-/ Elt4 rA er" )atACc7,Av�'.Y' , Ws. << o�u�*j EASEMENT - PAGE 2 OF 2 LEGAL DESCRIPTION SANITARY SEWER EASEMENT A sanitary sewer easement consisting of a 15.00-foot-wide strip of land lying 15.00 feet easterly along a part of the west line of that certain tract of land as described in Recorder's Fee No. 89-11910 of the Washington County Deed Records situated within the southwest one-quarter of Section 2, Township 2 South, Range 1 West, of the Willamette Meridian in the County of Washington, State of Oregon, the westerly line of said 15.00-foot easement being more particularly described as follows: Beginning at the southwest corner of said tract of land described in Recorder's Fee No. 89-11910, also being the southeast corner of Lot 1 of Melrose, a duly recorded subdivision recorded in Book 16, Page 43, Washington County Plat Records; thence along the line common to said tract of land described in Recorder's Fee No. 89-11910 and said Lot 1, N. 03° 03' 42" E., a distance of 128.83 feet to the southwest corner of an existing 15.00-foot easement as described in Recorder's Fee No. 83-00975 of the Washington County Deed Records, and the terminus of the 15.00-foot-wide strip of land herein described.
