An unencumbered perpetual easement 10 feet in width for
the purpose of constructing, operating, maintaining and
repairing of an underground sewer line, together with
the present and future right to clear said right-of-way
and keep the same free of brush and trees which in any
wise interfere with the maintenance, operation and use
of said sewer line, provided that the grantors reserve
fully right to utilize the area granted for true
construction of buildings or other structures thereon
and thereover, so long as no footings for buildings or
structures are placed directly over or bear upon the
sewer line to be placed within the easement area, and
further provided that no improvement assessment shall
be levied against the property of the grantors in
connection with the said sewer line. Said easement area
being five (5) feet on each side, when measured at right
angles, of the following described centerline:

TRACT I: Leginning at a point on the southwesterly line
of that tract of land described in Iook 308, page 59

being 17 feet in a southeasterly direction (S57°40'E)
from the most westerly corner (in the center of Old
Fenno Creek) of said described property; thence N63°
021-' E, 156 feet, more or less, to a point; thence
':forth 89°53' E, 18 feet, more or less, to a point in
the center of Far.no Creek, being the true point of
beginning of the centerline hereby to be described;
thence continuing on a bearing of N 89°53' L, 120 feet,
more or less, across that tract of land described in

the southerly meander line of the property described in

2. Temporary Easement:
TACT II: Together with the temporary right of ingress,
egress and regress, and use for construction purposes,
of additional land lying parallel to, along both sides
and within 15 feet, when measured at right angles, of
TAACT I above described, excepting and reserving to
owners the unimpaired enjoyment, use and preservation
of all structures and fruit trees, if any.

temporary easement shall cease when said sewer work is
11618 completed, and not later than November 1, 1964, and shall there-
after be of no further force or effect.
Should it be necessary to cut and remove any brush, trees,
or other matter or materials .from the easement area, said brush,
trees, or other matter and materials shall be removed and disposed
of by the City and the City shall leave the easement area in a neat
and workmanlike condition.
The grantors, their heirs and assigns, shall have the right
to the reasonable use of said perpetual easement area for any and
all purposes which do not interfere with or adversely affect the
use thereof by the City for the purposes above described. The City
agrees that in connection with its use of the perpetual easement
area and its right to inspect, repair, maintain, or replace said
sewer line, the City will leave the premises in a neat and work-
manlike condition and as nearly in the pre-existing state as prac-
ticable.
The grantors do hereby warrant that they are owners in fee
simple and have the right to grant the above describe, easements.
