We received your letter dated December 21 and submit the following.
First, to my recollection, you and I have never spoken to one another.
I believe the conversation referred to was with my field superintendent
Lyle Piersall.
It should be noted that the bond which we were requested to provide and
C,+^^"` did submit is a "performance" bond. At no time was a maintenance bond
�'re. �,�,•��'' even discussed much less agreed to. We have absolutely no control over
area subsurface or above ground use and/or conditions in the future.

I have been advised that you were present when this work was being done
and it would seem that if testing reports were necessary or to be
provided there was plenty of opportunity to discuss the matter prior to
the asphalt paving being placed.
Our position is - the street opening and related work has been
faithfully and properly completed fulfilling the requirements of bond
No. 5556568 dated August 15, 1989.

Dear Mr. Smith:
Regarding our phone conversation yesterday af,�srnoon, there is one point that I
believe should be clarified. There is a chai,Te in my mind that you may have
misunderstood the ten percent (10%) maintenance assurance. You mentioned that
you people did not want to be burdened with chasing down your subcontractor in
the case of trench failure, six months down the road. Your concezn is well
founded and shared by The City of Tigard.
The standard surety maintenance bond/deposit mentioned in Mr. Flagman'• letter
dated December 15, 1989, would provide sufficient assurance and enable release
of the current performance assurance. Either your fLrm, or your subcontractor,
could poet the maintenance Lond. If a failure occurs, we will notify the bond
provider of the need to respond. If the provider d)es not cors,ict the failure
then, we would make the repaire, charging the cost thereof, against the bond.
11 At the end of one year, if there is no bvidence of further settlement, the
bond/deposit would b6 returne9 to the provider.

1 .- Post bond as described above, by your firm, or your subcontractor.
2.- Have the Testing Lab of your choosing test for, band determine, the
following:
* 95% relative compaction on fine grade beneath the now AC paving.
* 3" minimum thickness of that new paving.
* 95% relative compaction of the AC pavement itself.
(Note: I will determine tht. location of the test coring. )
3.- Remove and replace the sunpected failure areae (the gaveled roadway, not

Dear Mr . Hagman :
Enclosed for preliminary revie : are two (2 ) sets of construction
plans for half street improvements at 9730 S .W. Shady Lane .
Based on a site visit and design survey we find that Shady Lane
has little or no vertical grade. We propose connection to
existing storm sewer system on the north side of the street.
Enclosed is a storm drainage analysis, please note that the
proposed building extends with service canopy and footings across
the entire lot . The property to the east is still undeveloped
and the existing drainage is much closer to the street which
should be used for storm drainage solution to Shady Lane .

The applicant proposes to construct a 5,120 scpare foot auto se rice facility
with 13 pzu-king spaces on a 0.43 acre site south of SW Shady Lane along Ash
Creek.
Findings:
1. 'ine applicant has submitted a site improvement including a prelimiroi-y
utility plan and grading plan; no public improvements are shown.
2. The site fronts on SW Shady Lane, a minor collector requiring a 60 foot
right-of-way. The e-visting right-of-way appears to be adequate but should
be verified. The north side of the street is improved wit;i curb and
sidewalk. Curb aril sidewalks have not been installed along the frontage
of the site although the existing paved width appears to be near the
required 4C: feat.
3. SW Shady Lane has a nearly level profile. At least one storm drain inlet
should be installed alorxl the frontage of the site. It appears that
runoff c ollect:ed in this inlet must be directed through the site to Ash

on behalf of Gloria Mae Perry to allow construction of an 5120 square foot
automotive and equipment: repairs, light equipment use on a 1.08 acre parcel
zoned C-G (Commercial General) and R-12 (Multi-family Residential , 12
units/acre) . Location: 9730 SW Shady Lane (WCTM 1S1 35 BD lot 800) .
DECISION: Notice is hereby given that the Planning Director's designee for the
City of Tigard has APPROVED the above request subject to certain conditions.
The findings and conclusions on which the decision is based are noted below.
A. FINDING OF FACT
1. Background
No previous applications have been reviewed by the Planning Division
with respect to the subject site.
2. Vicinity Information
Properties immediately to the north are also zoned and developed C-G
(Commercial General) . Properties immediately to the east and webt also
share this split C-G/11-12 zoning while properties to the south are all
zoned and developed R-12 (Multi-family Residential, 12 units per acre) .
3. Site Information and Proposal
The property is presently developed with a single family residence and a
detached garage. Ash Creek bisects the property from east to west and
the creek also forms the approximate land use boundary with the C-G zone
on the north side of the creek and R-12 to the south.
The applicant intends to develop only the upper portion of t1ta property
that Is zoned C-1, (Commercial General) . The existing house and garage
will be rent -4-d; the septic tank will also be removed and filled In. A
5120 square foot structure is proposed to be constructed on the site
along with 13 parking spaces. The proposed land use will be an
"automotive and equipment: repairs, light equipment" use.
4., Agency and NPU Comments
The General Telel.hone Co. , the Metzger Water District, Northeast Natural
Gas and Portland General Electric have all reviewed the proposal and
have no objections to it.

The City Building Division has reviewed the proposal end comments that a
demolition permit will he required for the removal. of existing
buildings.
The Consolidated Rural Fire District has reviewed the proposal and
states that hydrant protection is required within 250 feet of all
portions of the first floor; this is t;r, be measured around the outside
of the building and along access roadways. Access to the building is
required via an approved roadway to within 150 feet of all portions of
the building.
Neighborhood Planning Organization 82 has reviewed the proposal and
comments that it has traffic concerns, namely, whether_ there would be a
potential conflict between Good Samaritan mergency vehicles and in- and
outgoing traffic at the subject site.
The City Engineering Division has reviewed the proposal and makes the
following observations and findings:
a. The appli -int has submitted a site improvement including a
preliminary utility plan and qrading plan; no public improvements
are shown.
b. The site fronts as SW Shady Lane, a minor collector requiring a 60
foot right-of-way. The existing right-of-way appears to be
adequate but should be verified. The north side of the street .is
improved with curb and sidewalk. Curb and sidewalks have not been
installed along the frontage of the site although the existing
paved width appears to be near the required 40 feet.
C. SW Shady Lane has a nearly level profile. At least one storm
drain inlet should be installed along the frontage of the site. It
appears that runoff collected in th.ie inlet must be directed
through the site to Ash Creek. This would require a 12 inch storm
drain in a public easement huilt to public standards.
Furthermore, the inlet should be designed for a future connection
to storm drainage improvements the City intends to install along
the north side of SW Shady Lane.
d. Storm drainage for the site is provided by a pr.i.vate storm drainage
that discharges towards Ash Creek.

Chapters 16.120 and 18.62, Commercial General District, the following
sections of the Tigard Community Development Code are also applicable:
18. 86, Chapter 18.100, Landscaping and Screening; Chapter 18.102, Visual
Clearance Areas; Chapter 18.104, Fuel Tank Installations; Chapter
18.106, Off-street Parking and Loading; Chapter 18.108, Access, Egress
and Circulation; Chapter- 18.114, ^igns; Chapter 18.120, Site
Development Review; and Chapter 18.150, Tree Removal.
The a.aplicantls submittal meets most of the development standards
contained in Tigard,s Community Development Code but a discussion on
parking and access, fuel tank installation, signage, tree removal and
floodplain regulations is warranted.
Parking and Access
The submitted site plan shows standard r-rking spaces which measure nine
feet by twenty feet. This is two feet longer than what the Code
requires. The access drive which runs north-south on the property is
proposed to be only 23 feet wide where the Code requires a 24 foot width
for two-way access drives. Staff suggests requiring a new site plan
which shows parking space and access dimensions which conform to Code-
required dimensions.
There appears to be no conflict with the proposed location of the access
drive onto the subject property and the closest access drive of the Good
Samaritan medical clinic across the street. a two driveway entrances
will be offset by an estimated thirty feet.
Fuel Tank Installation
The applicant Should be required to obtain permits from the Fire
District and the City Building Division pertaining to fuel tank
installation prior to issuance of building permits.
Sm ir1nage
No new signage is proposed in conjunction with thin application. Staff
notes that a City aign permit will be required prior to the erection of
any sign. The Code will allow up to a maximum of 15 percent of each wall
face to be covered with signage. One freestanding sign 1.8 permitted on
the property; its dimensions cannot exceed 20 - 22 feet in height and a
total area of 70 - 90 square feet: per face (depending on sign setback).

Tree Removal
Chapter 18.150 contains regulations regarding the removal of trees on
developed commercial land. Since it is unclear which, if any trees are
to remain on the site during and after construction, staff recommends
requiring submittal of a detailed tree protection plan a.-d tree removal
permits prior to grading and clearing of the nits.
Floodplain
Code Section 18.120.180.A.8 requires that where landfill and/or
development is allowed within or adjacent to the 100-year floodplain,
the City shall require the dedication of sufficient open land area for
greenway adjoining and within the floodplain. This area shall include
portions at a suitable elevation for the construction of a pedestrian/
bicycle pathway within the floodplain in accordance with the adopted
pedestrian/bicycle plan. Therefore, dedication of the land area on this
property below the elevation of thea 100--year floodplain. Construction
of a bicycle pathway is typically required aG a condition of approval.
However, because public access is not available and the location of the
path has not been determined, it is not appropriate to construct the
path at this time.
C. DECISION
The Planning Director's designee for the City of Tigard approves of SDR 89-15
subject to the following conditions:
UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL HE SATISFIED FRIOR TO ISSUANCE
OF BUILDING PERMITS
1 . Seven (7) sets of plan and profile public improvement construction
plans and one (1) itemized construction cost estimate, stamped by a
Registered Professional Civil Engineer, detailing all proposed public
Improvements shall bo submitted to the Engineering Division for
approval . Two (2) sots of plan and profile plans shall be submitted
for preliminary review prior to submittal of final plans. STAFF

1. Construction of proposed public improvements shall not commence until.
after the Engineering Division has approved public improvement plans.
The aection will require a 100 percent performance assurance or letter
of commitment, an developer-engineer agreement, the payment of a permit

street opening permit or construction compliance agreement shall occur
prior to, or concurrently with the issuance of app•-oved public

3. The applicant i3hal.1 submit evidence verifying that the right-of-way of
SW Shady Lane along the frontage of site is of a width not less than 60

4. standard street improvements, including concrete sidewalk, driveway
apron, curb, asphaltic concretes pavement, storm drainaqe, street-
lights, and underground utilities shall be installed along the SW Shady
Lane frontage. Improvements shall include a storm drain inlet
ccnstructed to provide for a connection to future storm drainage
improvements planned for the north side of SW Shady Lane.
Improvements shall be designed and constructed to minor collector
street standards and shall conform to the alignment of existing
adjacent improvements or to an aligrunent approved by the Engineering

5. A prof.i.le of SW Shady Lane shall be required, extending 300 :Feet either
side of the subject site showing the existing grade and proposed future

6. The propceed privately-operated and maintained parking lot and/or
roadway plan-profile -.id cross section details shall be provided as
part of the public improvement plans. STAFF CONTACT: Gary Alfson,

7. The applicant shall provide for roof and pavement rain drainage to the
public storm water drainage system. STAFF CONTACT: Brad Roast,
Building Division (639-4171) .
B. The proposed privately operated and maintained sanitary sewer and storm ►3 J� IV

drainage system plan-profile details shall be provided as part of. the ` Q
public improvement plans. STAFF CONTACT: Greg Berry.
9. The applicant shall obtain written approval from Unified Sewerage Agency
of Washington County to connect to the trunk line prior to issuance of a
Public Improvement Permit. STAFF CONTACT: Greg Berry.
10. The applicant shall provide connection of proposed buildings to the
publin sanitary sewerage system. A connection permit is required to
connect to the existing public sanitary sewer system. STAFF CONTACT:

11. A permit shall be obtained by the applicant from the VS Army Corps of
Engineers and Division of State Lands, (Authority: Section 404, Clean
Water Act, and ORS 541.605 to 641.695) . A copy of the permit shall be
provided to the City Engineering Division by the applicant-., STAFF

12. The area below the 100-year floodplain elevation shall he dedicated as
greenway - open space to the City. A monumented boundary survey showing
all new title lines, prepared by a registered professional, land

surveyor, shall be submitted to the City for review and approval prior

13. The applicant shall submit a revised site plan which shows a minimum of
24 feet in access width and nine by eighteen foot long parking spaces.
The proposed design for the bicycle rack shall also be submitted for

14. A demolition permit shall be obtained prior to demolition or removal of
any structures on the site. STAFF CONTACT: Brad Roast, Building

15. A detailed tree protection plan shall be submitted for Planning Division
approval which includes locations and types of trees to be retained, an
arborist's recommendations for methods of protecting these trees during
construction of the new structure and also for maintenance of the .long-
term health of the trees. No site grading, clearing, or tree removal
shall occur prior to satisfaction of this condition. The trees to be
saved shall be protected during construction by fencing or similar means

16. The applicant shall obtain any required permits from the Fire District.
and the state Department of Environmental Quality prior to installation

THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO ISSUANCE OF AN OCCUPANCY
PERMIT:
17. All. landscaping materials and other proposed site improvements shall be
installed or financially assured prior to occupancy of any structure.

In order to better• serve the motoring public and to p 'otect our pavements, we
need to tighten up our policies on patching of e%cavations in paved areas .
Beginning immediately, any excavation in e. pavement shall be patched
prior to leaving the job site. Cold mix patches may be used until a permanent
patch can be installed. The cold mix patch must be regularly maintained until
the permanent patch is installed .
