KNOW ALL MEN BY THESE PRESENTS, That SCHOOL
DISTRICT NO. 23, Washington County, Oregon, in consideration of the
sum of $500.00, and other considerations, the receipt of which is hereby
acknowledged, does bargain, sell, convey, transfer and deliver unto
TIGARD SANITARY DISTRICT, a municipal corporation, a permanent
easement and right-of-way under and along the following described property,
to-wit:
A 15 foot strip, being 7 1/2 feet on each
side of a center line which is described
as follows:
Beginning at an iron pipe which bears
north 390 53' East 396. 5 feet and south
540 151 East 392 feet from the stone at
the quarter corner between Sections 2
and 3, Township 2, South Range I West,
W.M. , Washington County, Oregon; and
going thence from said iron pipe and the
true point of beginning on the center line
of Grant Street as vacated, north 390 53'
East 472. 7 feet to and terminating at a
point which is also the most easterly
corner of that tract of land conveyed to
School District No. 23 by John Carstensen
and Mary Carstensen, his wife.
THIS Easement grants unto the TIGARD SANITARY DISTRICT
the perpetual right to enter upon the hereinabove described real property at
any time that it may see fit and construct, maintain and repair underground
pipelines and/or mains for the purpose of conveying sewage over, across,
through and under said property, together with the right to excavate and re-
fill ditches and/or trenches for the location of said pipelines and/or mains,

and the further right to remove trees, bushes, undergrowth and other
obstructions interfering with the location, construction and maintenance
of said pipelines and/or mains. This instrument, however, does not
grant to or convey unto TIGARD SANITARY DISTRICT any right or title
to the surface of the soil along the route of said pipelines and/or mains,
except for the purpose of locating, constructing and maintaining.
In addition to the permanent right and easement hereinabove
granted, TIGARD SANITARY DISTRICT is granted a temporary right of
use during the initial location and construction of the sewer pipelines and
mains over and along a strip of land 15 feet in width lying contiguous to the
above-described and granted permanent easement.
The TIGARD SANITARY DISTRICT recognizes that the easement
herewith granted crosses the school property of School District No. 23; that
in the use of the easement for the purposes granted, TIGARD SANITARY
DISTRICT must fully recognize and have due regard to the rights of school
children and others using the surface area of the granted easement; thus,
TIGARD SANITARY DISTRICT, by acceptance of this easement, agrees
that it will properly barricade all open ditches, compact ditch areas on
backfilling and level all settling thereafter resulting within the area of the
easement and attributable to the system of the TIGARD SANITARY DISTRICT
and its use of the easement area for the purposes herein granted.
IN WITNESS WHEREOF, this Easement has been executed and
acknowledged pursuant to appropriate resolution of the School Board.
