Also requested is a Variance approval to the building height requirement in the C-P zone which is normally 45 feet and approval of a Lot Line Adjustment to adjust two parcels measuring 30,056 and 110,642 square feet into two parcels of 23,868 and 116,830 square feet. This request also proposes to change the alignment of SW 93rd Avenue (SW Lincoln Street). Finally, the applicant has requested Variance approvals to reduce the parking Apace width from 9 to 8 feet wide and to allow up to 45 percent of all parking spaces to be designated as compact spaces. Locations 10200 SW Greenburg Road (WCTM 1S1 35AB lots 1002, 1004, 900, 500, 501, 600, 700, 701, 702 and portions of lot 2800 and 2901) . DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above requests subject to certain conditions. The findings and conclusions on which the decision was based are noted below. A. FINDING OF FACT 1. Background The subject properties were annexed to the City of Tigard in late April, 1987. Prior to the annexation, two land use applications (Comprehensive Plan Amendment, Special Use Permit) were filed with Washington County. Also, it was agreed at that time between the City and Count,r that all applications in process at the County would continue even if the final decision occurred after annexation. A Comprehensive Plan Amendment and Zone Change (Case No. 87-73-M) to change the land use designation from R-5 (Residential, 5 units/acre) and Institutional to O-C (Office Commercial) on parcels located immediately north of Oak Street and west of Lincoln Street extension was approved by the Board of Commissioners on May 19, 1987. A Special Use Permit for a pa king lot (Case No. 87-122-SU) was granted by the Country on May 13, 1987, for four residentially zoned parcels located at the southwest corner of. Locust Street and 93rd Avenue. The residences on these properties were removad and a parking area was developed. The conditions of approval imposed by the county remain in effect. Also, since this property has been annexed and the City does no allow commercial parking lots in residential zones, this portion of the Lincoln Center parking lot .is a nonconforming use. On May 18, 1987, the Tigard City Council approved the rezoning of the NOTICE OF DECISION - TRAMMEL CROW CO (SDA 89-12/V 89-17/M 89-11) PAGE 1 annexed area in Metzger. from Washington County designations to City designations which most closely resemble the County zones. This ordinance (No. 87-22) became effective on June 18, 1987. Subsequent reviews utilized the City Community Development Code rather than the County regulations. A Site Development Review (SDR 87-08 and V 87-07) was conducted by City staff in June, 1987 for an approval to construct a 12-story office building. It was approved subject to 16 conditions. In June of 1988, the Hearings Offic�;r for the City of Tigard approved a Conditional Use permit request to allow the construction of a rooftop heliport atop the newly constructed Lincoln Tower office building. phis application was approved subject to 13 conditions. In Marcie, 1939, the Director's designee approved with conditions a request for several lot line adjustments and a minor land partition creating a new parcel at the southwestern corner of the Lincoln Center property (M 89-06/MLP89-05). In May, 1989, the Planning Commission voted unanimously to recommend approval of a Comprehensive Plan Amendment and Zone Change request (CPA 89-05/ZC 89-05) affecting the Lincoln Center property (tax lot 900 and a portion of tax lot 1002) ,and six residential properties to the east. A recommendation to the City Council was forwarded with the suggestion that a deed restriction be placed on the property to restrict the use on the residentially zoned land to a parking facilities use. Also approved was an amendment to the Metzger-Progress Community Plan to allow for the re-alignment of SW 93rd i,• enur These requests were approved by the City Council on May 15th and final crder is expected to be signed on June 12, 1989 . In thq applicant's submittal two separate site plans were provided so as to :afford the applicant a timely submittal, in the case that the compreheoB ive plan amendment and zone change was not approved. As a result of .its passage by the Council_, staff will only review that site and associated plans which correspond with the recent amendments. 2. Vicinity Information Properties immediately to the west and south are also part of the Lincoln Center comple.c and are likewise zoned and developed as C-P (Commercial Professional) . Properties immediately to the north are zoned and developed C-P and R-12 (Multi-family Residential, 12 units per acre) . The Metzger School in located immediately to the east and is zoned R-4.5 (Single Family Residential, 4.5 units per acre) . The Metzger-Progress Community Plan designates the school property as "Inst.itutional". Properties north of SW Locust Street and east of SW 93rd Avenue are in unincorporated Wanhington County. Site Information and Proposal The Lincoln Center property is presently developed with four office buildings with a gross floor area of approximately 530,000 equ re feet and two parking structures on a total of seven parcels. The office building is proposed to be constructed on two tax lots: tax lot 900 lies at the northeastern corner of the property. Immediately north and west of it is tax lot 1002 which measures 2.91 acres and now contains the Lincoln Center III building. The applicant proposes to construct a 120,750 square foot, seven-story office building on tax lot 1002, just north of the Lincoln Center III building. A two-level parking structure is intended to be built on 1.37 ac.•es of land immediately to the east of SW 93rd Avenue (SW Lincoln Street) which currently contains six single family residential homes. Approximately 520 parking spaces will be provided by the new parking structure; approximately another 224 will be available on the ground. In addition, the applicant is requesting a Variance approval to exceed the maximum building height standard in the C-P zone of 45 feet. The new seven story buil.ding, if constructed, would be 92 feet 6 inches to the roof line. Another Variance proposal requests permission to decrease the parking space width from 9 to 6 feet and to allow up to 45 percent of all parking spaces to be designated as compact spaces. Finally, the applicant proposes a lot line adjustment between the Lincoln Center and the Metzger School property just south of sW Mapleleaf which is necessary to accommodate the realignment of SW 93rd Avenue. Portions of tax lot 2800 and 2901 will be shifted to the west side of the proposed, realigned SW 93rd Avenue. The two affected parcels, measuring 30,056 (school district) and 110,642 (Trammel Crow) square feet each are proposed to be adjusted to 23,858 (school. district) and 116,830 (Trammel Ccow) square feet. 4. Agency and NPO Comments The Metzger Water District, Portland General Electric, the State Highway Division, and the Consolidated Fire District have all revie.✓ed the proposal and have no objections to it. Neighborhood Planning Organization ►8 has reviewed the proposal and comments that it has concerns as to flooding of homes due to concent.raten (storm water) drainage into Ash Creek and Ash Brook. The City Building Division has reviewed the proposal and has the following comments: a. A condition of approval should require that no construction be allowed to take place between the hours of 9:00 p.m. and 7:00 a.m. NOTICE OF DECISION - TRAMMEL CROW CO (SDR 89-12/V 89-17/M B9-11) PAGE 3 b. It should be required that all construction materials be stored on-site. U. It should be required that off-street parking be provided for all construction-related vehicles and trailers. d. Flagmen should be provided when construction vehicles are blocking public streets. The City Engineering Division has reviewed the proposal and has the following comr.ents: a. Access to the site will be from SW Locust Street, SW 93rd Avenue and SW Mapleleaf Drive. The submitted site plan for Lincoln Center V shows four accesses onto Locust Streot, plus the 93rd Avenue intersection and the Mapleleaf Drive intersection to Locust Street. Two accesses are proposed onto the relocated SW 93rd Avenue And one access is proposed onto the extended Mapleleaf Drive. Locust Street is a major collector street and will be improved in 1989 as a result of previous developments and the Tigare Major. Street Bond Projects. Its intersection with SW Greenburg Road is currently unsignalized. The construction plane are currently being designed for the Locust Street improvements. The applicant should cooruii,cte the design of the two projects so that construction vaii occur without duplication of effort. The applicant proposes to vacate the existing right-of-way of SW 93rd Avenue between SW Locust and SW Mapleleaf Street and relocate it to SW 92nd Avenue at Locust Street. SW 93rd Avenue is designated as a minor collector street from SW Oak Street to SW Locust Street. The realigned right-of-way should be provided by the applicant prior to the vacation of the existing right-of-way. SW 92nd Avenue at SW Locust Street has a 50 foot wide right-of-way. Minor collector streets require a 60- foot wide right-of-way and a 40 foot paved width plus sidewalks, streetlights, and associated underground utilities. Additional right-of-way will need to be dedicated along the SW existing 92nd Avenue to create the 60 foot wide right-of-way required for a minor collector street. Since SW 93rd Avenue fill only intersect SW Locust Street, it is our opinion that most of the traffic coming to and from the site will utilize SW Locust Street and only a minor portion will utilize the SW Mapleleaf Drive access off of SW Greenburg Road. Half-street improvements are typically required for developments such an this on adjacent st•-eets. Since SW 93rd Avenue is currently unimproved and proposed to be realigned, 2/3 street improvements should be constructed as a minimum to provide for two-way traffic. Right-of-way does not currently exist for SW N(YPICR OF DECISION - TRAMMEL. CROW CO (SDR 89-12/V 89-17/M 89-11) PAGE 4 93rd Avenue from Oak Street north approximately 280 feet. This area is currently occupied by a private residence. The applicant has requested that he be able to form a Local Improvement District to improve SW 93rd Avenue to full width from SW Oak to SW Locust Street. The district would include properties which would benefit from the SW 93rd Avenue li.nk between SW Oak and SW Locust Streets. We are not opposed to this request provided the appl'cant in required to make the two-thirds improvements if the Local Improvement District could not be formed prior to occupancy of the building or prior to any increase in traffic onto SW Oak Street, SW Locust Street or SW Greenburg Road from this develo anent. b. The traffic study submitted estimates the vehicle tri-9 generated by this site to be approximately 1622 trips per day. The study recommends the following: 1. The exi.et-ing signal at Greenburg and Mapleleaf remain as a four-phase operation and be reviewed for interconnection with the Highway 217 traffic signale to improve traffi circulation on Greenburg Road. 2. SW 93rd Avenue should provio. access to the site from the south. 3. Thei Locust/Greenburg intersection be restriped to provide a left-turn and right-turn lane for westbound Locust Street traffic. We are in agreement with the total trip generation of this site, but do not agree with the above recommendations or the distribution of vehicles onto SW Greenburg Road at SW Locust Street, SW Oak Street, and SW Mapleleat Streets. The Division concludes that the Locust Street access to Greenburg Road will carry much more traffic than shown on the traffic stud-,. The traffic study shows the Lincoln Center V will generate in the p.m. peak hours a total of 64 vehicles at the SW Locust Street intersection of SW Greenburg Road, 101 vehicles at the Mapleleaf intersection of Greenburg Road, and 28 vehicles at the SW 93rd Avenue intersection with SW Oak Street. It is staff's opinion that this distribution should be approximately 160 vehicles at the SW Locust Street intersection of SW Greenburg Road, and approximately 30 vehicles at the SW Mapleleaf intersection of SW Greenburg Road. The SW Oak Street intersection will not be provided as part of this development and therefore will not provide access to the site. The traffic study shows the total traffic on Greenburg road in the P.M. peak hour to be 1274 vehicles at the Locust Avenue intersection and 2551 vehicles at the Mapleleaf intersection. NOTTCR OF DECISION - TRAM-MI. CROW CO (SDR 89-12/V 89-17/M 89-11) PAGE 5 Based on the site generated traffic distribution discussed above, it appears that the intersection of Locust Street and Greenburg Road meets the signal warrants ;1, t2, and #11 as defined by the Manual of Uniform Traffic Control Devices, therefore, requiring a signalized i.nteruection. The installation of the signal at SW Locust Street will impact the traffic flow of SW Greenburg Road which is currently operating near capacity. We feel that additional evaluation should be performed on the impact of the signal on SW Greenburg Road and how this impact can be minimized. Improvements to SW Greenburg Road may eventually be required to increase its capacity. The accesses to SW Locust Street from the parking garage are shown to be approximately SO feet from centerline to centerline to SW 93rd Avenue and 65 feet from centerline to centerline to another access. SW 92nd Avenue, across Locust Street, is also approximately 50 feet from centerline to centerline to 93rd Avenue. We are concerned that traffic movements from these two driveways will create an unsafe situation for vehicles and pedestrians. The location of the proposed accesses should be evaluated to determine their beat location along SW Locust Street and along SW 93rd Avenue. d. The seven story office structure will be constructed over an existing parking lot, therefore the increase in storm drainage for this area will be negligible. The parking structure will be con ,tructed over an existing residential area, increasing the storm drainage runoff from this area. The storm water will drain to the south and is proposed to be collected in the realigned SW 93rd Avenue roadway. The impact of this increased storm drainage should be evaluated to insure that the increased storm drainage discharge will not adversely impact the properties downstream. The entire drainage basin for this storm water system should be evaluated to insure that, with ultimate development, the proposed future storm drainage system within SW 93rd Avenue will provide adequata storm drainage capacity. e. It appears that adequate sanitary sewer facilities exist to provide service to the seven story office structure. Washington County has reviewed the proposed development and submits the following comments: "All affected intersections operate at, near, or over capacity as shown below: Intersection LOS V/C Reserve Capacity Greenburg/Locust F -9 NOTICE OF DRCISION - TRAMMEI. Level of service at this location Is "F" and signal warrant volumes are exceeded. Mitigation measures must be developed to elevate the level-of-service at this intersectgion to "D" as required by Washington County Resolution and Ore.er No. 83-219. Staff review suggests that signalization in coniunction with signal interconnection for progressed traffic flow along Greenburg Road should be investigated. Several previous phases of Lincoln Center were reviewed and approved by Washington County. Through these reviews and also through the Metzger Circulation Study and recent Transportation Plan Update we have continued to review and obser�-e the traffic circulation issues associated with Washington Square and Lincoln Center. We are extremely concerned that continued large scale development at Lincoln Center will exacerbate an already difficult situation. Additionally, our concern regarding Lincoln Center Five and associated traffic impacts is heightened considerably by recent discussions of relocating Metzger School in order to facilitate continued easterly expansion of Lincoln Center by Trammel Crow. We stronyly believe that an appropriate condition of approval would require mitigation of traffic impacts. Obviously, full mitigation of the traffic impacts as a condition of approval will have a major economic impact on the development project. Nonetheless, it is important to ensure that existing stan6ards for mobility, traffic capacity, and traffic safety are maintained prior to sanctioning any further development. Washinqton County stands ready to meet with representatives of the City of Tiqard, Oregon Department of Transportation, Trammel Crow and perhaps adjacent property owners to discuss mitigation of impacts prior to granti.ig approval of Li.ncol.n Center Five. No other comments were received. B. ANALYSIS ]+.ND CONCLUSION Site Development Review (SDR 89-12) Section 18.120.180 of the Tigard Community Development Code contains standards whereby the Planning Director or designee can approve, approve with modifications, or deny a Site Development Review request. The proposed site plan meets Community Development Code standards for building setbacks and allowed uses in the C-P zoning district, but a discussion of access and egress, signage, landscaping, automobile and bicycle parking, and building height is warranted. a. Access and Egress The small scale of the site plan makes the access in the parking structure nearest the Locust street: frontage appear to be only 22 feet wide. Staff notes that section 18.108.080 of the Community Development Code requires a minimum pavement width of 24 feet for two-way vehicular access drives. This 24 foot width should be maintained throughout the proposed development. The driveway spacing and locations as submitted in revised civil drawings wit. need to be reviewed by the Engineering Division to ensure safe access and egress to the site. b. Signage A request for sign review under the provisions of the City Sign Code has not been made in conjunction with this development review request. Staff notes that all new or proposed signage to be erected with this or any other phase of the Lincoln Center complex must he reviewed by the City prior to its erection. Any additional freestanding signage will require a public hearing review by the Planning Commission because the site already exceeds the maximum allowable number of signs and possibly the maximum allowable area for freestanding signs in the C-P zone as well. C. Landscaping The landscaping plan submitted by the applicant shows generally where the landscaping is to be installed but dces not indicate exactly where specific types of vegetation are tr go. The site plan also indicates that trees will be planted at two ends of proposed parking spare rows. The Code does not allow trees to be within two feet of any permanent NOTICE OF DEC-SION - TRAM M. CRO" CO (SDR 89-12/V 89-1.7/M 89-11) PAGE 8 hard pavement surface or walkway. it is not clear from the applicant's submission exactly what these boxes will look like or haw they will be r.ited. All of these itemo can be addressed by requiring the applicant to submit a detailed landscaping plan. d. Automobile and Bicycle Parking It appears that the total number of parking spaces is sufficient for this project bath during construction and once construction has been completed. A final parking space count should be verified with the Planning Division prior to the issuance of building permits. Again, due to the small scale of the site plan, parking space dimensions were difficult to determine. The Code requires these dimensions to be 9 feet wide by 18 feet in length. A discussion of parking space width and number of compact spaces follows later in this report. Section 18.106.020(P) of the Code requires a minimum of one secure bicycle parking space for every 15 automobile spaces. This would mean at least 24 bicycle parking spaces need to be provided on a revised site plan. These spaces should be distributed throughout the project and a significant percentage located on the lower level of the parking structure. The rack design should also be submitted for approval. e. Building Height The maximum building height allowed in the :-P zoning district is 45 feet. The applicant is requesting a Varian:e approval so that the proposed Lincoln Center V building may rise 92 feet 6 inches feet to the roof line. An architectural design element or "appendage" will rise another 14 feet in the center of the building facade but does not count towards the overall building height. Building Height Variance (V 89-11) The provisions contained in Section 18.98.020(A) of the Code allow relief fro,-)m the maximum building height requirements up to 75 feet provided all thrice exception criteria can be me.. These criteria require that a maximum hei.gWof 75 feet may be allowed in a commercial zone when 1) the total. building floor area does not exceed 1.5 times the area of the site, 2) the setback equals at least one-half of the building height and 3) the structure does not abut a residential zone. The total building floor area will not exceed 1.5 times the area of the site. Since the building height will exceed 75 feet and the setback will be lees than 46 feet, a Variance approval is necessary to allow the proposed height of 52.5 feet. Section 18.134.050 of the Code contains criteria whereby the Director can approve, approve with modifications or deny a variance requent. They are: NOTICE OP DECISION - TRAMMEL CROW CO (SDR 89-12/V 89-17/M 89-11) PAGE 9 (1) The proposed variance will not be materially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies of the Community Development Code, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity. (2) There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; (3) The use proposed will be the same as permitted under this Code and City standards will be maintained to the greatest extent possible, while permitting some economic use of the land; (4) Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were located as specified in the Code; and (5) The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. The primary purpose of the Code height and setback requirements is to provide adequate light and space between buildings, particularly when different zoning districts are involved. Although the building height is taller than what the Code allows, the proposed angled 23 foot aetback of the building (only the corner of the building faces SW Locust Street) will result in a less imposing structure than with a 45 foot tall building with a 20 foot setback directly facing onto SW Locust Street which would meet Code standards. Moreover, the building will be separated from adjacent residential properties to the north and northeast by the 70 foot wide public right-of-way of SW Locust Street. The distance of approximately 93 feet from the outermost building surface to the nearest residential property line to the north is approximately equal to the height of the building. Across the street from the proposed site 1.e one isolated property which is zoned R-12, that is not under residential use, and which is completely surrounded by C-P zoned land. Two other residentially zoned parcels lie on the southeastern corner of SW 93rd Avenue and SW Locust Street. The first parcel in likely to be most affected by the shadows this new building might cause; however, it should eventually be rezoned because of its isolation from other., residentially zoned land and because it is no longer used for residential purposes. Existing physical and natural systems, including traffic, will. not be subnr.antially affected to a worse extent than if the building met: current City standards for building height, NOTICR OF DECISION - TRAMMEL CROW CO (SDR 89-12./V 89--17/M 89-11) PAC .R 10 Parki_nq_S ace_Width and Percent of Compact Spaces Variances The above criteria have also been adequately addressed by the applicant. The reduction in compact parking space width from 8.5 to 8 feet is minimal. The Washington County standard is 7.5 feet and the present parking lots are developed with this standard. Staff also finds no conflict in allowing up to 45 percent of all parking spaces to be designated as compact spaces, so long as the total number of spaces for each phase of Lincoln Center is satisfied. Lot Line Ad ustment M 89-111 A lot line adjustment approval of the joint property line between tax lots 2800 and 2901 (total area = 30,056 square feet, owned by the School District) and tax lot 1004 (total area m 110,642 square feet, owned by Trammel Crow) will be necessary because of the realignment of SW 93rd Avenue. Tax lots 2800 and 2901 are located at the southeastern corner of the intersection of SW 92nd Avenue and SW Mapleleaf Street. Tax lot 1004 is at the southeastern corner of the Lincoln Center development. Section 18.1it2.060 of Tigard's Community Development Code contains the standards whr;reby the Director or his designee may approve, approve with cond'_}iz�"d, or deny a lot line adjustment request. These criteria are: 1. An additional lot is not created by the lot line adjustment and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the approved zoning for that district; 2. 8y reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; In addition to the above criteria, the provisions of Code Section 18..162..040 shall also apply to lot line adjustments. This section requires that: a) the proposal conforms with the Ctty's comprehensive plan, all statutory and ordinance req»irements and regulations; b) adequate public facilities are available to serve the proposal; C) all proposed lots conform to the size and dimensional requirements of this title; and d) all proposed improvements meet city and applicable agency standardei. NOTICR OF DRCISION - TRAMMEI. CROW CO (SDR 89-12/V 89-17/M 89-11) PAGE 11 No new lots will be created by this lot line adjustment. The area remaining to the east of the realigned SW 93rd Avenue will be the remainder of tax lot 2901. The Trammel Crow property immediately to the west of the realigned SW 93rd Avenue will increase by 6,188 square feet formerly in tax lot 2800 and tax lot 2901, and will include the vacated right-of-way of SW 93rd Avenue between SW Locust and SW Mapleleaf Streets and tax lots 1004 (southern end of parking lot), 900 and 1002 (Lincoln Center V building and parking structure). No lots affected by this proposal will be smaller than what is required In the C-P and R-4.5 zoning districts. Tax lot 2800 is considered a nonconforming lot in the R-4.5 zoning district because it is smaller than the minimum lot size requirement of 7,500 square feet. By including it with the properties immediately to the west, this nonconformity is eliminated. The reduced tax lot 2901 will still be well over the 6,000 square foot minimum lot size in the C-P zone. All. structures affected by this lot line adjustment will retain adequate setback distance from property lines. All proposed lots, therefore, will conform to the size and dimensional requirements of the Code. The lot line adjustment proposal conforms with the City's Comprehensive Plan and all statutory and ordinance requirements and regulations. The proposal also conforms to the Metzger-Progreso Community Plan which was recently amended to provide for the realignment of SW 93rd Avenue. The proposed improvements will satisfy City and other applicable agency standards; the City will ensure that this is the case by imposinq conditions of approval which must be satisfied prior to recording the lot line adjustment with Washington County.
