Tigard Water District is holder of an easement across real
property located in what was Tax Lot 2100, Assessor' s Map 2S 1 5,
Washington County, Oregon, more particularly described in the easement
as follows:
An easement created by instrument dated November 6, 1992, recorded
November 18, 1992, Recorders Fee No. 92-82635, for the purpose of allowing
road ingress and egress, installation, maintenance and repair of public
utilities, over, through, under and along a 25.00 foot wide strip of land
to Tax Lot 400, Assessor's Map 2s 1 5DB.
In consideration of the release of easement by Tigard Water District,
Titan Properties and Stone & Co. , Inc. , the owners of the property subject
to the easements terminated by this Quitclaim Deed, agree that Tigard Water
District shall have no obligation to remove abandoned water pipes, mains,
and accessories thereto within such terminated easement areas, and it is an
express condition to termination that said owners, their heirs, and assigns
shallhold harmless and indemnify Tigard Water District from any and all
claims arising out of the presence of any such abandoned water line facilities
within the terminated easement area.
The termination and extinguishment of the above described easement
by this instrument is subject to the condition that grantee of this
instrument provide to grantor the alter4ate roadway and utility easements
described in the Bull Mountain Meadows No. 2 Plat dated August 4, 1993, and
recorded August 4, 1993, as Recorder' s Fee No. 93063211, PlAt Book 87, Pages
7 & 8, Washington County Records.

f KNOW ALL PERSONS BY THESE PREVNTS, that Titan Properties Corporation aad`"eone i Co., Inc., herein after called the
Grantorts), being lawfully seized in fee simple of the following described premises, for the consideration hereinafter stated
to the Grantors, paid by Tigard Fater District do hereby grant to the public a perpetual easement for access, installation,
maintenance and repair of public utilities, over, through, under and along a 25.00 wide strip of land situated in the County
of Washington and State of Oregon, shown on the attached Exhibit 'A' and being more particularly described on the attached
Exhibit 'B•.
To Have and To Hold, the above described easement unto the said Tigard Fater District for right of way, access, installation,
maintenance and operation of the public utilities therein.
This easement shall be perpetual, except that at such tine as the easement area is irrevocably and unconditionally dedicated
to the public for roadway and utility purposes, the easement granted hereby will be extinguished, except as to that portion
between the subdivision lots shown on the attached plat map (Exhibit 1) at the point of beginning of the easement described
herein (Exhibit 8). That portion of the easement area will be dedicated on the final plat as a tract to the public, but
subject to the continuing perpetual right of Tigard Water District and its assigns to use same for right-of-way, roadway,
waterline, and utility purposes for the benefit of Tigard Water District premises known as Tax Lot 400, Assessor's clap 2S1
5DR, and described in that deed recorded 3 July , 1989, Recorder's Fee No. 89030157
The Grantor and/or their assigns retain the right to install, erect, construct and maintain landscaping, signs and parking
facilities over and upon the surface of the hereinabove described utility easement, provided that it does not materially
interfere with the purpose of the same.
The true and actual consideration paid for this easement, stated in terms of dollars, is 3Q_QQ. However, the actual
consideration consists of other value given which is the whole consideration.
The Grantors hereby warrant that they are the owners in fee simple of the above described premises and have the right to
grant the above easements.
To Have and To Hold, the above described and granted premises for the purposes bereinbefore set forth unto the public
