My name is �Byr . Swanson . On 19 July 1985 1 bought a new house
from a b ' Micheal R. hnson . My home address is :

Within a few days of mo, iiig in to our new home our back yard
became flooded with water that flowed '.n from other lots up the
street . That in Itself wouldn ' t have o-en a big problem except
that it did not drain from our yard . The soil here is clay and
once it becomes wet anything sinks in it . It _just turns to mush .
I contacted the builder about the lack of drainage and he said it
was now my problem and I would have to take care of it by
landscaping . I have tried that and it didn ' t help. I have had
standing water in my yard since moving in ( and this being the
driest year on record in the Portland area . )
Numerous times I have placed calls to the builder only to be put
off or for my requests for a return call to be ignored . Finally ,
just after Thanksgiving I reached him on the pho 0 once again
ask him to fix our drainage problem because at th— time there was
water under the house deep onough that the heating ducts tire
pattially submergered . After our phone conversation he culled
back to say that the house was built without a crawl space drain
provided . He said he would got something done about it . Well ,
here it is over a month later and several phone calls to him Intor
and nothing has been done .
At this point- I fear that subs-3ntial weakening of the foundation
and the structure of the building itself may have already tokon
place. Eventually , it could lead to failure of the foundation and
permanent damage to the house . With the lack of response from the
builder , it seems to be his tactic to put me off until the one
year warranty time has expired .
After further investi.gatfon into the drainage problem, I .im nit
the only one with standing water in my yard . My neighbors un hath
sides and houses do and three lots tip have unusable back ►•aids
and some hale water in t:je crawl spaces up to dight inches doer .
In general , drainage for the yards on this side of the street has
not been provided for !
Looking into it a bit- further reveals that the majority r: the
water is coming from yards behind our neighbors . These yaids arf.
drained into our back yards rather then the streets in front of
their homes . This must have been done intenti.onal.l) by the
builders and developer !
The developer of this area is Russell A. Krueger .
We have had the building inspectors from the city of Tigard come
out to look. They only had to make a short inspection to see that
drainage was inadequate and they stated that it needed to be
fixed ! As a matter of fact they suggested that this letter be
written. The inspectors were here just last. wee ( . Toey are:

Other ucw houses have similar problems that: may not be as severe
as ours . Please help get this problem fixed . Orr builders are
appa-ently not interested in fixing the mess they left . Any
