Fanno Creek Associates, an Oregon general partnership
hereinafter called the Grantors, grant and convey unto the City of Tigard a perpetual easement fo� constructing,
reconstructing,operating,maintaining,inspecting,and repairing of an underground sewer line and appurtenances,together
with the right to remove, as necessary, vegetation, foliage, trees, and other obstructions on the parcel of land described
in Exhibit "A" situated in the City of Tigard, Washington County, State of Oregon.
THE TRUE CONSIDERATION for this conveyance is $0,00 . However,the actual consideration consists of or includes
other property or value given or promised which is the whole consideration.
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right,title, or interest except those expressly
stated in this easement,nor otherwise prevent Grantors from the full use and dominion thereover; provided,however,that
such use shall not interfere with the uses and purposes of the intent of the easement.
IN CONSIDERATION of the premises, Grantee agrees that if said Grantee, its successors or assigns should cause said
easement to be vacated, the rights of the Grantee in the above-described easement will be forfeited and shall immediately
revert to the Grantors, their successors and assigns in the case of such event.
TO HAVE AND TO HOLD the above-described and granted premises unto said Grantee, its successors, and assigns
forever.

January 23, 1995
Two parcels of land, in the northeast one-quarter of Section 2, 72S., R.1W., W.M., City of
Tigard, Washington County, Oregon, said parcels being more particularly described as
follows:
Parcel 1:
Commencing at the most westerly corner of Lot 9 of the Plat of"Burnham Tract", a duly
recorded plat in Washington County; thence N.49°16'05"E. along the northerly line of
said Lot 9, 143.90 feet; thence leaving said northerly line, N.44°0751"W. along the
easterly line and southerly extension of the easterly line of that parcel described in Deed
Book 138, Page 556 as recorded in the Washington County Deed Records, 557.34 feet to
the Point of Beginning of a strip of land, 15,00 feet in width, lying 7.50 feet on each
side of the following described centerline; thence tracing the centerline of said strip the
following courses and distance, N.66°14'39"E., 6.05 feet; thence S.83°08'49"E., 18.00 feet;
thence N.71°57'31"E., 290.84 feet; thence N.73°44'05"E., 190.65 feet to the Terminus of
the herein described strip.
Parcel 2:
Commencing at the most northerly corner of Lot 9 of said plat of"Burnham Tract";
thence West 49.82 feet; thence North 2.96 feet to an angle point on the westerly line of
that parcel described in Document Number 93-99583 as recorded November 30, 1993 in
the Washington County Deed Records and the Point of Beginning of the herein
described parcel; thence northerly tracing said westerly line the following courses and
distances N.01°26'51" W., 12.01; thence N.44°21'06" W., 100.00 feet; thence leaving said
westerly line, S.40°03'12"E., 109.10 feet to the Point of Beginning.
