Landmark Lane Tigard, Oregon Received call on radio from Jim Brien, inspector , that Northern Yards building was being occupied without certificate of occupancy and with building being posted with do not occupy signs. I asked Mr. Brien to pick me up and we would go out to the building together. I phoned Sabre Construction and was unable to get Mr. McGee When Mr. Brien and I arrived at building site I found warehouse portion of building occupied with merchandise covering between 1/3 and '/2 of floor aree. The office portion of building was in finishing stages of construction. The sprinkler system men were working on sprinkler system. I met Mr. Duane Wolfe, President of Northern Yards and advised him that the building could not be occupied legally for following reasons and that the certificate of occupancy could not be given for the same reasons. 1. Building not completed and final inspectioii could not be given at this time. 2. That water mains had not been installed leaving sprinkler system inoperative even when work on system was completed. 3. That sewer and power had not been installed in Landmark Street and building could not be connected up. 4. That necessary street dedications and easements had not been given as required by Planning and Zoning Commission. 5. That fire hydrants for Owens Corning building had never been installed which left area of building virtually without fire protection. 6. And advised him that building was so posted "DO NOT OCCUPY" At this time Mr. Pike owner of Sabre Construction and Mr. McGee arrived. They immediately advised me that it was all city ' s fault that the job was not completed but could not explain why required work was not being done or why they had given Norther Yards permission to occupy building page 2_ For above reasons and the fact that the building was being occupied and there was no evidence of water and sever being connected on near future to insure fire protection and sanitation I instructed Mr. Brien to issue a citat-Lon to both Mr. Pike and Mr. Wolfe. Citing them for occupying building without final inspection and certificate of occupancy. Mr. Wofe accepted his citation but Mr. Pike refused his and it was placed on packing box in front of him. Letter from Winslow Brooks, Planner For City of Tigard, to Mr. Pike dated July 9, 1974 lists requirements needed to satisfy planning and zoning before certificate of occupancy could be issued. Building permit ic,sued July 12, 1974 was issued under these conditions. With lack of water for sprinkler system and lock of fire hydrants in area the fire department does not want building occupied.
