PERMANENT DRAINAGE AND STORM SEWER EASEMENT
AND
TEMPORARY CONSTRUCTION EASEMENT
See-Zer PLUerties. a partnership, hereinafter called the Grantor,grants and conveys unto the City of Tigard, Grantee, its
successors and assigns, a perpetual easement for constructing, reconstructing, operating, maintaining, inspecting, and
repairing of an underground storm drainage line and appurtenances, and above ground drainage swale, together with the
right to remove, as necessary, vegetation, foliage, trees, and other obstructions on the parcel of land described in Exhibit
"A",situated in the City of Tigard,Washington County,State of Oregon.
Also, Grantor grants and conveys unto the City of Tigard, Grantee, its successors and assigns, a Temporary Easement for a
work area for construction purposes,over and across the property delineated on the attached plan,designated as Exhibit "B"
hereto and by this reference made a part hereof.
IT IS UNDERSTOOD that the temporary easement rights herein granted shall terminat year from the date hereof
or upon completion of the above-mentioned construction project,whichever is sooAeery,�-
THE TRUE CONSIDERATION for this conveyance is$ cc)
IT IS EXPRESSLY UNDERSTOOD that these easements do not convey any right, title, or interest except those expressly
stated in these easements, nor otherwise prevent Grantor from the full use and dominion thereover; provided, however, that
such use shall not interfere with the uses and purposes of the intent of the easements.
IN CONSIDERATION of the premises, Grantee agrees that if said Grantee, its successors or assigns should cause said
permanent easement to be vacated, the right of the Grantee in the above-described permanent easement will be forfeited and
shall immediately revert to the Grantors,their successors,and assigns in the case of such event.
TO HAVE AND TO HOLD the above-described and granted premises unto said Grantee, its successors, and assigns
forever.

A parcel of land lying in the NW% of Section 2, Township 2 South, Range 1
West, W.M., Washington County, Oregon and being a portion of that property described
in that deed to Dennis W. Balzer, Victor M. Seeber and Douglas M. Seeber, dba
SEE-ZER Properties, a partnership, recorded January 4, 1978 as Microfilm Document
No. 78-205 of Washington County Book of Records; the said parcel being that portion
of said property lying between lines at right angles to the center line of Grant Avenue at
Engineer's Stations 1+225 and 1+274 and included in a strip of land variable in width,
lying on the Northwesterly side of said center line, which center line is described as
follows:
Beginning at Engineers's center line Station 1+000, said station being South
381.444 meters and East 517.329 meters from the Northwest corner of Section 2,
Township 2 South, Range 1 West, W.M.; thence North 42012'17" East 105.006 meters;
thence North 3502917" East 230.380 meters to Engineer's center line Station

The widths in meters of the strip of land above referred to are as follows:
