1. The plans are not consistent in dimension and/or scale-per-inch. Provide revised
plans correctly drawn to the size of structure to be built.
How are the rafters supported when drawings show they terminate at 9 feet and

Dear Mack,
This letter will address item 2 of your letter dated September 23, 1993, specifically the use of the
retractable shade screen structure in the Garden Center of the above referenced store.

As you already know, the shade screen on the structure is manually retractable by the employee's
of the store. The cloth on the structure is not capable of supporting snow loads and the employees
in the store are trained in the methods used to retract it.
Besides retracting it in the wintertime, it is also retracted when the intensity of the sun is reduced
in order tr) provide more sun for the plant materials underneath. TLis shade screen structure is
bein,{used by The Home Depot in all areas of the country, including the Northeast where the
sno i is much heavier than that experienced in Oregon.
In all canes the shade screen is retracted before the snow fall and left in the retracted state for the
duration of the winter, and that is how this shade screen will be operated. It will not be left
exposed to the load exposed by the snow during the winter.
The only -„ea of possible concern for The Home Depot is the training employees of the in the
store on the use of this stricture and this is mitigated by the proper training of the emrloyees in
the store and the observation of the manager and the assistant mangers of the stc:e.

Mechanical Code (UMC) specifically referencing the fire

1. Enclosed, please find a copy of U.L. listed Fire Marshal
Approved Central Stations that are acceptable by this
department ror supervision of the automatic sprinkler
systems. Automatic sprinkler systems shall be fully
supervised for water flow, tamper and including dry
system for hich/low air pressure.
2 . Provide this office with cut sheets for detector check
I and automatic sprinkler heads to be used. Also include
any other specialized equipment, such as special
hangers, couplers, Sway bracing, attachments, etc.
3 . A slight elevation difference exists between building
location and where flow test has been made. This office„
would suggest that corrections be made in hydraulics and
substantiated in writing allowing for said differences.
4 . Provide 24 hour notification prior to an- anticipated
tests or inspection times for these sprinkler systems.

After careful consideration and review of Uniform Fire
,-ode Article 79 Section 202 (d) , as printed in the 1993
Accumulative Supplement by ICBG and comparing it to the
1991 Edition of the Uniform Fire Code Section 79 . 2.02 (b) ,
we believe that the revised section, as printed in the 9
Supplement, is equal to or better than the 1991 Edition
of this comparative section. The Fire District is
willing to accept the substitution as requested.
The Fire District received a letter from Home Depot's
insurance carrier (AIG) stating that they would not
require curtain boards. The curtain boards may be
delated as Jim Jaqua, City of Tigard 's Plans Examiner,
also agreed with their request.

EROSION CONTROL JOINT PERMIT
PURPOSE
This Permit is a 1200-C General Permit issued by the Unified
Sewerage Agency through the authority of an intergovernmental
agreement on behalf of the Department of Environmental Quality. i
This Permit is issued pursuant to ORS 468.740 and the Federal Clean j •
Water Act. This permit is required for properties with construction
activity including clearing, grading and excavation activities,
except for properties with operations that result in the disturbance
of less than five acres of total land area which are not part of a
larger common plan of development or sal.e.
This: Permit is also a Unified Sewerage Agency Erosion Control Permit
issued in accordance with Section 5.02 of Resolution And Order
91-47, and also meets the requirements of the Tualatin Basin Erosion
Control- program specified in OAR 340-41-455( 3) .

Monitoring and Reporting Requirements
The following shall be accomplished by or under the di►:ection of the
Permittee:
1 . All erosion control facilities shall be inspected at least
once every seven calendar days and within 24 hours after any
storm event of greater than 0. 5 inches of rain per 24 hour
period.

2. During stormy periods or periods oL snow melt when runoff f.
occurs daily, all erosion control facilities shall be j
inspected daily.
3. Storm water runoff discharges shall be visually monitored at e;
the above frequency to evaluate the effectiveness of the
pollution control facilities or practices. If any
measurable quantities of sediment are leaving the property,
corrective action shall be taken to reduce the discharge of
sediments.

4 . Keep a record of inspections, and any uncontrolled releases
of mud or muddy water or measurable quantities of sediment
found off the site with a brief explanation as to the
measures taken to prevent Euture releases as well as any
measures taken to clean up the sediment that has left the
site. This record shall be made available to the Agency or
DEQ upon request. For projects lasting more than one year,
the inspection record shall be sent to the Agency by July 1
of each year .
General Requirements
All general conditions and penalties for non-compliance shown in
Sections A and B of the DEQ 1200-C permit shall apply. In addition,
all conditions and requirements of Section 5.02 of Resolution and
I Order 91-47 and related enforcement provisions shall also apply.

Answer -- Any development that eisturbs 5 acres or more: of that is
p_- t: of a masterplan that will disturb 5 acres or more.
2. Would a development that is on a parcel larger than 5 acres, but
that will actually only disturb less than 5 acres, need a Joint
Permit?
Answer --•- If the area that is not being disturbed is part- of a
masterplan that will be developed, then the first phase will need a
permit even if it disturbs less than 5 acres. If the total
development planned on a site io less than 5 acres, even if the site
is larger than 5 acres, the devzlopment will not need a 120P C
permit . For example, bi.ilding a normal single family house on a 6
acre parcel would not need a Joint Permit (but would still need a
reg,ilar USA Erosion Control Permit) . The construction of public
improvements on a 6 acres subdivision would require a permit .
3. Does this rule apply everywhere, only in the Tualatin Basin, or

the time you are issued a building permit. The second iq to arrange for payment
over time by signing a promissory note. (If you wish to exercise this second
option please contact me for additional details. ) The third option is to defer
payment until occupancy.
Please note that you may appeal the discretionary decisions made in determining-

This letter is mailed to you to request that the draft curtain requirement in Article 81 of the
Uniform Fire Code be waived. Section 2.301 (a & b) provides this latitude.
Utilizing the Uniform Fire Code Article 81, automatic smoke and heat vents are required
on a basis of 1.0 square foot of vent for each 100 square feet of warehouse. Draft
curtains are required so that areas found do not exceed 10,000 square, feet based on
utilizing six foot curtains.
Tomes, Van Rickley& Associates is presently co-chairing a committee with the California
Fire Prevention Officers to rewrite Ariicle 81 of +he Uniform Fire Code. The experts on
this committee have great concerns about the installation of draft curtains. This is based
on the following:

(1) Fire testing has shown within sprinklered buildings draft curtains provided little or
no benefit and are sometimes detrimental to fire sprinkler system operation.
Roof vents and draft curtains were originally used as an aid to fire fighting in
unsprinklered buildings. In un orinklered buildings, roof vents, augmented by draft
curtains, can sometimes re.;4ve smoke accumulation by containing radial
movement along the ceiling and by permitting the .smoke to escape. Vents and
draft curtains are of much less value for fires in sprinklered buildings. In fact, draft
curtains can have a detrimental effect by actually increasing burning intensity and
spread.

(2) Automatic fire sprinklers control a fire by cooling the fire itself and pre-wetting the
' area around the fire, thus inhibiting fire growth. Installation of draft curtains could
preverit this prewetting of adjacent areas and adversely effect sprinkler operation.
The following diagram illustrates this problem.

If the fire advances down the rack towards the draft curtain, the draft curtain will
block the heat and not let the sprinkler heads in front of the fire operate. The
sprinkler head operation in front of an advancing fire is extremely important. This
is called pre-wetting the commodity in front of the fire. Without pre-wetting, again,
the ability of the sprinkler system to control a fire is in question.
(3) The activation of sprinklers are affected by many factors, including the ceiling
temperature and ceiling jetstream or heat velocity. Computer modeling has shown
tha: installing draft curtains will cause turbulance as the ceiling jetstrPaln makes
contact with the draft curtain. This turbulence could effect the response of the
sprinklers and cause skipping of adjacent sprinkler heads. (See "A" in the
illustration). This concept is confirmed in NFPA 13 which regulates sprinkler head
placement for sprinklers located below penalized roof systems.
(4) The NV tional Institute, of Standards and Technology Building and t=ire Research

(NIST) i;, Hearin the conclusion of a two year study designed to
j investigate fire sprinkler and smoke P^d heat interaction. The key objectives (if the
project were to complete a collaborative research effort between NIST and Factory
Mutual Research, develop a compute,,model. LAVENTS (Link Activated Vents and
Sprinklers) too simulate the interaction of fire sprinklers and smo!<b and heat vents,
and finally to conduct full-scale firr/ testing. One result from this stuc:y indicated
that ceiling vents can have a significant effect on controlling the. thichness and
temperature of smoke layers to avoid the deletoljous effect of'smoke-logging" that
is typically brought about by sprinkler operation.

From ,the NIST research, another important discovery was made. Duo to
interaction with the various gas layers which appear in a fire located in a w
sprinklered building, the role of curtain boards became questionable. The
likelihood of 'smokelogging' a building increases as a depth of the upper layer
(smoke layer along the ceiling) increases. The deeper the upper layer, the greater
the amount of smoke which will be entrained by the water droplets of the sprinkler
system and thus be 'downdragged' into the lower layer. This lower layer is
typically clean air apd infiltration of smoke into this layer will greatly incraase the
likelihood of smoke-logging the building.
The results of present testing and analysis of past data clearly indicate that draft curtains
provide no benefit in a sprinklered building but could certainly cause problems. This f !I
conclusion has become widely accepted within the fire industry.
We believe the elimination of the draft curtain requirement will provide superior fire
protection '.or this facility.
Based on the above reasons we suppert the installation of the smoke and heat vents, but j
request that the draft curtains not be installed based on the above fire protection r
concerns. The L 'sis for this request is the over-design of the sprinkler system and the { ti
potential risk of the draft curta;cls.

The ventilation topic was the portion of existing article which the committee
felt needed the most work. The basis for and documentation to support the
us=e of smoke and heat vents and curtain boards in sprinklrred buildings is an
age old question which has generated more disagreements among f ire protection
professionals than any other area in high-piled fire protection.
The reasons 'for this problem ai e the lack of full scale fire testing using
smoke and heat vents and curtain boards . None of the current National Fire
Protection Association or Factory Mutual Engineering tests, which are the
basis for all current fire protection standards, incorporated smoke and heat
vents and draft curtains in the testing process . Thus, o-ie's position on
this issue is probably based upon insight gained from real life fire
experience or speculation.
The main questions which need to be addressed are as follows :
1 ) Do smoke and heat vents affect automatic fire sprinkler activation?
2) Are smoke and heat vents beneficial for manual fire fighting and
when is the optimum time for the smoke and heat vents to activate
in relation to fire sprinkler activation?
To answer these questions and hopefully put this issue to rest once and for
all., a two-part program was established. First, all existing testing in this
area was compiled and analyzed. Next, the new testing and research presently
underway was examined. The committee' s hope was that by looking at research
in nn analytical ,.canner, the myths and misconceptions could be separated from
the science and engineering and thus a. logical conclusion reached.
The conclusions reached by the committee are as follows:
1 ) all research done indicates that smoke and heat vents do not have a
detrimental effect an a ._ttomatir. ;Drinklet operations. Smoke and heat
vents do reduce ceiling temperatures and improve visibility for manual
fire fighting.
2 ) The smoke and heat vents should probably activate prior to activation of
the fire sprinklers to reduce the thickness of the upper layer and thus
the potential for smoke-logging of the building.

3 ) Curtain boards provide no benefit in a sprinklered building and could
adversely affect sprinkler activation and inc:-ease the likelihood of
smoke-logging.
Division IV of Article 81 was written with this in mind. Venting ratios have
=-!yen increased and curtain boards have been eliminated in sprinklered s
L-.jildings. Due to the apparent lack of performance of. mechanical smoke
_emoval systems, smoke and heat vents were made the primary requirement, with
an exception to allow mechanical smoke removal if smoke and heat vents are
deemed not practi-cal (i.e. in cold storage buildings or where weather
conditions restri,:t the use of vents) by the chief . In addition, an appendix
was created which gives guidelines for the design of the smoke removal
system. The ex2:aust quantities used in this section were taken from the
atrium smoke r.emovel section of the Uniform Building Code. The committee
felt that the mecha, '.cal smoke removal design criteria presently in the code
was arbitrary and inadequate. I'
Background
The history of smoke and heat vents and curtain boards in buildings used for
high-piled stock is somewhat of a mystery. The first use of these devices,
although not documented, was reported to be in 1966 by the Los Angeles county
Fire Department. This application was based upon judgement by the fire
marshal. This was no fire testing to confirm this decision .
In the 1971 Er:i-tion of the Uniform Fire Code, Article 35 , High-Piled
Combustible Stack was introduced. Requirements for smoke and heat vents and
curtain boards :!-re introduced in this edition. smoke and heat vents and
curtain boards were required in all buildings used for high-piled stock
regardless of automatic fire protection. section 35 . 107 states "Draft
cu.L-tains shall be provided to limit the area of sprinkler operation and to
aid the operation of roof vents . " No fire -esuing or research was done at '.
that time to justify this position. Article 35 remained unchanged in the
1973 and 1976 Editions.

A major rewrite of Article which was iater changes to 81. , was undertaken
for the 1979 Edition of the Uniform Fire Code. Research conducted during
this rewrite indicated that a mechanical smoke removal system was preferred
and that smoke and heat vents and curtain boards were not required in
b�iildings protected by an approved fire-extinguishing system (Section I"
81 .107(a) ] . Smoke and heat vents and curtain boards were also not required
in fully sprinklered buildings in the 1982 Edition cif the Uniform Fire Code.
The 1985 , 1988, and 1991 Editions of the Uniform, Fire Code have again changed
the smoke and heat vent and draft curtain requirements. These codes require
either smoke and heat vents and draft curtains or mechanical smoke removal in
buildings used for high-piled stock storage regardless if the building is
sprinklered or not. No new research or fire testing was done to support this

rhe most well known and widely distributed testing on smoke and heat vents is
work done by Factory Mutual Research corporation in their Rhode Island
testing facility in! 1974. Factory Mutual 's conclusion was that smoke End
heat vents were detrimental to automatic fire sprinkler operation and thus
should not be installed in sprinklered buildings. Unfortunately, what is riot
commonly known is that due to the constraints of the Factory Mutual testing
facility, these tests have no similarity with real world applications or use
of smoke and heat vents . The most striking problem, for example, is that the
testing used vents placed on vertical wall secti,- not the horizontal
ceiling, as found in real world application. This and other problems, in the
committee's opinion, completely invalidate Factory Mutual ' s testing.
In 1982 the Illinois Institute of Technology Research (IITF''I ) began IITRI
Project JO 8.385 - Fire Venting of Sprinklered Buildings . This project
consist, of experiments and testing designed to assess the influence of
autolratic fire venting on the interaction of automatic fire sprinklers .
Eleven full-scale fire tests were conducted with automatic sprinklers and
smoke and heat vents to determine the t:ehavior of each. The IITRI testing
concluded that "the ability of 1.65"F-rated automatic spr'.nklers to control ,
or nearly control, a fire otherwise capable of growth, in a :large one story
structure, is not impaired by the presence of automatic fire vents of typical
spacing and area. " Furthermore, "venting appeer.o, to play a stronger positive
role on 286°F sprinkler controlled fires , based solely on tests with propane f
fires . " In other wards, the smoke and heat vents had no detrimental affect
on the automatic fire sprinkler syster; activation.
The National Institute of Standards and Technology Building and Fire Research
Laboratory (NIST) is nearing the conclusion of a two year study designed to
irvestigate fi.r_G sprinkler and smoke and heat interaction. The key ;.;.
objectives of the project, wenn to complete a collaborative research effort
between NIST and Fac.:toxi.1 Mutual Research, develop a computes model , LAVENTS
(L-ink Activated Vents and Sprinklers) to simulate the interaction of fire
sprinklers and smoke and teat; vents, and finally to conduct :full-scale fire
tests to validate the LAVED. r"l,_' model. All but the full-scale fire testing has
been completed. one result from this study indicated that ceiling vents can
have a significant effect;, on controlling the thickness and temperature of
smoke layers to avoid the deleterious effect of "smoke-logging" trdt is i
typically brougnt about. by sprinkler operation.
Other research projects are underway in Europe. The Swedish Fire Research
Board has established an ad hoc committee to study this topic. This
committee consists of an .-Interna--ional collection of experts on smoke and
heat venting. From this committee, a recent. research project conducted by
COLT International in Ghent, Belgium; was made public. This project
consisted of full-scale fire testing to expir. re the fire sprinkler smoke vent
Phenomenon. Preliminary results show that the ventilation system had little 5'

effect on the opening times of the first sprinklers. Other testing done in
vortsmouth, England, also by COLT International, indicated that temperature
rise in the buildings without fire ventilation was over three times the
temperature rise in the buildings with fire ventilation. In addition,
ooeration of the ventilation system did not hamper the operation of fusible
link devices which were set to simulate the operation of fire sprinklers.

Standard automatic sprinklers control fire by cooling the fire itself, and
prewetting the area around the fire thus impeding fire growth. Installation
of curtain boards could prevent this prewetting of adjacent areas and

the ceiling temperature and ceiling jet or heat velocity. The LAVENTS model
shows that inst�Al'ling curtain boards will cause tubulance as the ceiling jet
makes contact with curtain board. The tubulance could affect the response of
the sprinklers and cause skipping of adjacent sprinklers .
This concept is confirmed in NFPA 13 , which requires smaller sprinkler head
placement ' (130 square .feet maximum) for sprinklers located below panalized
roof systems than sprinklers located below a smooth ceiling ( 200 square feet
maximum) . It is thought that due to the irregularities in the surface below
rhe panalized roof system pocketing of heat and the prementioned tubulance
can cause skipping of adjacent sprinklers. Thus sprinklers are placed within
these pocket areas .

absence of any commEnts to the writer within five days after the date noted
above, the following will be assumed to be correct and we shall proceed with the
project as stated below.
1. Pac Trust should be kept informed about timing and scheduling of this
project.

3. Mackenzie Engineering was authori,,,ed by Mark Beers to proceed with
completion cf civil documents.
4. Dependent on project. timing, Home Depot may permit and contract grading
separately (from she building) .
5. Haul routes for Soil Fxpurt are dependent on street conditions. GFA will
consult with Mackenzie Engineering r2loarding a specification it:em
concernin(, the cleaning and maintenance f.;f the haul route.
6. Mackenzie Engineering will resubmit the site package to the city on
3/10/93.
7. Jim Jaqua stated that, the City of Tigard had no objections to CFA's letter
of 2/25/93, regarding code and permit requirements (see attached copy) .
B. Mark Beers stated that to meet the current schedule, bl-ilding construction �
must start the last week of April . If required, a Foundation Permit can
be obtained,
9. From the start of construction, substantial completion of the site and the
building will take 140 days.
10. GFA will have their MEP research the Oregon Energy Codes to verify that
Home Depot is in compliance.
11 . Mark Beers stated that Home Depot would like to use a "Detex like" panic
hardware connected to the building smoke detection system. The hardware
is designed to delay the opening of the exit by ± 15 seconds (unless a
building fire has been detected) to prevent theft of merchandise. Jim
Jaqua and Gene Burchill stated that plan check of this item will be per
UBC - Section 3304 (e) . Tomes and Associates will investigate this
s,,stem's requirements.
12. she double detector check valve is required to be located inside of the
Fuildiny or inside of a vault due to the possibility of freezing
temperatures. Home Depot and Tomes and Associates to determine location.
13. The Building and Fire Departments were informed that the fire protection
documents submitted at time of permit will be the construction documents. S..
For pl,n check, the cost of the fire protection system should be included
in the puilding valuation for inclusion into plan check and permit.
14. Propane tanks require separate permits.
15. The City of Tigard has no objections to using the propane tank for fork
lift fuel as the fuel source for the emergency gener 'tor provided Home
Depot gives the City of Tigard a written agreement stating that adequate
fuel for an emergency will be maintained at all times.

16. No hoses and cabinets are required at the small hose connections on the _
fire protection system.
17. Tomes and Associates will document to the Fire Marshal `_i;e request for
elimination of the smoke curtains (per alternate materials and methods i
process) .
18. The Fire Department typically requires therms-electric links for the
release of the smoke vents, but are open to either methods. Tomes and
Associates will investigate Mark Beers' recommendation of a radio
controlled release. Mark Beers will have the system's installer
demonstrate this for the Fire Department.
19, The Fire Department requested that the middle pair of emergency exits on
0P buildings west wall to be moved to align with the cross aisle.
20. See attached letter from Tomes and Associates regarding fire code issues.

1. Fire department access road width of 20 ft. shall be maintained. Roads as shown
on the plan are acceptable.
2. Fire department access road turning radius is acceptable as shown on the plan.

3. Access doors every 100 ft. are required per Article 81 of the UFC.
4. Fire hydrant spacing and location is acceptable as shown on the utility plan.
5. Hydrahts will be public, located on an easement.
6. The firo department connection (FDC) will be locates; within 70 ft. of a fire hydrant

and will be piped to an island. The check valve and ball drip will be located in a
below ground vaul'. A single 5 in. connection with 8 in. piping will be provided.
7. Fire sprinkler control valves will be wall indicating control valves (WPIV) located
on the building wall exterior. f
8. Fire flow will be calculated using UFC Appendix III-A and a 1.3 multiplication
factor. This method results in a 2,600 gpm required fire flow taking a 75% credit
for sprinklers and electrically supervised system.
9. A double detector check (DDU valve will be provided at the connection to the
public water supply. DDC location will either be inside the building or within a
below grourri vault due to freezing conditions.
10. A hazardous materials submittal package will be forwarded to Gene Birchill.

11. Panic hardware with a 15 second delay requires smoke detectors throughout the
building per UBC Section 3304(e).
12. Proposal to eliminate draft curtains and increased venting ratio was givers to Gene
Birchill. j
13. Remote operation of smoke and heat vents will be required. This may be
accomplished by pull cables, thermal electric operated links, or radio controlled j
released unit.
14. A single propane tank for back-up power generator and fork-lift supply it
acceptable.
15. A fire sprinkler design of 0.60 gpm/sq. ft. over )00 sq. ft. is acceptable.

6. PLAN CHECK:
a. Four sets of drawings and two sets of specifications are required
for plan check.
b. Stamp and signature are required on all drawing sheets submitted for
plan check and permit.
C. First comments can be expected two to three weeks after submittal
d. Site permits can be issued separately.
e. Foundation, permits can be issued separately.
f. Unless the revisions are extensive, no extra fees are required for
plan check.
g. A temporary Certificate of Occupancy will be issued to merchandise
shelves provided that all life safety items are installed and
operational .
h. Electrical and Mechanical Permits are issued by the County to the
electrical and mechanical contractors.
i . Plan check fees are based on building valuation. If a building
valuation has not been determined, the fees will be based upon the
valuation tables of the UDC.
7. FIRE PROTECTION:
a. Two separate sprinkler systems are required for buildings over
60,000 s.f.
b. Additional fire protection items will be addressed to you by Tomes
VanRickley and Associates, Home Depot's fire protection consultant.
