C M P13 a j, 80002611 EASEMENT KNOW ALL MEN BY THESE PRESENTS , Thatwe, MICHAEL LYNN CAMPBELL and HELEN KAY CAMPBELL, husband and wife , hereinafter termed grantors , in consideration of $1 , 200 . 00 paid to the grantors by GODWIN CONSTRUCTION CO., INC. G. FERDINAND WARDIN, ROBERT WESTLUND , and WILLIAM A. GODWIN DEVELOPMENT CORPORATION , as tenants in common , owners of Tax Lot 6400 , tax map 2S 1 11AD, which abuts upon the west and south boundaries of grantors ' tract described as Tax Lot 5800, tax map 2S 1 11AD, all in Washington County , Oregon , do hereby grant , bargain, sell and convey unto the City of Tigard, Oregon the perpetual rights of way and easements as hereinafter described , together with temporary right of way and easement for the use of additional area hereafter designated "temporary easement" for the following uses and purposes : 1. Perpetual easement : An unencumbered perpetual right-of-way and easement for the purpose of constructing, reconstructing, operating, maintaining, inspecting and repairing of underground sanitary and storm sewer lines , manholes and other appurtenances , together with the right to remove, as necessary, vegetation , foliage , trees and other ob- structions within the easement area, but reserving to the grantors the title to the lands , subject to the easement , and the right to make such use thereof except to construct buildings , as will not interfere with the uses and purposes of the easement ; said ease- ment area being 7 1/2 feet on each side, when measured at right angles , of the following described center line within the following designated premises : Page 1 - EASEMENT A parcel of land located in the SE 1/4 of the NE 1/4 of Section 11, T2S, RlW, W.M. , Washington County , Oregon, described as follows : Beginning at the northwest corner of Lot 81 of the Plat of "Pinebrook Terrace" a duly recorded plat in Washington County, Oregon ; Thence N 89105 ' 57" E a distance of 14 . 69 feet to the point of beginning of this description: A strip of land 15 feet in width being seven and one-half feet on each side of the following described line ; Thence S 01033 ' 03" E a distance of 86 . 23 feet to a point ; Thence S 31050' 06" W a distance of 16. 31 feet to a point in the south line of the aforesaid Lot 81 of the Plat of "Pinebrook terrace" . 2 . Temporary Easement : Temporary right of ingress , egress and regress , and use for construction purposes , of additional lands of grantors to terminate upon completion of sewer construction work within the permanent ease- ment area., excepting and reserving to grantor the unencumbered enjoy- ment , use and preservation of all structures present upon the termpor- ary easement area(s ) . Strip of land 20 feet in width lying easterly of, along and within 20 feet, when measured at right angles, of the east line of the above- described perpetual easement area. Should it be necessary to cut and remove any brush, trees or other matter or materials from the permanent easement area, said brush , trees or other matter and materials shall be removed and disposed of and the premises should be left in a neat and workmanlike condition. In con- nection with the use of the perpetual easement areas , and in inspecting, repairing, maintaining, or replacing said sewer line , the City of Tigard agrees to leave the premises in a neat and workmanlike condition and as nearly in the pre-existing state as practicable . All sewer lines constructed within the permanent easement areas shall meet the applicable standards and requirements of the Unified Sewerage Agency, the City of Tigard and State of Oregon. Grantors do hereby warrant that they are the owners in fee simple of all lands involved in the above-described easements . o2— Page 2 - Easement and had a good , legal right to grant the easements herein de- scribed. The foregoing easement is granted subject to restoration of westerly bank of property following installation of sewer line': if required to remove barrier of berry bushes- all bushes adjoining property to be removed, and the bank to be replanted with ivy cover and suitable plants to establish a bulky cover (i .e . Photinia or equivalent) . Restoration to take place immediately after work has been done to prevent any erosion or possible danger to tenants liv- ing at 8570 and 8572 S .W. Pinebrook, Tigard,, Oregon. Any damage to lawn will also be repaired immediately . Contractor shall install a "T" or "Y" (whichever is more suitable) with a riser for future hook-up of possible third unit to existing duplex ( location to be noted) .
