SEWER EASEMENT
KNOW ALL MEN BY THESE PRESENTS that for and in consideration of the
payment of the undersigned JOHN WEBER and M&RY WEBER, of the sum of One
Dollar ($1.00) and other good and valuable consideration, receipt of which
is hereby acknowledged, the undersigned do hereby grant, bargain, sell and
convey to TIGARD SANITARY DISTRICT, an Oregon corporation, a utility ease-
ment for the purpose of constructing, maintaining and operating a sanitary
sewer or sewers on the following described real property situated in
Washington County, Oregon, to-wit:
A strip of land five (5) feet in width running and interior to
the Easterly boundary of a duly recorded tract of land described
as follows: Beginning at a point in the center of County Road
No. 997, said point being North 450 46, West 809.84 feet from the
most Easterly corner of that certain tract of land conveyed to
Charles Burnhamby deed record book, Washington County, Oregon,,
u.
W., Page 162; running thence North 420 191 East a distance of
399 feet to the Westerly line of the right of way of the Oregon
Electric Railroad Company; thence North 420 371 West along said
Oregon Electric Railroad right-of-way a distance of 108.80 feet;
thence South 420 191 West a distance of 405.00 feet to the Center
of County Road No. 997; thence South 450 461 East along the center
of said County Road a distance of 108.40 feet to the point of
beginning. Subject to the rights of the public in and to that
portion thereof contained within the boundaries of said County
Road; thus describing a tract of land per Volume 348, Page 323,
Washington County, Oregon deed records.
TO HAVE AND TO HOLD the above described easement unto the said grantee,
its successors and assigns forever; provided further, in addition to said
easement, that the 'grantee, its successors and assigns, shall have the right
to cut., remove., or trim any trees or other growth which may interfere with or
menace the construction, maintenance or operation of said sewer, and provided
further that no building may be erected upon said easement hereby granted.
