7875 ~ Grant Avenue 3 NOW EASEMENT KNOW ALL MEN BY THESE PRESENTS, That C.H. STEARNS and IRENE STEARNS, husband and wife, in consideration of the sum of One and no/100 Dollars ($1. 00) and other considerations, the receipt of which is hereby acknowledged, do bargain, sell, convey, transfer and deliver unto TIGARD SANITARY DISTRICT, a municipal corporation, a permanent ease- ment and right of way under and along the following described property, to- wit: Tax Lot 10c - Northerly 101 of, more par- ticularly described as: Beginning at the most easterly corner of that certain tract of land in Lot 34, NORTH TIGARD- VILLE ADDITION in Section 2, TZS, RlW, W.M. , conveyed to Charles H. Stearns and Irene Stearns by deed recorded on page 467 in Book 24.1, Washington County, Oregon, Deed Records, which beginning point bears S. 450 W. 175.0 feet from the most easterly corner of said Lot 34. Running thence N. 450 W. 73. 0 feet to the most northerly corner of the said Stearns tract; thence S. 450 W. 10. 0 feet; thence S. 450 E. 73.0 feet to the south- easterly line of said Lot 34; thence N. 450 E. 10. 0 feet to the place of beginning. THIS EASEMENT grants unto the TIGARD SANITARY DISTRICT the perpetual right to enter upon the hereinabove described real property at any time that it may see fit and construct, maintain, and repair under- ground pipelines and/or mains for the purpose of conveying sewage over- across, through and under said property, together with the right to excavate and refill ditches and/or trenches for the location of said pipelines and/or mains and the further right to remove trees, bushes, undergrowth and other obstructions interfering with the location, construction and maintenance of said pipelines and/or mains. This instrument, however, does not grant or convey unto TIGARD SANITARY DISTRICT any right or title to the sur- face of the soil along the route of said pipelines and/or mains, except for the purpose of location, construction and maintenance. In addition to the permanent right and easement, hereinabove granted, TIGARD SANITARY DISTRICT is granted a temporary right of use during the initial location and construction of the sewer pipelines and mains over and along a strip of land fifteen feet in width, lying contiguous and to the north of the above-described and granted permanent easement.
