Hall Blvd. Tigard, Oregon 97223 NO CHANGE IN TAX STATEMENT --------------------------------------------------------------- EASEMENT Sanitary Sewer KNEZ REALTY GROUP, LLC, hereinafter called the Grantor, grant unto the City of Tigard, hereinafter called Grantee, excepting all existing rights and matters of record, a nonexclusive, perpetual easement for constructing, reconstructing, operating, maintaining, inspecting, and repairing of an underground sewer line and appurtenances, together with the right to remove, as necessary, vegetation, foliage, trees, and other obstructions on the parcel of land described in the attached Exhibit "All situated in the City of Tigard, Washington County, State of Oregon; provided, however, Grantee' s removal of any obstruction which is a structure or improvement owned by Grantor shall be replaced to its original condition by Grantee at Grantee' s sole expense . THE TRUE CONSIDERATION for this conveyance is $ 0 . 00 . However, the actual consideration consists of or includes other property or value given or promised which is the whole consideration. IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right, title, or interest except those expressly stated in this easement, nor otherwise prevent Grantors from the full use and dominion thereover, including, but not limited to paving; provided, however, that such use shall not interfere with the uses and purposes of the intent of the easement . GRANTOR RESERVES THE RIGHT to relocate the underground sewer line and/or appurtenances at any time, at its expense, provided that such relocation does not interfere with the uses and purposes of the intent of the easement . If the underground sewer line and/or appurtenances are relocated, Grantor must follow applicable city of Tigard permitting procedures . Grantor and Grantee shall record an instrument indicating the new location, but otherwise providing for the same rights and obligations of Grantor and Page 1 - EASEMENT 1 -- 4 Grantee as those set forth herein. Such instrument shall serve to amend this easement and eliminate any rights of Grantee in this original easement . GRANTEE SHALL BE RESPONSIBLE for all costs related to operation, maintenance, inspection and repair of the underground sewer line and appurtenances . GRANTEE COVENANTS TO indemnify and hold harmless Grantor from any and all claims, demands, causes of action, suite, judgments, which may be brought, arise or come against Grantor by reason of Grantee' s construction, reconstruction, operation, maintenance, inspection or repair of the underground sewer line and/or appurtenances. IN CONSIDERATION for the premises, Grantee agrees that if said Grantee, its successors or assigns should cause said easement to be vacated, the rights of Grantee in the above-described easement will be forfeited and shall immediately revert to the Grantors, their successors and assigns in the case of such event . THE PROVISIONS HEREOF shall inure to the benefit of and be binding upon the heirs, executors, administrators, successors, and assigns of the Grantor and the assigns and successor in interest of the Grantee.
