EASEMENT
KNOW ALL MEN BY THESE PRESENTS, That CHARLES L.
WOODARD and ARLIE WOODARD, in consideration of the sum of One
and no/100 Dollars ($1. 00) and other considerations, the receipt of which
is hereby acknowledged, do bargain, sell, convey, transfer and deliver
unto TIGARD SANITARY DISTRICT, a municipal corporation, a permanent
easement and right of way under and along the following described property,
to-wit:
Easterly 10 feet of Tax Lot 3a in Lot 4, more
particularly described as:
Beginning at an iron pipe on the northerly line of
Lot 4 of AMENDED PLAT OF NORTH TIGARD-
VILLE ADDITION in Section 2, T2S, R1W, W. M.
N. 57° 54' W. 157.4 feet from the northeast
corner of said Lot 4; thence S. 32° 06' W. along
the easterly line of that certain 1. 857 acre tract
conveyed to Charles L. and Arlie Woodard by deed
recorded on page 107 in Book 414 of Washington
County, Oregon, Deed Records, a distance of
419. 92 feet to the northerly line of S.W. Walnut Street;
thence along said street line N. 57° 54' W. 10. 0
feet; thence N. 32° 06' E. parallel to the easterly
line of the said Woodard tract 419. 92 feet to the
northerly line thereof; thence S. 57° 54' E. 10. 0
feet to the place of beginning.
THIS EASEMENT grants unto the TIGARD SANITARY DISTRICT
the perpetual right to enter upon the hereinabove described real property
at any time that it may see fit and construct, maintain, and repair under-
ground pipelines and/or mains for the purpose of conveying sewage over,
across, through and under said property, together with the right to excavate
and refill ditches and/ or trenches for the location of said pipelines and/or
mains and the further right to remove trees, bushes, undergrowth and other
obstructions interfering with the location, construction and maintenance of
{,4 said pipelines and/or mains. This instrument, however, does not grant
or convey unto TIGARD SANITARY DISTRICT any right or title to the sur-
face of the soil along the route of said pipelines and/or mains, except
for the purpose of location, construction and maintenance.
In addition to the permanent right and easement, hereinabove
granted, TIGARD SANITARY DISTRICT is granted a temporary right of
use during the initial location and construction of the sewer pipelines and
mains over and along a strip of land fifteen feet in width, lying contiguous
and to the north of the above-described and granted permanent easement.
