Dear Mr. Kron:
As T discussel with you on octobeT 99 1987, it has been determined that the
fence posts you have Installed along Winterlake Drive are not only in
violation of the setback requirement_, of the Tigard Municipal Code, they are
also located within the public right-of-way. You must take immediate action
to remove the fence posts.
I have enclosed a summary of the City's requirements pertaining to fences and
walls. As you will notice, a two foot fence setback from the right-of-way
line is required in aide yards of corner lots such as yours. Unfcrtunately,
the diagram noes not accurately represent your situation. The diagram allows
the inner edge of the sidewalk and the right-of-way line as conterminus. In
your situation the sidewalk is adjscen, to the street and the preen strip is
Located between the sidewalk and property line. The right-of-way extends to
the property 'line represented by the survey staKe you removed to install your
northeast corner fence post. The fence posts must be r_elocatee less than
two feet 1naidt! of that line.
if you believe that an undue or unnecessary hardship would result from the
literal interpretation of the fencing requirements of the Tigard Municipal
Code, you may apply for an administrative variance to those requirements.
Contact me if jou wish to discuss this procedure and the criteria for granting
a variance. The fee for applying for a variance is 6200.
Please contact me within ten days of the date of this letter to 1r!t me know
what Vol, will do about the fence posts.
