1120 ~ Walnut Place KNOW ALL MEN BY THESE PRESENTS, That we, ARTHUR J. FOULIN
and ESTIT-iER L. POULIN, husband and wife, Grantors, for and in con-
sideration of the sum of One Dollar paid by the CITY OF TIGARD. a
municipal corporation of the State of Oregon, Grantee, and the
benefits to accrue to us hereunder, do hereby grant, bargain, sell
to grantee
and convey/a perpetual right of way and easement, subject to the
terms and provisions hereof, on, over and across the following
described lands in the City of Tigard, County of Washington and
State of Oregon:
A strip of land five (5) feet wide, northwesterly of,
along and within five (5) feet of the Southeasterly
line of Lots B and A within the subdivision of Lots 2
and 3, FREiJING ORCHARD TRACTS, Washington County,-
Oregon, and along and within five (5) feet of the South-
easterly boundary of a 10-foot stri of land adjacent to
the Northeasterly line of said Lot K. being bounded by a
Northeasterly extension of the Southeasterly line of
said Lot t and the Southeasterly line of Pacific Highway
West, and being a portion of Lot 1 FRE'vGING ORCHARD TRACTS
and extending from the most southerly corner of Lot B at
the Northeasterly boundary of S. "J. `Walnut Place, north-
easterly to a point 10 feet Northeasterly of the South-
easterly corner of said Lot A.
The easement hereby granted shall include the right to enter
upon the above herein described real premises for the purpose of
constructing, reconstructing, repairing and maintaining an under-
ground pipeline or main for the purpose of conveying sewage, to-
gether with the right to excavate trenches and refill the same
and to remove trees, bushes, undergrowth and other obstructions
within the easement area as necessary for the location, construc-
tion and maintenance of said pipeline, together with the temporary
right during construction period to utilize that certain portion
of the Grantors ' lands lying Northwesterly of and within rive (5)
feet of the easement area above described.
The City of Tigard, by accepting this easement , agrees to
refill all trenches excavated and to replace the surface condition
to that pre-existing prior to the exercise of the rights hereunder.
