assignments to city address assignments. The following is a list of those
changes the county has made within Tigard•s city limits to date. In
conjunction to the addreos changes, the postal service has changed the zipcode

AGREEMENT
This Agreement is entered into this 27th day of
December, 1988 , between LEONARD DAVIS and MILDRED DAVIS ,
hereinafter collectively referred to as "DAVIS" or their land as
"the DAVIS property" and WII.L`rER WEST, an individual, and
WEST-BELL, INC. , an Oregon corporation, hereinafter collectively
referrrad to as "WEST" or their land as "the WEST property." The
DAVIS property is described as follows:
A portion of Lots 33 and 34, MILLARD AND VAN SCHUYVER TRACTS, in
the City of Beaverton, County of Washington and State of Oregon,
more particularly described as follows :
Beginnina at the Southeast corner of Lot 34, MI'UARD ANY) VAN
SCHUYVER TRACTS, as shown on the recorded plat thereof, and
runnina thence North 312. 3 feet al,)nq the East line of said Lot
34 to a point.; thence North 88032136" West 294.98 feet tc the
South line of S. ;l. Schools Perry Road (County Road No . $312) ;
thence continuing West to the center line of said County Road
812 ; thence Northeasterly along sal 1 center line 58. 55 feet to
point; thence South 88032' 36" East to the South line of County
Road No . 812 ; thence continuing Scuth 88032 ' 36" East 263 feet_ to
a point; thence North 89 . 69 feet, more or less , to a point;

WHEREAS , the DAVIS property adjoins a public roadway on
its west boundary which does not have public sanitary sewer or
water access; and,
WHEREAS , the existing drainfielt' troin the DAVIS
property may be affected by the improvements on the WEST
property; and,
WHEREAS , WEST has applied for approval from appropriate
governmental authorities for connection of the WEST parcel to a
public sewer system without including the DAVIS property in that
application; and,
WHEREAS, the part* s, mindful of the delays and

expenses which would be incurred by WEST to modify the applica-
tion to include the DAVIS parcel , have agreed that WEST shall
provide in the actual sewer service to be constructed on the WEST
property for the installation and connection of the DAVIS parcel
sanitary sewer lines to the WEST parcel', and that WEST shall
provide in the water.•-fire line to be constructed on the WEST
property for the installation and connection of the DAVIS parcel
water .line;
NOW, THEREFORE, the parties agree as follows:
1) WEST shall. construct, at its own expense, a water-
fire line which shall be located sufficiently near the DAVIS
property to allow installation by DAVIS , at DAVIS' expense, a
water line suitable for residential service onto the DAVIS
property;
2) WEST agrees to provide, at WEST' s expense, sanitary
sewer lines intended for use by a single family residence to the
property .line of the DAVIS property at the closest possible point
to the DAVIS' house, giving due regard to maintaining the slope
necessary to enable the line to flow properly;
3) WEST' s installation of improvements on the WEST
property shall not damage or interfere with the existing septic
system and drainfield servicing the DIXIS property until, such
time as DAVIS has connected the DAVIS property' s sanitary sewer
system to the system to be installed by WEST, provided however
that such installation shall be completed by DAVIS within 30 days
after the completion of the DAVIS sanitary sewer line;
4) DAVIS agrees to connect to the sanitary sewer
system provided by WEST at DAVIS' expense and terminate use of
the drainf.ield when WEST has made the sanitary sewer line
available as set out above , but in no event later than 30 days
after WEST has finished installation of the sanitary sewer line;
5) Each party agrees to be responsible for the mainte-
nance and repair of that portion of the sanitary sewer system
which lies on their respective property.
6) In the event suit or action is instituted to
enforce any of the terms of this Aqreement, the prevailing party
shall be entitled to recover from the other_ party such sums as
the Court may judge reasonable as attorney fees at trial or on
appeal of such suit or action in addition to all other sums
provided by law.
The mutual obligations of the Agreement shall survive

the closing of the. sale of the above-described proper-y and shall
bind the parties until fully satisfied.
