Dear Pastor Smith:
This is sent to inform you of action taken by the City Council
in regard to your tentative request for vacation of a public sewer
easement crossinf_?- T.L. #lC-00 (2ED) ; said easement being duly
recorded in Book 401 on Page C48 in Washington County, Ore5,.on.
First , the Council has indicated a willingness to vacate said
easement provided that an alternate storm water drainage facility
is developed, through or around the site , reyi1acing, the existinf3
system which presently utilizes the easement it question.
Secondly, formal petition for vacation of a public easement
must be submitted to the City Recorder (Doris Fartig) along

a legal description and may., of the area proposed to be vacated and ,
also, along with a, ;)100.deposit to offset the cost of public
notices, hearings, etc. which must occur to affect such vacation.
Any unused portion of the denosit will be refunded unon completion
of the proposed action .
Further, I Ini transmitting ocopies of a legal description, rar and
'blank' petition (form) which should be of help to you in Tnahin�--
' formal application' . A preliminary proposal prepared by a
civil engineer for the alternate drainage facility should- in-
eluded therewith.

Tigard Sanitary District for the construction of a sanitary sewer
line across the northern portion of Tax Lot 1600 2 S. 1 2 BD.
This easement was dated October 31, 1957 and recorded January 29,
1958 in book 401 page 648, Deed Records of Washington Co. Oregon.
The above easement was never used, and subsequently easements
following the northeasterly boundary and northerly boundary were
granted to the city and a sewer line was constructed on this
easement, thus eliminating the necessity of the easement given to
the Sanitary District.
There is now the possibility of developing this property and we
respectfully request that the City abandon the above mentioned
unused easement. We attach a copy of said easement.
