EASEMENT
,64 KNOW ALL MEN BY THESE PRESENTS, That WARREN
I JOHNSON and LORETTA JOHNSON, husband and wife, in consideration
of the sum of One and no/100 Dollars ($1. 00), and other considerations, the
receipt of which is hereby acknowledged, do bargain, sell, convey, trans-
fer and deliver unto TIGARD SANITARY DISTRICT, a municipal corporation,
a permanent easement and right of way under and along the following de-
scribed property, to-wit:
Northerly 10 feet of Tax Lot 3 in Lot 4, more
particularly described as:
Beginning at the most easterly corner of Lot 4 of the
AMENDED PLAT OF NORTH TIGARDVILLE ADDITION
in Section 2, T2S, R1W, W.M. Running thence N. 57°
54' W. along the northerly line of said Lot 4, a distance
of 157. 4 feet to an iron pipe; thence S. 32° 06' W. 10. 0
feet; thence S. 57° 54' E. , parallel with and 10. 0 feet
distant southerly from the northerly line of said Lot 4,
a distance of 156. 04 feet to a point on the easterly line
thereof; thence N. 390 53' E. 10. 09 feet to the place
of beginning.
THIS EASEMENT grants unto the TIGARD SANITARY DISTRICT
the perpetual right to enter upon the hereinabove described real property
at any time that it may see fit and construct, maintain, and repair under-
ground pipelines and/or mains for the purpose of conveying sewage over,
across, through and under said property, together with the right to excavate
and refill ditches and/or trenches for the location of said pipelines and/or
mains and the further right to remove trees, bushes, undergrowth and other
obstructions interfering with the location, construction and maintenance of
said pipelines and/or mains. This instrument, however, does not grant
or convey unto TIGARD SANITARY DISTRICT any right or title to the sur-
face of the soil along the route of said pipelines and/or mains, except
for the purpose of location, construction and maintenance.
In addition to the permanent right and easement, hereinabove
granted, TIGARD SANITARY DISTRICT is granted a temporary right of
use during the initial location and construction of the sewer pipelines and
mains over and along a strip of land fifteen feet in width, lying contiguous
and to the north of the above-described and granted permanent easement.
