7871 ~ Grant Avenue e EASEMENT KNOW ALL MEN BY THESE PRESENTS, That M. H. STEEL and LOIS V. STEEL, husband and wife, and KENNETH R. BEEBE and JACQUELINE R. BEEBE, husband and wife, Grantors, in consideration of the sum of One and no/100 ($1.00) Dollars and other consideration, the receipt of which is hereby acknowledged, do bargain, sell, convey, transfer and deliver unto TIGARD SANITARY DISTRICT, a municipal corporation, a perpetual easement and right of way for the purposes hereinafter stated, within the following described portions of grantors ' premises : A strip of land eight (8) feet wide Southwesterly of along and within eight (8) feet of the Northeasterly boundary of the grantors ' lands,said boundary line being described as follows: Beginning at a point North 39* 50' East 74.94 feet from the most Westerly corner of Lot 34, NORTH TIGART)VILLE ADDITION, a duly recorded subdivision in Washington County, Oregon, in Section 2, Township 2 South I Range 1 West , Willamette Meridian; thence South 50* 47 East 118.33 feet to a point on the North line of those cer- tain lands conveyed to John R. Baldwin as described in Book 376 at page 447, Washington County Deed Records. Included in the rights hereby granted to the TIGARD SANITARY DISTRICT is the right to enter upon the eight-foot wide strip of land hereinabove described, and no other lands of the Grantors, for the purpose of ingress, egress and regress on, over and across the same in connection with or as necessary to the construction, re- construction, maintenance and repair of an underground sewer line located on the property of Ben H. Davis and Anna 0. Davis which adjoins the above described strip along the Northeasterly boundary thereof; provided, that the TIGARD SANITARY DISTRICT shall place no portion of said sewer line and no permanent improvement upon the Grantors' lands and shall preserve and protect an existing tree near the northerlymost corner of Grantors ' lands, and shall restore the surface of Grantors ' lands in each and every instance of use thereof to its pre-existing condition as nearly as possible to do, and shall further repair any damage or destruction on Grantors ' lands occurring with respect to each and every use thereof. As and for additional consideration for the rights herein granted, by accepting this deed of easement, TIGARD SANITARY DISTRICT agrees that the Grantors shall be entitled to one free sewer service connection to the District sewer system within the granted area or adjacent to Grantors ' property, but otherwise subject to the rules and regulations of the said District. .—(SEAL) (SEAL) --(SEAL) Parc I(4 'low ?'7 STATE OF OREGON ss.
