Co. Tax Map 2Sl 11(;D, rax Lot 7900) . DECIS]:ON Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above described applications subject to certain conditions . The findings and conclusions on which the Director based his derision are as noted below. A. FINDING, OF FACT 1 . Background A Planning Director der_i.sion regarding this matter was issued on November 16, 1984. However, there was a misunderstanding between the Planning staff and the applicant regarding the height of the building. After receiving the decision, the applicant notified the City that a 12-foot tall building was proposed . Since 10 feat. is the maximum height allowed by the Code, an additional variance review is required . 2. Vicinity Information The property is surrounded by single family residential development on lots ranging from 4,600 to 7,000 square feet in size. The lots to the north and south are zoned R-4 .5 (Residential, 4 .5 units/arse) and the parcels to the west are zoned R-7 (PD) (Residential, 7 units/acre, planned development) . 3 . Site Information and Proposal Description The lot is within Kerwood Estates subdivision which has five-foot utility easements along all lot lines. The applicant proposes to build a 1.2-foot high, 220 square foe' accessory building in the northwest corner of the rear yard. A variance is requested to allow the structure to have a three-foot setback from thc, north and west property lines and a height of 12 feet. "Che rear yard is presently enclosed by a 6--foot solid wood fence, 4 . Agency and NPO Comments The Engineering Division, Building Inspection Office, and NPU M6 have no objections to the proposal. NOTICE OF DECISION - M 9-84 6 V 16-84 - PAGE. l i 8. ANALYSES AND CONCLUSION The proposed structure is consistent, with maximum siee limits in the Code of 300 square feet. Section 18 . 134 .050 of the Code requires the following approval criteria for variance proposals : 1 . The pruposed variance will not be materially detrimental to the purposNs of this Corse, be in conflict with the policies of the Comprehensive Plan, to any otfiar applicable Fir)li.ci.e9 and standards; and to other properties in the samri zoning district or vicinity; 2. There are spacial circumstances that exist which are peculiar to the lot sire or, shape, topography or other circumstances over which the applicant has no control., and which are not applicable to other properties in the same zoning district; 3 . The use proposed will be the same as permitted under this Code and City standards will be maintained to the greatest extant that. is reasonably possible, while permitting some economic use of the land; 4 . Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not br, adversely affected any more thr.o would occur if the development were located as specified in the Code; and 5. The hardship is not. self--imposed arid the variance requested is the minimum variance which would alleviate the hardship, The prii„iry purpose of the setback standards for the R-4 .5 zone is to allow for adequate spacing, air, light, and privacy for residential structures. The variance will not have an appreciable effect upon the existing residences in the area. The structure will be screened almost entirely by the existing fence and vegetation. The lot is relatively small and if all setback requirements from the property lines and the house were enforced, the applicant would be unable to construct an accessory building anywhere on the property . The City has no abjection to the threw-foot setback, however, permission must be granted by the utility companies which are eligiblri to use the five--foot easement before a buil.di.ng may be constructed over it . The bulk of the building will be approximately 10 feet in height. The variance is needed because of the roof pitch proposed which will have a maximum height of 14 feet at the-F of the roof. City Code def uses building height as the average height of a pltc—ed roof and therefore the proposed building will be slightly less than 12 feet. Due to the location of the building and the relatively small amount of building mass that will be above 10 feet, the height variance appears justified . NOTICE Of- DECISION -. If a lesser setback is desired, written permission must be yranted by all affected utility companies or the utility easements must be vacated according to City procedures. 4. This approval is valid if exercised within one year of the final decision date noted below. D. PROCEDURE 1 .
