operating,maintaining, inspecting, and repairing of an underground sewer line and appurtenances,
together with the right to remove, as necessary,vegetation, foliage,trees, and other obstructions on the
parcel of land situated in the City of Tigard,Washington County, State of Oregon, described as:
A 15.00 foot wide sanitary sewer maintenance easement across said Tax Lots 4300, 4500,
4600,4700 and 4800, described specifically as: beginning at a point at the center of City
manhole 74-A, said manhole located in Burnham street approximately 144 feet southeast
of the intersection of said Burnham Street and SW Main Street and said point of beginning
lying N89°47'07"W—29.41' from the northwest corner of that tract conveyed from
Charlotte Shrier and F.J. Shrier to Edward McDaid and Margaret McDaid on February 6,
1952;thence N4502710011W—7.56';thence N51°40'21"E—202.24'; thence S38019'39" E
15.00;thence S51°40'21"W—200.36;thence N45°27'00"W—7.56 to the point of
beginning,excepting that portion within the right-of-way of Burnham Street.
THE TRUE CONSIDERATION for this conveyance is$0.00. However,the actual consideration
consists of or includes other property or value given or promised which is the whole consideration.
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right,title, or interest
except those expressly stated in this easement,nor otherwise prevent Grantors from the full use and
dominion thereover;provided,however,that such use shall not interfere with the uses and purposes of
the intent of the easement.
IN CONSIDERATION of the premises, Grantee agrees that if said Grantee, its successors or assigns
should cause said easement to be vacated,the rights of the Grantee in the above-described easement will
be forfeited and shall immediately revert to the Grantors,their successors and assigns in the case of such
event.
TO HAVE AND TO HOLD the above-described and granted premises unto said Grantee, its successors,
and assigns forever.
