KNOW ALL MEN BY THESE PRESENTS, That EDWARD A.
WOODARD and VERONICA T. WOODARD, husband and wife, in con-
sideration of the sum of One and no/100 Dollars ($1. 00) and other con-
siderations, the receipt of which is hereby acknowledged, do bargain,
sell, convey, transfer and deliver unto the TIGARD SANITARY DISTRICT,
a municipal corporation, a permanent easement and right of way under
and along the following described property, to-wit:
Northerly 10' of Lot 5 of AMENDED PLAT OF NORTH
TIGARDVILLE ADDITION, more particularly described
as:
Beginning at the most northerly corner of Lot 5, AMENDED
PLAT OF NORTH TIGARDVILLE ADDITION in Section
2, TZS, RIW, W.M. and running thence S. 390 531 W. along
the westerly line of said Lot 5 a distance of 10. 09 feet;
thence S. 570 541 E. , parallel with and 10. 0 feet distant
southerly from the northerly line of said Lot 5, a distance
of 197. 34 feet to a point on the easterly line thereof; thence
N. 390 531 E. 10. 09 feet to the most easterly corner of
said Lot 5; thence N. 570 541 W. 197. 34 feet to the place
of beginning.
THIS EASEMENT grants unto the TIGARD SANITARY DISTRICT
the perpetual right to enter upon the hereinabove described real property
at any time that it may see fit and construct, maintain, and repair under-
ground pipelines and/or mains for the purpose of conveying sewage over,
across, through and under said property, together with the right to excavate
and refill ditches and/or trenches for the location of said pipelines and/or
mains and the further right to remove trees, bushes, undergrowth and other
obstructions interfering with the location, construction and maintenance of
said pipelines and/or mains. This instrument, however, does not grant
or convey unto TIGARD SANITARY DISTRICT any right or title to the sur-
face of the soil along the route of said pipelines and/or mains, except
for the purpose of location, construction and maintenance.
In addition to the permanent right and easement, hereinabove
granted, TIGARD SANITARY DISTRICT is granted a temporary right of
use during the initial location and construction of the sewer pipelines and
mains over and along a strip of land fifteen feet in width, lying contiguous
and to the north of the above-described and granted permanent easement.
