85-012458 ~ Summerlake Drive ~ Lily Circle • o/ Projec S 50 12458 Easement: Deed Reference: KNOW ALL MEN BY THESE PRESENTS: That we (I) AMERICAN GUARANTY LIFE INSURANCE COMPANY hereinafter termed grantor (s) , in consideration of the sum of $ 1.00 to be paid by CITY OF TIGARD, a municipal corporation of Oregiin, hereinafter termed the City, hereby grant, bargain, sell and convey unto the CITY OF TIGARD a perpetual right-of-way and easement as hereinafter described, to- gether with a temporary right-of-way and easement to use an additional area hereinafter described and designated temporary easement, for the following uses and purposes : 1. Perpetual easement: An unencumbered perpetual right-of-way and easement for the purpose of constructing, reconstructing, operating, maintaining, inspecting and repairing of an underground sewer line and appurtenances , together with the right to remove, as necessary, vegetation, foliage, trees and other obstructions within the easement area, but reserving to the grantors the title to the lands , subject to the easement, and the right to make such use thereof, except to construct buildings , as will not interfere with the uses and purposes of the easement; EXHIBIT A The following described strip of land being situated in the N.E. 1/4 and S.E. 1/4 of section 33 township 1 south, range 1 west W.M. city of Tigard, washington county, oregon. Beginning at a point on the center line of S.W. Summerlake Drive, 5-59° 15' 08"-E 25.00 feet from the S.E. corner of lot 33 of Amart Summer Lake; Thence: along the center line of a 50.00 foot wide strip of land being the proposed future extention of S.W. Summerlake Drive, being 25.00 on each side of said center line along the arc of a 322.16 foot radius curve having a central angle of 27° 10' 17" ( the chord of which bears N-17° 09' 44"-E 151 .35 ) the arc distance of 152.78feet being to the right of the chord; thence : N-03° 34' 35"- E 8.84 feet to the terminus of said 50.00 foot wide easement and the beginning of a 15.00 foot wide easement being 8.24 feet to the right and 6.76 feet to the left of a line bearing S- 82° 09' 46"-e 144.06 feet to the terminus of the easement. It shall be understood that the side lines of the easements shall extend or shorten to intersect the controling boundry. 2. Temporary easement: Together with the temporary right of ingress, egress and regress, and use for sewer construction purposes , of additional lands lying parallel to, along the sides and within et. feet, when measured at right angles , of the above described perpetual easement area, excepting and reserving to grantors the unencumbered enjoyment, use and preservation of all structures present upon the premises .
